Such conversion may be granted by a Special Permit obtained from the Zoning Board of Appeals . The property which is the subject of the current petition complies with or will be brought into compliance with all of the provisions of Section 4. 122 paragraph (14) . The lot area and frontage on Elm Street comply with the requirements of sub-paragraph (a) of paragraph (14) . There are no intended major exterior structural changes and Mr. Onanian, the prospective purchaser of the premises , will have to comply with all state and town codes and by-laws in order to obtain the necessary building permits for conversion from the Town of North Andover Building Inspector. These facts show compliance with sub-paragraphs (b) and (c) of paragraph (14) . Floor plans of the structure are submitted with this application. Mr. Onanian' s intended use of the premises is to convert this dwelling into five one-bedroom luxury apartments . Due to the one- bedroom feature of the apartments it is expected that prospective tenants will be primarily elderly individuals . The size of the lot provides more than adequate space for parking to comply with the Town of North Andover Zoning By-Laws . Each tenant will have his or her own parking area and no one will be allowed to park in the drive-way. Plans showing the location of the dwelling on the lot and proposed parking areas will be submitted to the Board prior to the date of hearing. In addition, this Petition and the premises meet all of the requirements for granting a Special Permit as stated in Section 9.31 of the North Andover Zoning By-Laws . in that : (a) The specific site is in appropriate location for such a use because of the size of the dwelling and lot area to accommodate easily this number of dwelling units and parking spaces ; (b) The use as developed will not adversely affect the neighborhood in that several other dwellings are multi- family dwellings and no major exterior changes are intended to the dwelling and appropriate rules and regulations will be established for all tenants to preserve the character of the neighborhood; (c) There will be no nuisance or serious hazard to vehicles or pedestrians in that there will be no major increase in traffic on the street of vehicles or pedestrians and the location of the buildings on the property allow for safe entrance and exit from the property of both vehicles and pedestrians ;and (d) adequate and appropriate facilities will be provided for the proper operation of the proposed use in that all structural changes and renovations will be approved by the Town of North Andover Building Inspector before any work may begin and proper and appropriate parking facilities are planned to comply with all requirements of the Town of North Andover Zoning By-Laws . In light of all of the above facts and statements , the Petitioner requests that his Petition for the granting of a Special Permit to convert this premises to a five-family dwelling unit be granted by the Zoning Board of Appeals.
