MARK O. HEMRY and others petitioned to ~amd 5eotio~ ~.129 of the North Audover
Zoning By-law which lists the uses permitted in the Ym~ustrial nl" District~ by
adding the following sub-section 17:
(17) Indoor recreational facilities (Special Per~l.t required).
Mr, Mark Henry and Atty. Stephan Duly the~ wo~ld like to have an ice skating rink
facility in an already zoned Industrial #1# area, but this use is not presently
all,wed in the Zoning By-Law. They felt that by adding a section to provide for
"Indoor Recreational Facilities, by special permite this would allow that use.
Several people present at the hearing and the Board members felt 'recreatio~_A
facilities' was too encompassing a~M could imelude a rmmber of facilities which the
to~n sight not want.
The petition was takan u~der advisament. At a ~eeti~g held on Saturday morning,
March 17, 1973, at 10:OO A.M., at which e~l! members were present and voting~

favorable action; Mr. Monteiro seconded the motion and the vote was umanimeus.
The Board felt the original amended article ~a~ too broad and geaeral~ and that its
amendment to allow this specific use is in keeping with other similar uses already
in this district.

MAS~ ACH~U'SETTS
March 17, 1973
John J. Lyons, Town Clerk
Town OfficeBuilding
North Andover, Mass.
Dear Sir:
The following petition was heard at a meeting of the Planning Board on Monday
evening, March 5, 1973 at 7:30 P.M. in the Fire Station meeting room. Members
present and voting were: Donald N. Eeirstead, Acting Chairman; Fritz Ostherr,
Clerk; William Chepulis and John J. Monteiro.
MARK O. HENRY and others petitioned to amend Section ~.129 of the North Andover
Zoning By-Law which lists the uses permitted in the Industrial "1" District, by
striking out sub-section (3) and inserting in place thereof the following sub-
section: (3) Retail, perso~el service, and eating and use shall be permitted
in an amount not to exceed 5% of the total gross floor area of
the principal uses.
Mr. Mark Henry and Atty. Stephen Duly explained that the only change in that
particular section was striking out the word "limited". They did not realize that
the word "limited" was not clear in the By-law until they tried to borrow money
and the bank's attorneyinterpreted it differently than what they thought the By-
law intended. They said it becomes difficult to borrow money when the Zoning
By-law is subject to a certain lawyer's ~uterpretation. They would like to have
this section of the By-law clarified. No one else spoke.
The petition was taken under advisement. At a meeting held on Saturday morning,
March 17~ 1973, at 10:00 A.M., at which all members were present and voting:
William Chepulis, Chairman; John J. Monteiro, Vice Chairman; Paul R. Lamprey, Clerk;
Donald M. Keirstead and Fritz Ostherr, a vote was taken on the petition. Mr. Ostherr
made a motion to recommend unfavorable action; Mr. Monteiro seconded the motion and
the vote was unanimous. The Board felt the word "limited" should remain because it
restricts uses to services for employees and provides an outlet for products manu-
factured on the premises.
Very truly yours,
