Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening,
February 11, 1985 upon the application of Richard and Lillian
Lafond. The hearing was advertised in the North Andover Citizen
on January 24 and 310 1985 and all abutters were notified by
regular mail . The following members were present and voting:
Frank Serio, Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice
Chairman; William J. Sullivan; and Associate Members Walter F.
Soule and Raymond A. Vivenzio, Esq.
The petitioners seek a variance from Section 4, Paragraph 4. 122
(4a) of the Zoning By Law so as to permit a home occupation in a
dwelling not occupied by the owner of the occupation on premises
located at 396-398 Andover Street in the Residential-4 (R-4)
zoning district .
Mr . Richard Lafond testified that he proposes to re-locate his
business from its present location to the dwelling at 396-398
Andover Street . The business will employ himself, his wife and
their son in approximately 25%, or one-half of the first floor , of
the dwelling. The second floor would continue to be used as a
residence. The only structural changes proposed are new paint for
the dwelling, landscaping, and slight re-location of the parking
area. Neither he and his wife nor their son propose to reside in
the dwelling as required under Section 4, Paragraph 4. 122 ( 4a) of
the North Andover Zoning By Law. All other conditions of this
section will be met according to the petitioner .
Several neighbors from an abutting subdivision spoke in opposi-
tion to the petition. The main reasons for the objections were
increased traffic and congestion in the neighborhood.

Upon a motion made by Mr . Frizelle and seconded by Mr . Vivenzio,
the Board voted four to one, with Member Sullivan abstaning, to
deny the petition.
The Board has determined that the request is for a variance in use
or activity which is not permitted in the Residential-4 zoning
district under the North Andover Zoning By Law.
