The foregoing amendments to the general by-laws adopted under
articles 7 and 10 of the warrant for the North Andover Special
Town Meeting held October 5, 1989, are hereby approved.

January 8, 1990
1 enclose the amendments to the general by-laws adopted
under articles 7 and 10 of the warrant for the North Andover
Special Town Meeting held October 5, 1989, with the approval of
the Attorney General endorsed thereon.
Under article 9 of the warrant, the Town voted to accept the
provisions of G.L. c. t40, § 147A. The acceptance of local
option legislation by a municipality does not require the
approval of the Attorney General.

Vote on the following articles was taken October 5, 1989
Article 9. To see if the Town will vote to accept the
provisions of Section 147 A, Chapter 140, G.L., which empowers
the Town to enact by-laws relative to the licensing and
regulation of dogs or to take any other action relative thereto.
Petition of the Town Clerk
It was VOTED UNANIMOUS to adopt the article.
Article 10. To see if the Town will vote to adopt the
following Dog Licensing By-Law.
All dogs six (6) months old or over must be licensed and
tagged.
License fees shall be:
For male dogs & spayed female dogs . $4.00
For unspayed.female dogs ...... 7.00
Kennel Licenses:
Four dogs.
Ten dogs .
More than ten dogs .
.$10.00

The owner or keeper of an unlicensed dog after June 1st will
be fined fifteen ($15.00) per dog in addition to the license fee.
A review and adjustment of these fees may be made by the
Selectmen whenever deemed necessary.
This by-law shall take effect March 1, 1990.

Article 7. To see what action the Town will take in
connection with amending North Andover Code "Garbage, Rubbish,
and Refuse", Chapter 115, as adopted at a Special Town Meeting
by Article 1 on November 24, 1980, by deleting from such codes,
paragraph B of Chapter 115-1 - Weekly Collections as follows:
"Each building used for commercial, business or industrial
purposes where the amount of refuse produced is no more than
eight (8) thirty-gallon barrels per week and the building is
not a commercial, business or industrial complex."

§ 109-1. Determination of necessity; installation.
Upon determination by the Fire Chief that fire lanes are necessary
for the protection of the lives or property of the public in an area to
which the public has access, the owner or the person having control of
such premises shall prov/de, install and maintain "No Parking-Fire
Lanes" signs and striping in the location designated by the Fire Chief.
§ 109-2. Obstruction of private ways.
It shall be unlawful to ~obstruct or block a private way to an area to
which the public has access so as to prevent fire apparatus or other
emergency equipment from gaining access to any building thereon.

requiring them.
It shall be unlawful to obstruct or park any vehicle in any fire lane,
such fire lane to be designated by the Chief of the North Andover Fire

§ 109-4. Enforcement.
These traffic regulations are enforced by the Police

If 8 two-th~r_~ vote is required, the final vote must b~
certified either as being unanimous or the actual vote count must
be shown. The actual vote count must be given if the vote is not
unanimous. Certifications such as "unanimous but one" or
"unanimous but a few" do not suffice if the actual count is
required. A two-thirds vote is required for zoning by-laws
c. 40A, § 5) and historic district by-laws (G.L.c. 40C, § 3).
Other state statutes or town charters or by-laws may also require
a counted vote.
If a two-thirds vote is not required, the final vote may be
certified as "a majority, .... unanimous," or by the actual count.
Note: It is preferable that each final by-law as voted by town
meeting (with all of the'information described above) be submitted

§ 115-1. Weekly collection.
The Division of Public Works shall each week collect the refuse and
trash of:
A. Each detached single-family residence and each multiple
dwelling that:
(1) Contains fewer than nine (9) living units; and
(2) ls not part of an apartment or condominium complex
containing nine (9) living units or more.
B. Each building used for commercial, business or industrial
purposes where the amount of refuse produced is no more than
eight (8) thirty-gallon barrels per week and the building is not
a commercial, business or industrial complex.
§ 115-2. Placement of refuse for pickup.
Service will be provided only if the refuse and trash is placed on the
side of the highway in front of said residence or multiple dwelling or
building.
