Dea~ Sir: On April 28~h, 1975 I forwarded ~o your office for Approval Articles 55, 56 and 57 of the Warrant for our Annual Town l~ee~ing of ~a~ch l?, 197~ of which we received ~his date approval of same. Inadvertently I left out Article 84 of the same Warrant which I now submit the following for your approval. ARTICLE 64. To see if the To~n will vote to amend Section 4 of Article l, of its General By-Laws to provide that the adjourned Annual Town ~eeting shall hereafter Oe held on the third Monday in ~ay at 7:~0 P.M., or at such other time as this Meeting may determine. Petition of the Selectmen. Under the aforesaiG Article 64 the following was voted: VOTED TO ~END Section 4 of Article l, of its General By-Laws to provide that the adjourned Annual Town Meeting shall hereafter be held on the Fourth (~th) Saturday of April at l:~0 P.M. The vote was Unanimous and so declared. All reGuirements of General By-Laws were complied with. For the purpose of controlling and abating noise, no automobile service station wit~hin the Town shall conduct business, except in case of an emergency, between the hours of 10 P.M., and 5:30 A.N. Under the aforesaid Article 55, it was VOTED TO ADOPT the Article. ARTICLE 56. To see if the Town will vote to amend its General By-Laws by inserting, in Article III, thereof, the follo~ng new section~ SECTZON 10. The Selectme~ ms~, for the purpose of controlling and abating noise, promalgate orders, not inconsistent with any governing statute, establishing the hours during which az~ holder of a co~m~n victualler's license may open his licensed premises to the public. Under the aforesaid Article 56, it was VOTED TO ADOPT the article. ARTICLE 57. To see if the Town will vote to amend Article XI-A of its General By-Laws by adding thereto the following opening paragraph: No Owner of keeper of an~ dog shall permit it to leave its owner's or keeper's premises unless it is held firml~ on a leash. The Owner of keeper of a dog shall be that person no~]_l,y' responsible for the mainten- ance and upkeep of the premises upon which the dog is kept, and need not aecessarily be the person to ~hom a dog license may have been issued. The dog officer shall be the enforcing officer of this By-Law, and ms~ seek complaints against persons in violation hereof under provisions of Section 173A of Chapter 140 of the General Laws. Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, March 5, 1973 at 7:30 P.M. in the Fire Station meeting room. Members present and voting were: Donald N. Eeirstead, Acting Chairman; Fritz Ostherr, Clerk; William Chepulis and John J. Monteiro. MARK O. HENRY and others petitioned to amend Section ~.129 of the North Andover Zoning By-Law which lists the uses permitted in the Industrial "1" District, by striking out sub-section (3) and inserting in place thereof the following sub- section: (3) Retail, perso~el service, and eating and use shall be permitted in an amount not to exceed 5% of the total gross floor area of the principal uses. Mr. Mark Henry and Atty. Stephen Duly explained that the only change in that particular section was striking out the word "limited". They did not realize that the word "limited" was not clear in the By-law until they tried to borrow money and the bank's attorneyinterpreted it differently than what they thought the By- law intended. They said it becomes difficult to borrow money when the Zoning By-law is subject to a certain lawyer's ~uterpretation. They would like to have this section of the By-law clarified. No one else spoke. The petition was taken under advisement. At a meeting held on Saturday morning, March 17~ 1973, at 10:00 A.M., at which all members were present and voting: William Chepulis, Chairman; John J. Monteiro, Vice Chairman; Paul R. Lamprey, Clerk; Donald M. Keirstead and Fritz Ostherr, a vote was taken on the petition. Mr. Ostherr made a motion to recommend unfavorable action; Mr. Monteiro seconded the motion and the vote was unanimous.
