Town MASSACHUSETTS Clerk. 5 BOARD OF APPEALS Marylee Spicer * Petition: #84-88 59 Elm 5t. N. Andover, MA 01845 * PETITION The Board of Appeals held a public hearing on September 8, 1987 on the application of Marylee Spicer requesting a Special Permit from the requirements of Section 4, Paragraph 4.-122(14) of the Zoning ByLaws so as to permit relief to increase from a two-family dwelling to a three-family dwe113.ng. The following members were present and voting: Frank Serio, Jr. , Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Anna O'Connor and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on July 23 and July 30, 1987 and all abutters were notified by regular mail. Mr. Spicer spoke for the petition. The Board recommended that he withdraw the petition without prejudice until he had obtained the correct plans and all the specification regarding the additional unit. Upon a motion made by Mr. Vivenzio and seconded by Mr. Frizelle, the Board voted to allow the applicant to WITHDRAW WITHOUT PREJUDICE. The vote was unanimous. BOARD OF APPEALS RECONSIDERATION * * Andrew & Irene Soucy * Petition: #57-89 483 Andover St. N. Andover, MA 01845 DECISION The Board of Appeals held a public hearing on Tuesday evening, June 13, 1989 upon the request for reconsideration of petition #57-89 for Andrew & Irene Soucy requesting a variation from the requirements of Section 7, Paragraph 7.1, 7.2 and 7.3 and Table 2 of the Zoning Bylaw so as to permit relief from area, frontage and setbacks for B-4 district on the premises located at 485 Andover Street. They request that condition #3 be eliminated from the original decision due to the fact that an error in the measurements of the building was made. The following members were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Anna O'Connor and Louis Rissin. Upon, a motion made by Mr. Rissin and seconded by Ms. O'Connor, the Board voted, unanimously, to reconsider this petition, due to the error in the measurements of the building in the first petition. Upon a motion made by Mr. Rissin and seconded by Ms. O'Connor, the Board voted, unanimously, to GRANT the variances subject to the following conditions: 1. Parking for ten (10) cars be provided. 2. The garage be razed prior to a building permit being issued. 3. All the measurements be determined accurate by the Building Inspector before an Occupancy Permit is issued. The Board finds that granting these variances will not adversely affect the neighborhood nor derogate from the intent and purpose of the Zoning Bylaw. Dated this 15th day of June, 1989.
