Dear Sir: A public hearing was held by the Board of Appeals on March 12, 1973 upon appli— cation of NOREN REALTY, INC. who requested a variance of Sections 6.1, 6.2, 6.3 and 6.5 of the Zoning By—Law so as to permit the relocation of lot lines in order to conform to present zoning and the allowance of the existing lots formed under the earth removal permit; located at the south side of Holt Road, approx. 80 ft. from the corner of Clark Street. The following members were present and voting: J. Philip Arsenault, Esq., Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R. Drummond, Frank Serio, Jr. and William N. Salemme. Mr. Marino appeared before the Board as representing Noren Realty, Inc. and ex- plained that there is a hardship because they were following the zoning requirements as to the sizes of the lots; the last two lots have been formed to conform to present zoning. The first three lots were terraced to conform to zoning existing at that time; he said it would be costly to make those lots conform to present zoning. He was also asking that the Board allow the setbacks as they were in the previous By— law because it would be hard to set a building on a 50,000 sq. ft. lot with the present setbacks of 50 feet. The petition was taken under advisement and during that period was reviewed by the Board. Dr. Bel.iveau made a motion to grant the variance to allow the area of 50,000 sq. ft. and 35 ft. sideline setbacks on lots 1, 2 and 3; Mr. Serio seconded the motion and the vote was 3 members voting yes and members Salemme and Drummond voting no. A Board of Appeals vote must be 4r1 or unanimous in order to pass, according to state statute. The members voting against the motion felt that the petitioner had not proven hardship. Dear Sir: Upon application of the Noren Realty, Inc. to the Horth Andover Board of Appeals for a Special Permit under Sections 5.1 and 5.2 of the Zoning By-Lava so as to permit the excavation of some 50,000 cubic yards on the south side of Holt Road., a public hearing was held on February 18, 1969. The hearing, originally scheduled for February 10, was postppmed for one week due to inclement weahher and held on February 18 in the Town Hall facilities after having been advertised in the Lawrence Eagle—Tribune on the dates Jan— uary 25 and February 1, 1969 and with all abutters duly notified by certified mail. The members of the Board present and voting were: James A. Deyo, Chairmn; Arthur Drummond, Secretary; Daniel T. O'Leary and J. Philip Arsenault, Esq. The applicant was represented by Mr. S. G. Marino, President of Noren Realty, Inc. Mr. Marino presented a drawing of the proposed excavation showing that some six lots of about an acre each were to be graded and developed on the south side of Holt Road beginning about 80 feet east of Clark Road. There were no objections presented at the hearing. After due deliberations and on a motion by Mr. O'Leary, seconded by Mr. Arsenault and unanimously approved, the petition was granted. Conditions attached to this permit are as follows 1. A performance bond in the amount of $15,000 shall be posted with the town of North Andover prior to any excavation. 2. A11 costs incurred in the execution of said bond shall be borne by the petitioner. Noren fealty, Inc. —2— March 26, 1969 3. This permit is for a one year period and may be renewed on request and favorable report from the Building Inspector, 4. Excavation is limited to the area submitted with this application. 5.
