held April 23 and 25, 1977, with the approval of the Attorney

Dear Sir:
At our Annual Town Meeting held in the Veteran's Au~ditorium of our
North Andover Middle School on Saturday April 23, 1977 at 1:30 P.M.,
The following article appeared in the Warrant for same.'
ARTICLE 55. To see if the Town will vote to amend Article III of
its General By-Laws by adding thereto the following new section~
SECTION 8A: No person shall make any excavation or other substantial
change in the surface of any travelled portion of ~ Way
in the ToM open to public travel without first obtaining
a permit .therefor from the Highway Surveyor. Such a
permit shall be granted only upon a written application therefor,
which shall contain such information as to the proposed excavation
or change as the Highway Surveyor may require, and the permit
may contain any reasonable requirements, including the
applicants procurement of and adequate performance bond assu~i~g
his compliance with such requirements, the amount of such b
to be set by the Highway Surveyor. In the event that such
excavation or change cannot be completed within twelve hours,
the Highway Surveyor shall forthwith make all necessary repairs
to he surface of .~he way, and the applicant shall be responsible
to the Town for the incident expense.
