Dear Sir: The following petition was heard at a meeting of the Board of Appeals on Monday evening, June 14, 1965 at the Town Office Building. Members present and voting were: Daniel T. O'Leary, Chairman; William Morton, Secretary; Arthur Drummond, John J. Shields and James Deyo. JOE'S DINER (Margaret L. Legault) requested a variation of Sec. 7.3 of the Zoning By-Law so as to permit an addition to the present restaurant to serve as a take-out area for food and ice cream on the premises, located at the east side of Osgood Street known as No. 1211 Osgood Street. This public hearing was advertised in the Eagle Tribune on May 29 and June 7, 1965. All abutters were duly notified by certified mail of this hearing. Mrs. Legault appeared on her own behalf and explained that the land on which the restaurant is located is owned by Stefanowicz and that she wants to make an addition to be used as a take-out service for food and ice cream. George Barker, Sr. and George Barker, Jr., immediate abutters, were opposed, saying it would be detrimental and would create a worse parking problem than what already exists. Two other neigh- bors were also recorded as opposed, mainly because of the parking problem as regards to Barker Street. This proposed addition would come nearer than the allowed set-back under the Zoning By-Laws. In Executive session, after a lengthy discussion, Mr. Drommond made a motion to DENY the variance. Mr. Deyo seconded the motion and the vote was unanimous. This petition is denied for the following reasons: 1. The applicant will suffer no substantial hardship, financial or otherwise, by the denial of this petition. Daniel T.
