Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening::, August 16 and September 13, 1976 at 7:30 P.PC, in the Town Office Meeting Room. The following members were present and voting: Frit:. Ostherr, Chairman; William Chepulis, Vice-Chairman; John J. Monteiro, Clerk; Paul R. Lamprey and William N. Salemme. Pr. Richard Perkins and Mr. Frank C. Gelinas represented North Andover Associates and petitioned for a subdivision of a parcel of land containing approximately 68 acres, situated off I-linter Street, subdivided into 54 lots and to be known as ";Minter Fill states". Mr. Perkins, one of the owners of the property, told the Board that the overall density of the subdivision would be 1.3 acres per house lot; that they tried not to r',isturb the terrain, give drainage protection and are prepared to give easements to the Torn at the time that the property is subdivided in order to preserve the waterways, MT. Gelinas presented plans to the Board and stated that the project would include 6100 feet of roadway, that they will bring in Town water from Winter St. and that the site is characterized by 3 ridges running south to north perpendicular to Idinter St. He further emplained drainage plans and their intention to reconstruct the meadow with a dam. There are 3 access ways to the property - from Plain St., Boxford, Foster St., and Dale St. along Winter, and there are two accesses and egresses within the locus itself. Opposition was expressed by 11r. Monteiro regarding drainage and traffic situations which he felt .were severe problems. The following residents and/or abutters also roiced opposition: Michael Smolak, Dale St.; Mrs. Sandra Munroe, Ninter St.; Robin Munroe, !Tinter St.; and Philip Busby, Sr., Chestnut St. All were concerned about the drainage facts. Conditions: 1. That the record owners of the sul-ject lard forthwith execute and record a "covenant running with the land", or otherwise provide security for the construction of ways, and the installation of ,municipal services within said subdivision, all as provided by G.L. c. 41, S. 81—U, 20 That all such construction and installations shall in all respects conform to the Cove.-nin- rule--, and regulations of thi- Board. 3. That all water mains shall be installed. in accordance with the Board of Public Works specifications. K.
