N. Andover, MA 01845 * PETITION
The Board of Appeals held a public hearing upon the application of Donald C.
Stanley on February 13, 1990 and March 13, 1990 requesting a Special Permit
of Section 4.133, Paragraph 3(d) of the Zoning Bylaw so as to permit building
and grading within 100 ft. of a tributary to the Lake within the Watershed
District on the premises located at 179 Covernty Lane. The following members
were present and voting: Frank Serio, Jr. , Chairman, Augustine Nickerson,
Clerk, Walter Soule and Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on January 25, 1990
and February 1, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Soule and seconded by Mr. Nickerson, the Board
voted, unanimously, to GRANT the Special Permit as requested.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.3 of the Zoning Bylaw and that the granting of this Special Permit
will not derogate from the intent and purpose of the Zoning Bylaw now will it
adversely affect the neighborhood.
