Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening* July 61 1970 at 7:30 P.M. in the Town Office Building. The following members were present and voting: William Chepulis, Jr., Chairman; Robert J. Burke, Charles W. Trombly, Jr., Vice Chairman; John J. Monteiro, Secretary; and Donald N. Keirstead. ARTHUR F. KENT petitioned to subdivide a parcel of land containing approximately 12.6 acres on the east side of Johnson Street near its intersection with Summer Street. The definitive plans showed 8 lots, all of which meet the requirements under the Subdivision Control Law. The roadway to the turnaround is approxi.ma*ly 750 feet long. James Champy is the prospective purchaser and developer of the subdivision; John Callahan Associates are the engineers. Preliminary plans had been presented and several changes were made as suggested by the Highway Surveyor and Board of Public Works and the Planning Board. There were several abutters present who asked questions relative to the drainage, contours, etc. Mr. Keirstead made a motion to take the petition under advisement; Mr. Trombly seconded the motion and the vote was unanimous. A meeting was held on Monday evening, Aust 3, 1970 at which time the same members were present and voting. Letters were received from the Board of Public Works, the Highway Surveyor and the Board of Health. The Board discussed and voted on the petition. Mr. Keirstead made a motion to APPROVE the subdivision subject to certain conditions as listed below. Mr. Monteiro seconded the motion and the vote was unanimous. The conditions are as follows: 1. That the record owners of the subject land execute and record a "covenant running with the land" within 20 days from the date of this decision, or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as provided by G.L. c. 411' s. 81-II. 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. r ARTHUR F. KENT � —2 August 4, 1970 3. That, as required by the North Andover Board of Health, no building or other structure shall be built or placed upon lots as shown on said plan without the prior consent of said Board of Health. 4. That water and sewer will be according to the rules and regulations of the Board of Public Works, and as specified in Board of Public Works letter dated June 30, 1970. 5. That surface drains and street bounds must be installed; the roads must be hot— topped and constructed all in accordance with the requirements under the Subdivision Rules and Regulations of the Planning Board. Proper street signs must be installed. Provisions are to be made for possible future installation of sidewalks on one side of the roadway. Appropriate inspections for the satisfactory completion of the pro— visions in this paragraph are to be performed under the direction of the Office of Highway Surveyor. 6.
