HomeMy WebLinkAbout1959-04-272O3 Monday, April 27, 1959 Special Meeting special meeting of the Board of APPeals was held onMonday, April 27, 1959 7:30 E~at the TownBuilding. ~nbers present and voting were: Daniel T. 0'Leary, Chairman, Charles Foster Jr. Henry Lund, Howard Gilman andAlfred Boeglin, Associate Member. The election of o~ficers for the comin~ year was held. Mr. Lurid nominated Mr. OILeary to act as Chairman of theBoard. Mr. Burke seconded the motion. Unanimous vote. Mr. Burke nominated ~lr. Foster to.act as Secr.~tary. Mr. Lund seconded the motion. Unanimous vote. 1st hearing. Mrs. Rose Filetti petitioned for the erection of a motel located at 209 Chickering Road. Atty. ~Echael Ste~la represented ~s. Filetti who was unable to be present due to illness. Atty. Stella pointed out due to the change in the Zoning By Law it was necessary for them to appeal to the Board of Appeals and that everything was the sa~e as it was when they .petitioned the Planning Board. Mr. John Osgood, an abbutter appeared before the Board and asked what was meant in the legal notice whenit stated ~s. Filettiwanted a variance. Acco~ding to his understanding A Special Permit was needed and no variance. Mr. Osgood stated he felt the hearing was illegal as a variance was not sought for. Mr. O'Leary asked the Board how they felt and it was voted that the hearing continue and legal information would be received from Town Counsel Mrs. Nortate Rogers, 580 Osgood Street suggested the hearing be held and if the Town ~ounsel agreed the hearing was legal everyin~ woo2d be taken into consideration. Edward Phelan, an Assessor brought out the fact a variance wasnot needed but the oetitioner~as asking for a special permit. Atty. Stella stated he felt a variance or special permit meant th~ same thing although he felt a variance Mas stronger than a variance. Mr. Lund moved to take the matter underad~isementand to act on the adviea ofthe Town Counsel. Mr. Burke seconded the motion. Unanimous vote. Atty. Daniels appeared before theBoard with more detailed information on the restaurant for mdMard Keeler. He pointed out the State controls the lighting, entrances, drainage etc. that would be srected. Mr. Boegltn ~sked if the size building could be shown on the plan and type of building proposed. 204 Atty. Daniels agreed to get ~ore detailed plans as will be submitted to the Building Inspector, A bill for $17,05 was signed for l,~ry Doherty. The meeting adjourned at 9:00 PM Clerk
