Gentleman: Since Mr. Marino filled in the land adjoining ours and built a good looking six room house on it, it has greatly improved the appearance of this part of Beverly Street. We feel that when the second house he is building, is completed, and the land around it graded and seeded, as he has done the first one, it too will be attractive and add to the surroundiags. Mr. Marino requested us to give you our opinion as to the land and buildings he has erected. C'Jjerary, Chairrya.-ara F j c AJA Nanry AP11L TV :; i 1 9ACHUgB� TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS November 24, 1958 A meeting was held on M nday evening, November 102 1958 at 7;30 on the application of Carmlo Marino for a variance of the requirements of Section 6, Paragraph 6.31 of the Zoning By Law so as to permit the erection of a ranch type residence on the premises on the west side of Beverly Street 93 feet distant from the corner of Middlesex Street, and being shown as Lot 49 on a plan of land entitled "Plan of Land of Carmelo Marino, North Andover, Mass., Frank A. Marino, C.E, , Dated October S. 1958"p made a part of this decision. Present and voting were: Daniel T. O'Leary, Chairman, Kenneth Theroux, SAc retary, Donald F. Smith, Robert Burke, and William Partin, Associate Member designated by the chair- men to sit in place of Henry Lund, regular member who was absent. There was evidence and the Board finds that the petitioner purchased three lots of land in January 1958, subsequent to the effective date of the Zoning By-Law. The Lot in question, Lot 49, has a frontage of 72.5 feet on the westerly side of Beverly Street. Petitioner owns two other unnumbered lots to the south of the premises in question, one of wh1ch has a frontage of 72.5 and them other, 50.52 feet. Lot 49 does not contain at least 12,500 square feet of land as required of a building lot in a Village Residence Zone. On motion duly made and seconded, it was unanimously V6TED: That the petition for variance be denied. REASONS FOR DECISION Petitioner purchased the lot in question in January 1958 subsequent to the effective date of the Zoning ByLaw. Petitioner owns itacant land adjacent to the lot for which the variance is sought which he can use in conjunction with Lot 49 to provide the necessary area and frontage.
