A public hearing was held by the Board of Appeals on December 13, 1971 upon
application of HENRY & BEMCE FINN who requested a variation of Sec. 4036 of
the Zoning By—Lax so as to permit owner occupancy of the upper level of a
mercantile building for personal living quarters; on the premises, located at
the east side of Turnpike Street at the corner of Johnson Street and known as
1250 Turnpike Street. The following members were present and voting: J. Philip
Arsenault, Chairman; Kenneth E. Pickard, V. Chairman; Dr, Eugene A. Belivesu,
Clerk; Arthur R. Drummond and Associate Member James A. Glynn, Jr. who sat in
place of member Frank Serio, Jr.
The hearing was advertised in the Lawrence Eagle-Tribune on November 27 and
December k, 1971 and all abutters were duly notified by regular mail.
Mr. Fink appeared on his own behalf and explained that he has been in business
for 19 years at the corner of Hillside Road and Rte. 125 and has lived there.
He wants to expand and there is no room where he is. He acquired the property
on Rte. 114 and would like to build his business building there and wants to
live on the premises in order to conduct the business. He makes concrete forms
and statues and because of vandalism it is necessary to be on the premises at
all times. He said there would be no signs.
No one else spoke and there was no opposition.
The petition was taken under advisement and during this period was reviewed by
the $card. Mr. Drummond made a motion to GRANT the variance; Mr. Pickard seconded
the motion and the vote was unanimous.
The Board found that if the petitioner was not able to reside on the business
premises, it would result in a hardship to him in that the products are highly
susceptible to vandalism and theft and require constant supervision. A single
residence providing living quarters on the second floor of the business building
would not be detrimental to the neighborhood.
