Deat+ Sir: The following petition was heard at a meeting of the Board of Appeals on Monday evening, October 14, 1963 at the Town Office Building. Members present and voting were: Daniel T, O'Leary, Chairman; William Morton, Secretary; John J. Shields, Arthur Drummond and Robert J. Burke, who sat in place of Henry Lund. JOSEPH LANE requested a variation of sec. 6 & 7, Para. 6.31 & 7.23 of the Zoning By-Law so as to permit the division of three existing lots of land into two lots, as shown on the plan; and erect a Cape Cod house on one of the lots thus formed, on the premises located at the west side of Fernwood Street; 100 feet distant from the corner of Massa- chusetts Avenue and known as Lots No, 19, 39 and Io. This public hearing was advertised in the Eagle Tribune on September 30 and October 7, 1963. A11 abutters were duly notified of this hearing by certified mail. Mr. Stephen Doherty represented the petitioner. Only two abutters appeared in protest, after the hearing was over. The Board discussed and voted on the petition. Mr. Burke made a motion to GRANT the variance subject to making lots 39 and 40 into one lot marked OBu and lot 19, one lot marked "AN on a corrected plan. 15r. Eorton seconded the motion. Four members were recorded as voting in favor; Mr. Drummond abstained from voting. This variance is granted for the following reasons: 1. There exist certain conditions, especially affecting the parcel in question, which do not generally affect the entire zoning district in which the parcel is located. 2. Unless the variance is granted, the applicant will stiffer substantial hardship, financial or otherwise. 3. The requested variance will not adversely affect the public good to any substantial extent and will not materially affect the general character of the neighborhood. 4.
