Dear Sir:
The following petition was heard at a meeting of the Board of Appeals on Monday
evening, June 8, 1964 at the Fire Station meeting room. Members present and
voting were: Daniel T. OlLeary, Chairman; William Morton, Secretary; Henry S.
Lund, Arthur Drummond and John J. Shields.
NORMAN STAFFORD, HOWARD STONEHOUSE & ARTHUR GILMAN requested a Special Permit
under Seo. 4.7 of the Zoning By-Law so as to permit an apartment development on
the premises located at the west side of Mass. Ave. approx. 200 feet from the
corner of Greene St. , containing approx. 28,250 sq. ft.
This public hearing was advertised in the Eagle Tribune on May 25 and June 11 1964.
All abutters were duly notified by certified mail of this hearing. Atty. Peter
Speronis represented the petitioner. Atty. John J. Willis represented 27 of the
abutters who were all opposed. There were over 125 people present for this hearing.
They objected to having an apartment development in a single family dwelling area,
claiming this would lower the valuation of their homes. The size of the buildings
and traffic hazards were also objected to.
The Board discussed and voted on the petition. Mr. Shields made a motion to ]ANY
the special permit. Mr. Drummond seconded the motion and the vote was unanimous.
The reasons for denial are as follows:
1. The development as proposed, would be detrimental to the neighborbood.
2. The petitioner failed to meet all requirements under See. 4.7 of the Zoning
By-Law.

Lund, Arthur Drummond and Jobn J. Shields.
LEONARD OATES requested a Special Permit under See. 4.7 of the Zoning BY-Law so
as to permit an apartment development on the premises located at the east side of
Linden Avenue to the rear of property of Fortin, Androski, Seymour and Oates,
containing approx. 1.677 acres.
This public hearing was advertised in the Eagle Tribune on May 25 and June 1, 1964.
All abutters were duly notified by certified mail of this hearing. Atty. Peter
Speronis represented the petitioner. Atty. John J. Willis represented 27 of the
abutters who were all opposed. There were over 125 people present for this hearing.
The main objection was to having an apartment development in a single family
dwelling area. The size of the buildings and traffic hazards were also objected to.

voting were: Daniel T. 0lLeary, Chairman; William Morton, Secretary; Henry E.
Lind, Arthur Drummond and John J. Shields.
ALYCE R. COLGATE requested a Special Permit under Sec. 4.7 of the Zoning By-Law
so as to permit an apartment development on the premises located at the east side
of Linden Ave., at the end of Sylvan Terrace, comprising 6 lots of approx.
1139060 sq. ft.
This public hearing was advertised in the Eagle Tribune on May 25 and June 1, 1964*
All abutters were duly notified by certified mail of this hearing. Atty. Harry
Silver represented the petitioner. Atty. John J. Willis represented 27 of the
abutters who were all opposed. There were over 125 people present for this hearing.
They objected to having an apartment development in a single family dwelling area,
claiming this would lower the valuation of their homes. The size of the buildings
and traffic hazards were also objected to.
The Board discussed and voted on the petition. Mr. Shields made a motion to DENY
the special permit. Mr. Drummond seconded the motion and the vote was unanitous.
The reasons for denial are as follows:

Requirements as io the conicmis of "definitive plans".
G.L. c. 41, § 81 0, briefly describes a "definitive subdivision plan" as "a
plan of such proposed subdivision, showing the lots into which such land is to
be divided and the ways already existing or which are to be provided. .'. .. for
furnishing access to such lots However, such a plan should also supply
the data required of "preliminary plans" under G.L. c. 41, § 81 L, as follows:
"Preliminary plan" shall mean a plan of a proposed subdivision or resubdivi—
sion of land drawn on tracing paper, or a print thereof, showing (a) the
subdivision name, boundaries, north point, date, scale, legend and title
"Preliminary Plan"; (b) the names of the record owner and the applicant and the
name of the designer, engineer or surveyor; (c) the names of all abutters, as
determined from the most recent local tax list; (d) the existing and proposed
lines of streets, ways, easements and any public areas within the subdivision
in a general manner; (e) the proposed system of drainage, including adjacent
existing natural waterways, in a general manner; (f) the approximate boundary
lines of proposed lots, with approximate areas and dimensions; (g) the names -
approximate location and widths of adjacent streets; (h)and the topography of
the' land in a general manner:
It should also conform to the rules and regulations of the North Andover
Planning Board relative to definitive plans, and to the requirements imposed
by law for the recording of plans at the Registry of Deeds.
