Lyons, Town Clerk Town Office Building North Andover, Ma. 0184.5 Dear Sir: j A public hearing was held by the Board of Appeals on March 8, 1976 upon application of the Ninety—Nine North, Inc. who requested a variation of Section 7.11 of the Zoning By—Law so as to permit the parking of 50 motor vehicles at 287 Chickering Rd, by a Special Permit. The premises are located at the East side of Chickering Rd., 100 ft* distant from the corner of Massachusetts Ave. and known as 287 Chiokering Rd. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vice Chairman; Louis DiFruscio, Clerk; James D. Noble; and Walter Jamit— kowski, Assoc. Member. The hearing was advertised in the Lawrence Eagle-Tribune on Feb. 21 & 28, 1976 and all abutters were duly notified by regular mail. Atty. Carmine DiAdamo appeared before the Board representing the petitioner. They seek the Special Permit in order to alleviate the severe parking problem and have attempted to purchase contiguous property to no avail. There is a 110 ft. right of way existing between the restaurant and the proposed land for parking. Franklin S. Davis and Ben Osgood spoke in favor of the petition. Also, Assoc. Member, Stephen Doherty urged favorable action. In opposition were Mrs. Marie Dow, Michael Warchol and George Stern. At a meeting held on April 12, 1976, the 4 members present who sat on the petition, Messers Serio, Noble, Jamitkowski and DiFruscio, voted unanimously to DENY the special permit by dismissing it without prejudice for the following reasons: the particular use sought is not allowed in an R-3 District and the petitioner failed to show that this Board had the power to grant a parking permit under Section 7.11.
