Dear Sir: At otm Annual Town Meeting held Saturday April 23, 1977 in the Veteran's Auditorium of our North Andover Middle School and adjourned until Nonday evening April 25, 1977 at 7:30 P.M., the following Article appeared in the Warrant For same: ARTICLE 55. To seeif the Town will vote to m~end Article III of its General 'By-Laws by adding thereto the following new sectiom Section 8A: No person shall mare any excavation or other substantial change in the surface of any travelled portion of any way in the T own open to public travel without first obtaining a permit therefor from the High~ Surveyor. Such a permit shall be granted only upon a written application therefor~ which shall contain such information as to the proposed excavation or change as the Highway Surveyor may req~dre, and the permit may contain any reasonable re- quirements, including the applicant's procurement of an adequate performance bond assuring his compliance with such requirements, the amount of such bond to be set by the Highway Surveyor. In the event that such excavation or change cannot be completed Within twelve hours, the Highwa~ Surveyor shall forthwith make all necessary repairs to the surface of the way, and the applicant shall be responsible to the Town for the incident expenses. Under the aforesaid Article it was VOTED TO ADOPT the article. Two hundred and eighty six (286) duly registered voters were present. A true copy. In the event that such excavation or change cannot be completed ~thin twelve hours, the Highwa~ Surveyor shall forthwith make all necessary repairs to the surface of the way, and the applicant shall be responsible to the Town for the incident expenses. Under the aforesaid Article it was TOTED TO ADOPT the article. Two hundred and eighty six (286) duly registered voters were present.
