Dear Sir: A public hearing was held by the Board of Appeals on December 11, 1972 upon application of BRUNO J. FALAWA who requested a variation of Section 6.21 Table 2 of the Zoning By—Law so as to permit the division of a parcel of land into two lots, both having the required area, but one lot lacking approx. 8 feet of the required 150 feet frontage; located at the east side of Johnson Street, approx. 200 ft, from the comer of Mill Road and known as 60S Johnson Street. The following members were present and voting: J. Philip Arsenault, Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R. Drummond, Frank Serio, Jr. and Associate Member'Louis DiFruscio. The hearing was advertised in the Lawrence Eagle—Tribune on November 25 and December 2, 1972 and all abutters were duly notified by regular mail. Mr. Falanga appeared on his own behalf and explained that one lot lacks S feet frontage but has 1.2 acres and the other lot meets all of the zoning requirements so that he is seeking a variance for the lot lacking the S feet frontage. Several abutters were concerned because there is a drainage problem. Mr. Falanga said there is enough area so that there shouldn't be any problem as far as drainage goes. There are other lots in the area lacking frontage so that he is not asking for too much. Dr. Beliveau made a motion to take the petition under advisement and that the Board would view the premises; Mr. DiFruscio seconded the motion and the vote was unani— mous. At a meeting held on January 3, 1973, at which the same board members were present, the Board reviewed the petition after having viewed the premises. Mr. Serio made a motion to GRANT the variance; Mr. DiFruscio seconded the notion. Four members voted yes and Member Drummond abstained from voting. k A Bruno J. Falanga —2- January 12, 1973 The Board viewed the premises and found that the lacking of B feet frontage was not a substantial derogation from the intent or purpose of the By—law and that there would be a hardship if he were not allowed to divide his property in this manner because of the topography of the area, and the drainage involved.
