TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS December 21, 1964 Dear Sir: The following petition was heard at a meeting of the Board of Appeals on Monday evening, December 3-4, 1964 at the Town Office Building. Members present and voting were: Daniel T. O'Leary, Chairman; William Morton, Secretary; Henry E. Lund, Arthur Drummond and John J. Shields. SALVATORE & FRANCES FICHLU and JOSEPH & ALFIA TOT%AMLI requested a variation of Sec. 6, Para. 6.31 & 6.62 of the Zoning By-Law so as to permit the combination of three existimg '50N100 lots into two 75x100 lots on the premises located at the south side of Mablin Avenue at the corner of Kenwood Street. This public hearing was advertised in the Eagle Tribune on November 23 & 301 1964. All abutters were duly notified by certified mail of this hearing. The petitioner was represented by Atty. Charles W. Trombly, who reviewed the history of the land and the objective of Salvatore & Frances Fichera, in-laws to the petitioner, that it was decided to create two homesteads, one for his son and one for his daughter. That there existed three 50x100 ft. lots bounded by Kenwood Street and Mablin Avenue, with 150 ,ft. frontage on said Mablin Atenue. I That Atty. Trombly indicated that under the provisions of Para. 6.62 under the current I'f Zoning By-Laws, two lots of record could be permitted to be combined into a new lot on not less than 10,000 sq. ft. area and not less than 100 ft. width at the street front- age, which if this was granted would leave an isolated lot of 50 ft. street frontage and a total of 5,000 sq. ft. Atty. Trombly indicated that the plan as submitted was more eauitable. There were no other persons to speak either in favor or in opposition to the petition. The petition was taken under advisement. The Board, after further study and consideration, feels that the presentation of Atty. Trombly was well taken and that the petitioner, subject to the approval of the Board, could sub-divide the three lots into one of 10,000 sq. ft. leaving an isolated lot of 53,000 sql ft. That if this procedure was followed, which is permissive under Para. 6.62 of the Zoning By-Law, that it would be the least desired sub-division of the 155,000 ft. parcel and that the sub-division plan as presented showing two lots, namely (Cont. on page 2) �y0RTy 7 0?.• '• g ����r•O Oe�� y.• 1855 p� }s�SgCH6g KA� S-4 APRILTM :W tyrw•,.<< TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS -2- December 21, 1964 lot A and lot B each containing 7,500 sq. ft. with 75 ft. frontage, it would reflect the highest standard of land planning, would result in better proportion of each lot proposed and should give the greater potentiality of up-grading the final end use of the three lots of record into two new proposed lots. Dear Sirt The North Andover Board of Appeals met in the Town Office Building on Tuesdays April 21, 1970 with the following members present and voting: Arthur R. Drummond, Chairman; Daniel T. O'Leary, Secretary; Philip Arsenault, Esq., Donald J. Scott and James A. Glynn, Jr., Esq., Associate Member. A hearing was held in the appeal of Salvatore and Frances Fichera who requested a variance under Section 6.31 and 6.62 of the Zoning By-Law so as to permit the combination of six lots presently having a 50-foot frontage, into four lots each having a 75-foot frontage and to decrease front depth to 20 feet, on the premises located at the north side of Shawsheen Road at the corners of Ingle- wood and Jetwood Streets. The hearing was advertised in the Lawrence Eagle-Tribune on March 28 and April 4t 1970 and all abutters were duly notified by certified mail. The petitioners were represented by Atty. Charles W. Trombly, Jr. who stated that the property was located on the north side of Shawsheen Road, at the corners of Inglewood and Jetwood Streets. The six lots are desired to be combined into four lots with a 75-foot frontage, the six lots now having a 50-foot frontage and to decrease the front depth to 20 feet. Appearing in opposition was Paul Timony, an abutter. The Board, in its decision, considered the land did not meet by a considerable margin the requirements of each lot having a 100-foot frontage and if being combined must be at least 10,000 sq.- ft. in area. No hardship was noted to the owners. Upon motion of member O'Leary, seconded by member Glynn, the vote was to DENY the variance. Dear Sir: A public hearing was held by the Board of Appeals on April 10, 1972 upon application of SALVATORE '& FRANCES FICHERA who requested a Special Permit under Sec. 6.62 of the Zoning By Lax so as to permit the combination of six lots, each having a 50•-foot frontage, into three lots, each having a 100-foot frontage, and containing 10,000 sq. ft. each; and to decrease front depth to 20 feet in keeping with other houses in the neighborhood, located at the north side of Shawsheen Road at the corners of Inglewood & Jetwood Streets. The following members were present and voting: J. Philip Arsenault, Chairman; Kenneth E. Pickard, Vice Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R. Drummond and Frank Serio, Jr. The hearing was advertised in the Lawrence Eagle—Tribune on March 25 & April 1, 1972 and all abutters were duly notified by regular mail. Atty. John J. Lynch represented the petitioners. He stated that there had been a previous appeal on this same area which had been denied, for division into four lots. He explained that the Zoning By—Law allows, by special permit, for lots having 10,000 sq. ft. and 100 ft. frontage; Water and sew6r facilities are available. These lots meet all of the requirements of Section 6.62 of the Zoning By—Law. No one else spoke and there was no opposition. The petition was taken under advisement and further reviewed at a Board of Appeals meeting on May 89 1972 with the same members present. Mr. Serio made a motion to GRANT the variance; Mr. Drummond seconded the motion and the vote was 4 — 1, Dr. Beliveau voted no. Trombly represented the petitioner, who vas also present. TbM were no abutters present and there was no opposition. Atty. Tramp stated that there were sever and water facilities on the street and that the approval of these lets would help the Town since homes would be built and it would mean xore tastes. These lots are at the very end of Inglewood and Jetwood Streets and were originally de— veloped in 5 100 sq. ft. lots. Mr. Fiches and Mr. Bootaaa were recorded in favor of granting the petition. In Executive session, after thorough discussion, Mr. Drummond made a notion to NW the variance, Mr. Deyo seconded the motion and the vote was . The petition is denied for the lolloving reasons* 1. The applicant will staffer no substantial hardship, financial or otherwise, by the denial of this petition. 2.
