Dear Sir:
The North Andover Board of Appeals met in the Town Office Building on Tuesday,
April 21, 1970 to consider the request of Joseph B. & Carol J. O'Connell for a
variation of Section 7.21 of the Zoning By—Law so as to permit the erection of a
two—car garage on the east side of Marian Drive, known as 114 Marian Drive. The
Board members present and voting were: Arthur R. Drummond, Chairman; Daniel T.
O'Leary, Secretary; Philip Arsenault, Esq., Donald J. Scott and Associate Member
James A. Glynn, Jr., Esq. The hearing was advertised in the Lawrence Eagle-Tribune
on March 28 and April 4, 1970 and all abutters were duly notified by certified mail.
Mrs. O'Connell stated that the builder had located the house on the lot in such a
manner that a variance is necessary before a two—car garage and breezeway can be
erected and it would be closer to the lot line than the required 30 feet. Joseph
Winning, an abutter, spoke in favor of the variance and further explained the
circumstances. The addition would not be detrimental to the neighborhood.
After thorough discussion, member O'Leary made a motion to GRANT the variance, member
Scott seconded the motionand the vote was unanimous. The Board found this is a
rural residential lot and that the small portion of the garage that would overlap
would not be noticeable or detrimental to the area.
