Conservation Assessors Erich Nitzsglq Police Chief, Engineer Fire Chief, Interested Parties Michael .Leary Applicant, File '' ' ' ' ' ' 'plunni�g Board ° Texaco Station - Repetitive Petition Pursuant to Chapter 40A, Section lb and Section 10.8 of the Zoning Bylaw, the Planning Board finds that the petition before us has the following specific and material changes in conditions upon which the Board of APpeal.s based its previous unfavorable action: 1 . The applicant was unable to have a proper hearing before the Board of Appeals due to his failure to appear or to request and extension on his application. Due to the statutory time constraints imposed upon the Board , a decision has to be made and filed with the Town Clerk . The Planning Board finds that the applciant has not had a full and complete hearing on his application and is entitled to have the matter decided upon the merits of his proposal . 2. The Board of Appeals requested additional information be supplied by the applicant in order to adequately review his application. The Planning Board finds that the applciant has plans which should prove sufficient to the Board of Appeals to properly review and take action on his proposal . 3 . The new plans presented to the Planning Board during the public hearing show changes to the proposal not originally before the Board of Appeals at the time they denied the application. Further the Planning Board has discussed and the applicant has agreed to place the proposed canopy further back from the Route 125 right-of-way, remove any signage from the canopy and to place additional landscaping on his site to further screen the site from Route 125.
