Dear Sir:
At ov_~ Special Town Heeting held in the Veteran's Auditorium
of our North Andover High School on Thursday evening, January
9, 1969 at 7:30 P.M., the following article appeared in the
Warrant:
ARTIC~ ~,~, To see if the Term will vote to amend its Zoning
.By Law by striking therefrom the following se~ctions: 4.7, l~.71,
~.72, 4.7~, and 4.74 which said Sections presently read as follows:
4.7 APA~RT~ DEVELOP~v~i~S: The Board of Appeals may grant a
special permit for an apartment development in any zoning district,
but only if it be satisfied that such development will conform to
the permitted uses and specific regulations set forth in Sections
4.7a an~ 4-7~.
4.71 In so far as they may be apt, the provisions of Sections ~.5
thrOugh 4-54 inclusive~ shall apply to any application for a special
permit uuder Section 4-7.
4.72 Permitted Uses:
(a) ~ultiple or group dwellings, provided that there shall be
not more th~n twelve dwelling units per structure.
(b) Such accessory uses as are customary in connection with
the permitted principal uses, except that professional offices and
home occupations are specifically excluded.
~..73 Specific Regulations:
(a) No Structure shall exceed two and one-half (2~) stories or
~irty-five /35) feet in height, measured above the top of the
foundations.
(b) No structures, except one-story garages or carports, or
un-pierced walls of residential struct~res shall be nearer to each
other than the sum of the heights of their two opposing exterior
walls, measured above the top of the foundations.
(c) There shall be a lot area of at least ~,500 suare feet for each
dwelling unit in multiple-dwelling structure, in addition to the lot
area, if any, reeuired for other permitted uses.
(d) The gross usable flogr area of all principal and accessory
structures shall not exceed ~0% of the gross area of the lot.
(e) No structure shall be built within 30 feet of the side line
of any public street or way and no structure or parking space shall
be built or maintained within 20 feet of any other exterior property
line.

4.73 (f) There shall be provided at least one paved off-street
parking space, or space in garage or carport, of each dwelling
unit, said space to be no more than 200 feet from the outside
entrance to each such unit. No space shall be considered available
for oarking which reduces the effective width of a driveway pro-
riding access to more than one dwelling unit to less than 12 feet.
(g) There shall be a paved driveway, er paved walk adequate to
acoomodate emergency vehicles, within 50 feet of the outside en-
trance to each dwelling unit.
(h) Any road or driveway providing principal access to 6 or more
dwelling units or 8 or more parking spaces shall conform to appro-
priate provisions of the subdivision control regulations as if it
were a minor residential street. Before issuing any permits the
Board of Appeals shall request a report from the Planning Board on
the extent of such conformity.
4.74 No special permit shall be granted under Section ~-7 unless
the Board of Appeals finds that the development as planned will not
be detrimental to the neighborhood in which it is to be located, and
that the Town can reasonably provide the proposed development with
all necessary utilities and facilities.

Under the aforesaid article it was VOTED to amend its Zoning By Laws
by striking therefrom the following sections: 4.7, 4.71, 4.72, 4-73
and 4.74 as described in the article.
The vote was AFFIRI~ATIVE 297. NEGATIVE 80 A two-third major ty.
Three h~&udred and twenty-seven (327) duly registered voters were
present and checked from the voting lists.
