Dear Mr. Long: A public hearing was held by the Board of Appeals on November 13, 1979 upon application of Stamard Realty Trust who requested a variance from the provisions of the Zoning By —Law under sections 7.1, 7.2, 7.3 and Table 2 so as to permit the approval of a convey— able house lot on the premises located at the east side of Osgood St. and known as 1189 Osgood St. as shown on a plan of land dated July, 1979. The following members were present and voting: Frank Serio, Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice —Chairman; James D. Noble, Jr. ; Richard J. Trepanier, Esq. ; and Assoc. Member, William J. Sullivan. The hearing was advertised in the North Andover Citizen on Oct.. 25.& Nov. 1, 1979 and all abutters were duly notified by regular mail. The petitioner seeks a variance from the provisions of sections 7.2 and 7.3 of the By —Law for a parcel of land with a dwelling thereon located on Osgood St. Testimony at the hearing showed that the dwelling was constructed prior to the present By-Law. The frontage and side setbacks presently do not meet the By—Law requirements due to the shape of the particular parcel of land. The Petitioner does not own the adjoining lots and has lived on the premises for a number of years. Atty. J. Albert Bradley, representing one abutter, Sophie Haphey, appeared and asked the Board to insert a provision in its decision, if it deemed to grant the variance, which would protect the abutter's right to use a driveway in common with others. The Board, on a motion made by Trepanier, seconded by Noble voted to GRANT the variance as requested subject to the reservation as follows: "Subject to the reservation of the right to use the southerly half of the driveway referred to in the deed from Stanley Stefanowics, et al trustees to Albert J. Steinberg dated June 25, 1945 and recorded at the North Essex Registry of Deeds, Book 673, Page 572." 0 1 Stamard Realtor Trust Decision —2— The Board, in granting the variance, finds that due to the unusual shape of the parcel that a literal enforcement of the provisions of the By—Law would be a substantial hard— ship to the petitioner and that the relief herein granted will not be of substantial detriment to the public good nor will it substantially derogate from the intent and purpose of the By—Law. The Board notes that the character of the area in question is such that the parcel and dwelling conform to the neighborhood, and further finds that each of the requirements set forth in Section 10.4 of the By—Law have been satisfied. A public hearing was held by the Board of Appeals on June ll, 1979 upon application of STARWD REALTY TRUST who requested a variation of Sec. 7.1$ 7.2$ 7.3 and Table 2 of the Zoning By-Law so as to permit the approval of a conveyable house lot for a condition that has existed for many years on the premises located at the east side of Osgood St. and known as 1189 Osgood St. and shown on a plan dated April, 1979. The following members were present and voting: Alfred E. Frizelle, Acting Chairman; R. Louis DiFruscio, Clerk; James D. Noble, Jr., Richard J. Trepanier and. William Sullivan. The petitioner stated that the lot in question resulted from the fact that the building, when constructed, conformed to the zoning; however, that it desired to convey the premises and therefore requires a variance specifically in regard to the area of the lot. At the meeting of July 9, 1979, with the maze members present, upon motion by Mr. Sullivan, seconded by Mr. Trepanier, the Board voted to DENY the variances requested. The Board, in making its decision, has found that the petitioner failed to meet the requirements of Section 10.1 of the Zoning By-Law; more specifically, that since it owns adjacent and abutting land$ that the necessary area could be added to the lot in question to give it the necessary area.
