The Planning Board makes the following findings regarding this Site Plan Review Application as required by section 8.3 of the North Andover Zoning Bylaws: FINDINGS OF FACT: 1. The proposed use and site design for this lot are appropriate, due to it's location in Town. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided. 3. The landscaping plan as shown and revised, meets the requirements of section 8.4 of the Zoning Bylaws, with the addition of the following conditions. 4. The site drainage system is designed in accordance with the Town Bylaw requirements. 5. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw. 6. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this proposal generally complies with the Town of North Andover Zoning Bylaw requirements as listed in section 8.35 but requires minor conditions in order to be fully in compliance. Therefore, in order to fully comply with the approval necessary to construct the facility as specified in the Site Plan Review application before us, the Planning Board hereby grants a approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. Any revision to the approved site plan shall be reviewed by the Town Planner. If any revisions are determined to be substantial and materially different by the Town Planner, then the applicant shall be directed to resubmit the site plan to the Planning Board in accordance with the provisions of Section 8.3 of the North Andover Zoning Bylaw. 2. The material used in construction of the exterior facade of the proposed structure shall be of the same material found 4 in the construction of the existing facility. (ie: Brick) 3. Any Plants, Trees or Shrubs that have been incorporated into the Landscape Plan approved in this decision, that die within one year from the date of this approval, shall be replaced by the owner. 4. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 5. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 6. All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 7. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 8. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 9 . The Planning Board is of the opinion that the property currently contains enough existing parking spaces to accommodate the proposed manufacturing facility. The applicant has submitted a plan entitled "Additional Parking" Prepared by Richard F. Kaminski & Associates, Inc. , Dated 11/25/91, which provides areas for future expansion of the parking facilities if needed. The property shall be reviewed annually from the date of this approval. Should the Planning Board or the applicant feel that the additional parking is needed the spaces shall be provided as shown on the above referenced plan, or as otherwise directed by the Planning Board. 10. Prior to the issuance of a Building Permit the following items shall be addressed to the satisfaction of the Planning Board: A. The existing fire alarm control panel shall be relocated as directed by the North Andover Fire Department. B. The applicant shall place erosion control measures on site as directed by the Town Planner and Conservation Administrator. C. All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. D. A detailed planting list shall be prepared listing specific material to be used. This list shall further indicate quantity and size of all proposed material. E. Bonds, in an amount to be determined by the Planning Board, shall be posted to ensure completion of all site screening. This bond shall be in the form of a bank passbook in terms deemed appropriate by the Town Treasurer. F. This Planning Board Order of Conditions is to be recorded with the North Essex Registry of Deeds. Recording information shall be provided to the Planning Department. 11. Prior to the issuance of the Certificate of Occupancy, the following items shall be addressed to the satisfaction of the Planning Board: A. The building shall be equipped with commercial fire sprinklers and fire suppression systems installed in accordance with the rules and regulations of the NAFD. B. This site shall have received all permits and approvals from the North Andover Board of Health. C. The Building shall inspected and approved by the NAFD for storage and handling of any Hazardous Material. (SARA) D. The site shall be reviewed by the Planning Board. Any screening as may be reasonably required by the Planning Board shall be added at the owners expense. 14. The meeting was held in the Town Building, Selectmen's Meeting Room, 120 Main Street, North Andover, MA. The public hearing was duly advertised in the North Andover Citizen on December 24, and December 31, 1991 and all parties of interest were properly notified. The following members were present and voting: George Perna, Chairperson, John Simons, Clerk, John Draper, Richard Nardella and Richard Rowen. Joseph Mahoney was absent. The petitioners are seeking to modify an approved Site Plan by adding an additional 20,000 sq.ft. to the proposed manufacturing facility in an Industrial-S Zoning District. John Simons read the legal notice to open the public hearing. George Perna stated that the Board had seen the plans before and that the applicant is adding to the center of the building. The only difference was the square footage. Christian Huntress, Town Planner, stated that 10,000 sq.ft. will be added for manufacturing and 10,000 sq.ft. for a cafeteria. One of the detention ponds has been relocated at the request of Conservation. Peter Moriarty, architect for North Andover Mills, told the Board that all the data in the original application included the additional 20,000 sq.ft, but it was not included in the application. Page 2: North Andover Mills A motion was made by John Draper to close the public hearing. The motion was seconded by Richard Nardella and voted unanimously by those present. Christian Huntress gave the Board a draft decision. Mr. Huntress commented on Condition 1,changing the wording from"manufacturing facility" to just"facility as permitted by zoning". Condition 11 was added. "The Order of Condition issued by the North Andover Conservation Commission, File 242-563, shall be considered as part of this decision." Both Condition 1 and 11 were added to the original approval. Condition 14 reflects the plans approved. A motion was made by Richard Nardella to approve the Site Plan Modification for North Andover Mills Realty as drafted and amended. Petition No. 57- ' 84 Dear Mr . Long: The Board of Appeals held a public hearing on Monday evening, November 19, 1984 upon the petition of North Andover Mills Realty, Limited. The hearing was advertised in the North Andover Citizen on _November 1 and 8, 1984 and all abutters were notified by regular mail . The following members were present and voting: Frank Serio, Jr. , Chairman; William J. Sullivan; Augustine W. Nickerson; and Associate Members Walter F. Soule and Maurice S. Foulds . The petitioner seeks a Special Permit under Section 4, Paragraph 4. 11 ( 3) of the Zoning By Law so as to permit the extension of an Industrial-S ( I-S) zone into a Residential-4 (R-4) zone to allow the construction of a one level parking deck on premises located at 38 High Street . The project engineer testified that the parcel is the site of the former Davis and Furber Machine Company. The premises are being renovated and the applicant proposes to extend the zoning line approximately fifteen feet ( 15 ' ) into the R-4 district to allow the construction of a one level parking deck . This proposal will be aesthetically more pleasing to the surrounding neighborhood as opposed to a three level deck which could be constructed under the Zoning By Law. Upon a motion made by Mr . Foulds and seconded by Mr . Soule, the Board voted unanimously to grant the Special Permit with the following conditions: 1. That all lighting be down lighting. 2. In particular , the Board finds that the specific site, being a mill in the process of extensive renovation, is an appropriate Location for such a structure; that the use of a one level deck will not adversely affect the neighborhood, where a three level deck would; that there will be no nuisance or serious hazard to vehicles or pedestrians; and that adequate and appropriate facilities will be provided for the proper operation of the proposed use.
