Eugene S. Oldfield John J. Lyons, Town Clerk Town Office Building North Andover, Mass. Dear Sir: Upon application of Eugene S. Oldfield to the North Andover Board of Appeals for a variance under Sections 6.61 and 7.23 of the Zoning By-Laws so as to permit the erection of a 2-stall garage closer to the side lot line than allowed under said By-laws, a public hearing was held on September 16, 1968 by the North Andover Board of Appeals. The hearing was held in the North Andover High School Auditorium after having been advertised in the Lawrence Eagle- Tribune on the dates August 31 and September 7, 1968 and with all abutters duly notified by certified mail. The members of the Board present and voting were: James A. Deyo, Chairman; Arthur Drummond, Secretary; Daniel T. O'Leary, Donald J. Scott and J. Philip Arsenault, Esq. The petitioner was represented Atty. J. Albert Bradley who pleaded the case by stating that a severe hardship would be imposed if the petition were to be denied. Particularly in that a garage was a necessity in the harsh weather and locating the garage in any position other than that proposed would be difficult and awkward. There were no objections voiced and upon motion the petition was taken under ad- visement, During this period it was noted that a previous petition heard by the Board on June 10, 1968 for a garage on this lot had been denied. The present petition presented considerable difference to the first petition in the location of the garage on the site. The petition in general appeared to be reasonable and on a motion by Mr. OtLeary, seconded by Mr. Drummond, the variance was unanimously granted. Eugene S. Oldfield —2— October 23, 1968 The principal reasons for granting the variance are as follows: 1. Denial of the petition would cause severe hardship to the petitioner, financial or otherwise. 2. Granting the petition would permit the erection of a garage in keeping with the neighborhood. 3. Granting the variance would be in keeping with the intent and purpose of the Zoning By-Laws. Deas Sirs Upon application of Eugene S. Oldfield to the North Andover Board of Appeals for a variance under Sections 6.61 and 7.23 of the By-Laws so as to permit the erection of a garage closer to the side lot line than is allowed under said By-Laws, a public hearing was held on June 10, 1968 by the North Andover Board of Appeals. The hearing was held in the Town Ball facilities after having been advertised in the Lawrence Eagle Tribune on the dates May 25 and June 1, 1968 and with all abutters duly notified by certified snail. The members of the Board present and voting were: Taxes A. Deyo, Chairman; Arthur Drummond, Secretary; Daniel T. O'Leary, Donald Scott and John J. Shields. The petitioner represented himself pleading that he had no garage for his ear and in anticipation of the need for a second car in the near future he wanted to build a two-car garage. He had placed the garage as presented no as to have access to it through a small breezeway or porch, part of which would need to be removed. There was only one interested abutter who neither opposed nor spoke in favor of the petition. The petition was taken under advisement through approved motion. During this period it was pointed out that the petitioner had not attempted to place the garage on more ample rear yard area nor had he presented evidence of hardship, financial or otherwise, which is a prerequisite for granting a variance. Accordingly, on a motion by Mr. O'Leary, seconded by Mr. Shields and passed unanimously, the petition was denied. The principal reasons for denial are: 1. There was no hardship evidenced, financial or otherwise. 2, Granting the variance would be in severe derogation of the intent and purpose of the Zoning By-Laws, specifically on the We yard requirement.
