Town Clerk Town Office Building North Andover, Mass, Dear Sir: A public hearing was held on May 10, 1971 upon application of Edward Fionte and others requesting a variation of Sec. 6.32 and 7.22 of the Zoning By-Law so as to permit the division of a parcel of land into two lots, each having less than the required frontage and area; on the premises located at the east side of Longwood Ave., approx. 500 feet distant from the corner of Chestnut Street and known as 82 Longwood Avenue. The following members were present and voting: J. Philip Arsenault, Esq., Chairman; Dr. Eugene A. Beliveau, Clerk; Kenneth E. Pickard, Arthur Drummond and Frank Serio, Jr. The hearing was advertised in the Lawrence Eagle-Tribune on April 24 and May 1, 1971 and all abutters were duly notified by regular mail. Atty. Clifford E. Elias represented the petitioners. They desire to divide a parcel of land into two lots; lot A to contain 81141 square feet and lot B to contain 8,236 square feet; each lot having 80 feet frontage. The area is zoned country residential which requires 25,000 square feet area and 125 feet frontage. There is presently a dwelling on lot A which requires a sideline setback variance. They would like to erect a dwelling on the second lot..a member of the family presently living in Haverhill. Most of the lots in the area have less than 125 feet frontage and less than 25,000 square feet area. This would not be detrimental to ,the area and would be in keeping with the general character of the other lots. There is water and sewer available and it would be a hardship to the petitioner to own the land as it is presently constituted. No one else spoke and there was no opposition. The petition was taken under advisement and during this period was reviewed by the Board. The Board found that the petitioner presented no evidence of hardship and that to create lots with areas of 81141 and 81236 square feet would be a serious deviation from the intent or purpose of the Zoning By-Law. Dr. Beliveau made a motion to DENY the variance; Mr. Serio seconded the motion and the vote was unanimous. Very truly yours, BOARD QF APPEALS J.
