Lyons, Town Clerk Town Building North Andover, Massachusetts Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, May 2, 1966 at the Town Office Building. Members present and voting were$ William Chepulis, Jr., Chairman; Robert J. Burke, Vice Chairman; Howard. Gilman, Secretary; James M. Bannan and George IL Farley. OLD NORTH ANDOVER REALTY TRUST petitioned to sub-divide a parcel of land on the southerly side of Great Pond Road, to be known as "Coaehmanls Forest", bounded by land of Leland, Peterson and North Andover Country Club. Atty. Victor Hatem represented the petitioner, Benjamin Osgood, who was also present. There were several abutters present. Three of the abutters spoke in opposition to the sub-division because they felt it would add to the drainage problems and cause excess water due to the large amount of wet land. The plans presented were incomplete since they did not show the contours of the entire area. The petition was taken under advise- ment until completed plans could be presented. Mr. Burke made a motion to take the petition under advisement. Mr. Gilman seconded the motion and the vote was unanimous. At a meeting held on June 6, 1966, completed plans were presented. After thorough discussion with the petitioners, Mr. Gilman made a motion to approve the Sub-division plans, as outlined and presented, subject to the following conditions. Mr. Farley seconded the motion and the vote was unanimous. Conditions 1. That the record owners of the subject land forthwith execute and record a "covenant running with the land", or other wise provide security for the construction of.ways and the installation of municipal services within said subdivision, all as provided by G.L. c. 41, p. 81 U. 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. That, as required by the North Andover Board of Health in its report to this Board, no building or other structure shall be built or placed upon Lots as shown on said Plan without the prior consent of said Board of Health. ./+. That surface drains and street bounds must be installed; the construction of streets and driveways shall be subject to the approval of the Highway Dept. 6. The roads must be hot topped and street signs installed. 7. Approval subject to the requirements of the Local and/or State Dept. of Public Health regarding sanitary disposal systems. 8. Must comply with Board of Fire Engineerst requirements as to the fire alarm system. 9. Petitioner will execute and record a "covenant". Dear Sir: The Planning Board held a public hearing on Friday evening, November 29, 1968 at 7:30 P.M. at the Fire Station Meeting Rooms due to the large attendance. There were 50 to 75 people present. The following members were present and voting: William Chepulis, Jr., Chairman; William B. Duffy, Jr., Secretary and James M. Bannan. Robert J. Burke dis- qualified himself from sitting and George Farley was unable to attend. The public hearing was held upon a petition of Old North Andover Realty Trust to re-zone a parcel of land on Turnpike Street, bounded by Hillside Road and Chestnut Street and containing approximately 170 acres, from Rural Residential to Industrial nL" . This area,-wa6, proposed as a site for the Raytheon plant if they decided to come to North Andover. The Board met on December 2, 1968 and made the following .recolm enda- tion: Mr. Bannan made a motion to recommend favorable action on the re-zoning. b1r. Farley seconded the motion. Three members voted favorably and Mr. Duffy voted against. The reasons for favorable action are as follows: 1. This re-zoning would be beneficial to the economy of the Town. 2. The land is accessible to major highways. 3. It complies with the modern concept to industrial planning and with all requirements of zoning. 4. This is a desireable area for this type of development and does not deviate from previous plans and recommendations made to the Town. Dear Sirs The following petition was heard at a meeting of the Planning Board on Monday evening, June 3, 1968 at the Town Office Building, The ambers present and voting were: William Cbepulis, Jr., Chairman; Robert J. Burke, Vice Cbairman; William B. Duffy, Jr., Secretary; James M. Bsnnan and George B. Farley. OLD NORTH ANDOVER REALTY TRUST petitioned to subdivide z parcels of land containing a total of approximately 97 acres on Farnum Street of land formerly owned by Brodie. Atty. Victor L. Hater represented the petitioner, Benjamin C. Osgood, who was also present. Preliminary plans had been presented to the Board previously and several recommendations and changes were made on the Definitive plans, as requested by the Board, the Board of Public Works and the Highway Department. Atty. Hatem explained that all requirements have been met under the Subdivision Control Law. The develop- ment comprises approximately 4,8 lots. Mr. Osgood offered to rebuild Faramm Street with the cooperation of various town departments from Summer Street to Brook Street, a distance of approximately 1,,000 feet. There were about 25 people present and several of them discussed the wet land and swamp in the area. Mr. Barman made a motion to take the petition under advisement. Mr. Burke seconded the motion and the vote was unanimous. A meeting was held on Tuesday evening, June 25, 1968 at which time the same Board members were present and discussed and voted on the petition, Mr. made a motion to APPROVE. the Subdivision subject to certain conditions. Mre seconded the motion, Four members voted in favor of the approval and Mr. Duffy abstained from voting because he felt that there should be a report from the Board of Health. The conditions are as follows: 1. That the record owners of the subject land forthwith execute and record a Reovenant running with the land#, or otherwise provide security for the construction of ways and the installation ofmunicipalservices within said subdivision, aU as provided by G.L. c. 41, s. 81-U, Old N.A. Realty Trust -2- duly 120 1968 2. That all such construction and installations shall in all respects conforss to the governing rules and regulations of this Board. 3. That, as required by the North Andover Board of Health in its report to this Board, no building or other structure shall be built or placed upon lots as shown on said Plan without the prior consent of said Board of Health. 4. That water and sewer will be according to the rules and regulations of the Board of Public Works. 5. That surface drains and street bounds must be installed; the roads must be hot- topped and constructed all in accordance with the requirements under the Subdivision Rules and Regulations of the Planning Board. Proper Street signs mast be installed. Sidewalks are to be installed on one side of the roadways. Other specifications are to be followed as outlined in the letter from the Highway Surveyor dated May 6, 19661, a copy of which is attached hereto. 6. Mast comply with the Board of Fire Engineers' requirements as to the fire alarm system.
