HomeMy WebLinkAbout1960-09-19Monday, September 19, 1960 Regular Meeting The regular montb_ly meeting of the Board of Appeals was held an Monday, September 19, 1960 at the Town Building. Members present and voting were: Daniel T. O'Leary, Chairman, Charles Foster, Secretary, Henry Lurid and Robert Burke. A Public Hearing was scheduled for Arthur Corey who requested a variation of Section Paragraph 4.5 of the Zoning By Law so as to permit the erection of a motel located at the Southeast side of Peters Street. Mr. Burke moved that the hearing be thrown out as no one appeared to represent the petitioner. Mr. Foster seconded the motion. Unanimous vote. An entire new application will have to be filed if the petitioner would like to have another hearing. Mr. Chepulis and Mr. Hughes of Osgood Street appeared before the Board regarding Edward Keeler's permit for a restaurant. Mr. O'Leary re~d a section of the Board's regulations on what constitutes the term "restaurant". Mr. O'Leary also read a copy of a letter the Board of Health received from the State Department of Health. Mr. Chepulis told the Board when Attorney Daniels, counsel for Mr. Keeler, appeared l~ore the Board he talked about a restaurant not a diner. He stated he felt the Board of Appeals were giving a permit for a particular type of restaurant. He also stated this excavating that is being done is not allowed in the Town. He explained work is continuing even though workers have been told to stop. Mr. Chep~lis said the Police Department and Building Inspector have told the workers to stop but the workers say they will continue until properly notified. Mr. Lund stated the Board of Appeals has no jurisidiction on this. This is up to the Building Inspantor. Mr. Foster explained the Building Inspector is the enforcing body. Mr. Chepulis said the Building Inspector told him to see the Board of Selectmen amd the Board of Selectmen referred him to the Board of Appeals. Mr. Lund explained the Board of Selectmen appoint the Building Inspector therefore they have Jurisdiction over the Bur lding Inspector. Mr. Foster stated the Board of Appeals are not a law enforcing body. Mr. O'Leary read this section frc~ the By Law. Mr. Chepulis asked fir the Board would go before the Board of Selectmen on this and the Board said they would. Will~,- Shann presented plans to the Board and asked if a Public Hearing were necessary to sell a portion of his land. Mr. O'Leary stated he would check Town Counsel e~ thi~.
