H. 03038 The Board of Appeals held a public hearing on Tuesday evening, March 14, 1989 upon the application of Antonio & Francesca Nicolosi requesting a variance from the requirement of Section 7, Paragraph 7.8 and Table 2 and a Special Permit under Section 9, Parag- raft 1 and 2 of the Zoning Bylaws so as to permit operating the existing building as a proprietor business in the existing industrial district on the premises located at 242 Sutton Street. The following members were present and voting: Frank Serio, Jr. , Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule and Louis Rissin. The hearing was advertised in the North Andover Citizen on January 19, 1989 and January 26, 1989 and all abutters were notified by regular mail. Upon a'motion made by Mr. Frizelle and seconded by Mr. Rissin, the Board voted, unanimously, to allow the petitioner to WITHDRAW THE VARIANCE WITHOUT PREJUDICE and to GRANT the Special Permit subject to the following conditions; that no more than two (2) business entities, corporations, or partnerships operate from this facility and adequate (6) parking spaces be provided per the bylaw. The Board finds that the petitioner has satisfied the provisions of Section 10, Para- graph 10.3 of the Zoning Bylaws and the granting of this Special Permit will not derogate from the intent and purpose of the Zoning Bylaw.
