Dear Mr. Lyons:
A public hearing was held by the Board of Appeals on September 19, 1977 upon appli—
cation of Nicholas F. Nicetta who requested a Special Permit under Sec. 4.11 (3)
of the Zoning By—Law so as to permit a lot for residential use as shown on a plan
of land dated August 1977 located on Perley Rd. The following members were present
and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vice—Chairman; R. Louis
DiFruscio, Clerk; James D. Noble, Jr.; and Ralph R. Joyce.
The hearing was advertised in the Lawrence Eagle—Tribune on September 3 & 10, 1977
and all abutters were duly notified by regular mail.
The petitioner seeks a Special Permit to permit the residential use of a lot located
on Perley Rd. pursuant to Sec. 4.11 (3) of the By—Law. The Special Permit is sought
since the land in question is located in two zones.
Based on the testimony of the petitioner and the application, the Board found that
on June 5, 1972 the petitioner owned the land in question. Upon motion by Mr. Noble
and second by Mr. DiFruscio it was voted unanimously to GRANT the Special Permit
pursuant to Sec. 4.11 (3) and 9.3 of the By—Law. In granting the Special Permit the
Board found that the petition met each of the required elements set forth in Sec.
9.31 of the By—Law.

The undersigned wishes to record the accowpasiying plan and requests a determina-
tion by said Board that approval by it wider the subdivision Control Lary is not
required. The undersigned believes that such approval is not required for the
follotting reasons:
1. The division of land shorn on the accompanying plan is not a subdivision
because every lot shown thereon has the amount of frontage required by the
North Andover Zoning By Lary and is on a public xray, na-nely,
