The Board of Appeals held a public hearing on4onday evening,
May 21, 1984 upon the application of Robert Kereage. The
hearing was advertised in the North Andover Citizen on April 26
and May 3, 1984 and all abutters were notified by regular mail.
The following members were present and voting: Frank Serio, Jr. ,
Chairman; Richard J. Trepanier, Esq. , Clerk; William J. Sullivan,
and Associate Members Maurice S. Foulds and Raymond A. Vivenzio,
Esq. .
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7. 3 and Table 2 of the Zoning By Law so as to permit
relief from the front and rear setback requirements to allow the
continued existence of a dwelling on premises located at 201 Greene
Street.
i4r. Kereage was present and testified that a plot plan recently
drawn for mortgage survey purposes revealed that a shed on the
property does not meet the side or rear setback requirements of
the current Zoning ByLaw. A variance granted by the Board in 1959
to a previous owner allowed the construction of an addition which
did not meet the side or rear setback requirements . In addition
to the above mentioned violations , the plot plan revealed that the
existing dwelling does not meet the front setback requirement.

After reviewing the plan submitted and the application, the Board
came to the agreement that the application as submitted and as
advertised did not seek a side setback variance for the shed, so
said violation could not be addressed at this hearing.
Upon a motion made by Mr. Vivenzso and seconded by Mr. Trepanier,
the Board voted four to one, with Member Foulds voting in opposition,
to grant the variance as requested for the front and rear setback
violations of the existing dwelling.
In granting the variance , the Board finds that a literal enforcement
of the provisions of the By Law would create a hardship to the
petitioner and therefore, Section 10 . 4 of the Zoning By Law has
been satisfied.
Said variance, in .the opinion of the Board, will not derogate from
the intent and purpose of the Zoning By Law.

Dear Sir:
The following petition was heard at a meting of the Board of Appeals on Monday
evening, June 10, 1963 at the Town Office Building. YAmbers present and voting
were: Daniel T. O'Leary, Chairman; Henry E. Lund, John J. Shields, Arthur
Drummond and Associate Member Robert J. Burke who sat in place of William Morton.
The decision was made at a special meeting of the Board held on Tuesday evening,
dune 25th, with the same members present.
Robert S. gereage requested a variation of Sec. 7.3, Para. 6.11 of the Zoning
By-Law so as to permit the construction of a one story addition to the present
building to allow for expansion of hardware store, located at the northwest
side of Main Street, ]mown as No. 136 Main Street.
This public hearing was advertised in the Sagle Tribune on May 27 and June 3,
1963. All abutters were duly notified by certified mail of this hearing. There
was no opposition. One abutter was present, a representative of the Merrimack
Valley National Bank, who was in favor.
Mr. Shields made an amended motion, not to make a decision until the petitioner
submits architectural plans and gets a recommdendation from. the Fire Chief. Mr.
Drummond seconded the motion. The vote was 41, with Mr. Burke abstaining, since
he had made the original motion to grant the variance.
At the special meeting of June 25th, after proper material had been submitted,
Mr. Lund made a motion to GRANT the variance in accordance with the submitted
plans. Mr. Drummond seconded the motion and the vote was unanimous.
This variance is granted for the following reasonss
1. There wxtst certain conditions, especially affecting the parcel in question,
which do not generally affect the entire zoning district in which the parcel is
located.
2. Unless the variance its granted, the applicant will suffer aubstantW hard.
ship, financial or otherwise.
3. The requested variance will not adversely affect the public good.
4. The requested variance will not be in substantial derogation from the intent
or purpose of the Zoning By-Law.
