ARTICLE 1. To see if the Town will vote to amend its
General By-Laws by adding thereto the following new Article:
ARTICLE XII-C No person shall add, or cause to be added to
the ,public water supplies of the Town of North Andover any
substance (except fluorides) for the purpose of affecting the
persons or the physical or mental functions of all consumers
or any clas~ or classes of consumers of the Town Water.

Under the aforesaid Article, it was VOTED to amend the General .
By-Laws by adding thereto the following new Article:
ARTICLE XII-C. No person shall add, or cause to be added to
the public water supplies of the Town of North Andover any
substance (except fluorides) for the express purpose of
affecting the persons or the physical or mental funct~.ons
of all consumers or any class or classes of consumer& ~ .the
Town water. Normal water treatments, such as purification
and acidity-Alkali.nity balance, shall not be affected by
this By-Law.
The vote was: AFFIRMATIVE 2 30. NEGATIVE 2 1 1.
Ail requirements of the law have been complied with. The
meeting opened at 7:30 P.M., with Town Moderator Donald F.
Smith, Esquire presiding. Meeting adjourned at 9:45 P.M.
Four hundred and seventy-five (475) duly registered voters
were present and checked by the Board of Registrars.

Dear Mr. Lyons:
I enclose the amendments to zoning by-laws adopted
under Articles 6 and 7 of the warrant at the Special
Town Meeting held June 25, 1973, with the approval of the
Attorney General endorsed thereon.
I regret that I must enclose the amendment to town
by-laws adopted under Article 1 of the warrant at the same
meeting, with the DISAPPROVAL of the Attorney General
endorsed thereon.
This amendment is disapproved for the reason that
it would apparently forbid the town authorities concerned
with water supply from carrying out their responsibilities
under law, particularly General Laws, Chapter 111, Sections
5G and 1~ a~d is therefore inconsistent with the General
Laws.

Chapter 111 Section 5G (Acts 1961, Chapter 625, Page 553)
The department (Mass. Dept. Public Health) may require by
order a city, town or'district maintaining a water supply to pro-
vide and operate such treatment facilities as are in its opinion
necessary to insure the delivery of a safe water supply to .all
consumers. The supreme judicial or the superior court shall have
jurisdiction in equity to enforce any such order.
Chapter 111 Section 17 (As amended by Acts 3937, Chapter 340)
The department shall consult with and advise the officers of
towns and persons having or about to have systems of water supply,
drainage or sewerage as to the most appropriate source of water
supply and the best method of assuring its purity, or as to the
best method of disposing of their drainage or sewage ~ with refer-
ence to the existing and future needs of other towns or persons
which may be affected thereby. It shall also consult with and
advise persons engaged or intending to engage in any manufacturing
or other business whOse drainage or sewage may tend to pollute any
inland water as to the best method of preventing such pollution,
and it may conduct experiments to determine the best methods of
the purification or disposal of drainage or sewage. No person
shall be required to bear the expense of such consultation, advice
or experiments. Towns and persons shall submit to said department
for its advice and approval their proposed system of water supply
or of the disposal of drainage or Sewage, and no such system shall
be established without such approval. Ail petitions to the general
court for authority to introduce a system of water supply, drainage
or seweraEe shall be accompanied by a copy of the recommendation,
advice and approval of said department thereon. The department may
after a public hearing require a city or town or water supply com-
pany to mak~ such improvements relative to any existing treatment
works as in its judgment may be necessary for the protection of the
public health. In this section the term "drainage" means rainfall,
surface and subsoil water only, and "sewage" means domestic and
manufacturing filth and refuse.
The amendment to the zo~ by-laws adopted under Article 1 of the
warrant of the Special Town Meeting of June 25, 49?3 specifically
excluded "normal water treatments" and banned only those proposed
additives which are intended to affect (~ransitive verb) persons
as consumers of the water.
The A. ttorney General disapproved this by-law on the grounds of an
alleged conflict with Gene~l Laws, Chapter 1ii, Sections 5G and 17.
The town authorities conoerned with water supply would not be in-
hibited in any way from "carrying out their resposibilities under
law,"as a consequence of the enforcement of the by-law. The by-law
specifically excluded the resp~sibilities conferred by Sections 5G
and ~?.
Section 5G deals only with requirements for provision of treatment
facilities "necessar~T to insure the delivery of a safe water supply
to all consumers". By no stretch of the imagination can this 5G
be deemed to apply to the by-law. No additive intended to affect
cons~e~s as such can oos~ibly be nec~s~ or even advisable to
make the water safe for consumption. Because of the very unpre-
dictable effect of prescriptive type ad8itive~ on particular in-
dividuals who would be in effect "medical patients", prescriptive
type additives acvually ~egra~e the safety of the water supply.
The by-law therefore would reinforce, not detract from, Section 5G.
Section 17 deals with systems of water supply, drainage and sewerage.
It is concerned that "the best method of assuring its purity" be
used for the water supply. Certainly, "normal water treatments"
are excluded by the by-law from its specific coverage because the
by-law is no~ concerned with water treatments required for purity,
but only with misuse of the water s~pply as a vehicle for p~ople
treatment with prescriptive type additives. "Prescriptive" here
has the connotation of medical prescriptions. There is nothing in
the context of Section ~7 that "the protection of the ~ubl~c ~ealth"
(in next to last sentence of Sec. ~7) that would indicate that this
section i's intended to permit prescriptive type additives.

I regret What I must enclose the amendment to town
by-laws adopted under Article 1 of the warrant at the same
meeting, with the DISAPPROVAL of the Attorney General
endorsed thereon.
This amendment is disapproved for the reason that
it would apparently forbid the town authorities concerned
with water supply from carrying out their responsibilities
under law, particularly General Laws, Chapter 111, Sections
5G and 17 and is therefore inconsistent with the General
Laws.

You will remember my discussing with you, by telephone, some weeks
ago, a proposal made by an added anti-fluoridationist in the Town of North
Andover, by way of a petition to the Board of Selectmen~ that the following
Article be submitted to a special town meeting for action:

Laws by adding thereto the following new Article:
Article XII-C No person shall add, or cause to be added to the
public water supplieS of the Town of North Andover any substance for the ex-

all consumer~ or any class or classes of consumers of the Town water,

I believe we~agreed (felephonicallyl at that time that the proposed
By-Lewwould not be proper in view of the fact that the Great and General Court
had provided the sole method by which a town might provide (or not provide) for
fluoridation of its town water supply, General Laws c. 1118C. Since North
Andover had voted at the biennial State Election in 1972 i~o fluoridate its water
supply~ you and I les I recall) agreed that e town meeting could not override
such action.
Thereafter, by another petition, the same anti-fluoridation group
pre~ented the following Article to be added to the warrant for a special town
meeting; the number of signatures being sufficient~ the Selectmen called such
a town meeting and the Article in question was included, It follows:

At our Special Town Meeting held in the Veteran's
Auditorium of our North Andover High School on Monday
evening June 25, 1973 at 7:30 P.M., the following
Zoning By-Law Articles appeared in the Warrant and
was voted Upon: is herewith submitted for your approval.
ARTICLE 6. To see if the Town will vote to amend the North
Andover Zoning By-Law Section 6, Dimensional Requirements,
Table 2, Summary of Dimensional Requirements as follows:
Delete reference to not 06 in the heading of the R-4 District
and delete the reference to note 05 in the lot area, minimum
sq. ft. section of the R-4 column. Petition of the Planning
Board.
Under tile aforesaid Article 6. it was a UNANIMOUS VOTE and

substance (except fluoridee) for'the purpose of affecting the
persons or the physical or mental functions of all consumers
or any class or classes of consumers of the Town Water.
Petition of Howard M. Thomeon'and others.
Under the aforesaid Artlcl,~ it' was VOTED to amend the General
By-Laws by adding thereto the following new Article:
ARTICLE XII-C. No person shall add, or cause, to be added to
the public water supplies of the Town of North Andover any
substance (except fluorides) for the ~express purpose of
affecting the persons or the physical or mental functions'

Town water. Normal water treatmea~s, Such as purification
and acidity-Alkalinity balance, shall not be affected by
