My dear Mr. Duncan: Enclosed herewith is by-law enacted under Article 2Q March 3, 1941 town meeting, with the action of the Attorney General noted thereon. Dunoanw Town Clerk of North Andover, Massachusetts, hereby certif7 that the following article appeared in the warrant for our Ar,nual Town Meeting held March 3, 1941 and adjourned to March 15, 1941= Article 20. To see if the town will vote to accept the following addition to its By-Laws:- # Previous to the erection of a new building or the alteration of any existing one, notice shall be filed with the Board of Assessors by the person responsible for such work." Petition of the Board of Assessors. That under said Article 20, the town voted as follows:- Voted that the following addition to the Town By-Laws be accepted: "Previous to the erection of a new truildlng or the alteration of any existing one, notice shall be filed with the Board of Assessors by the owner of the property." My dear Mr. Duncan: A proposed by-law concerning your Board of Assessors under Article 20 of your March 8, 1941 town meeting, ad- Journed to March 18, 1941, h~ Just been found. It had been misplaced in a file, and apparently never received action by this office so far as approval was necessary. My predecessor, Mr. Leboeuf, may have acted on other papers in connection therewith, but our file fails to disclose that. Would you look through your by-law file and ascertain if there has been any approval of the by-law mentioned. Your letter was dated May 26, 1941. Your by-law seems to meet all requirements, and I am prepared to recommend its approval, but I would not want to duplicate something which had been done before. Dear Sir: Enclosed is by-law enacted at your adjourned annual town meeting held March 14, 1942, with the action of the AZtorney General noted thereon. Assistant Attorney General Mr. Joseph A. Duncan, Town Clerk, North Andover, Mass. Dear Sir: I am enclosing the building by-laws enacted at your annual town meeti?gheld March 2, 1942, an~ adjourned to March 14 and March 28, 1942, with the action of the Attorney General noted thereon. These Oy-laws are approved, with the following exceptions. The second sentence in section 2 is deleted, as the appoint- ing power sets the compensation or salary of its appointee. Section 3 is deleted, as it is repugnant to law and is beyond the power vested in the town with reference to the statute enabling the town to make such by-laws. At this point in the deletion the section numbers will follow as corrected in red ink. Your original numbering is used in referring to deletions. Section 8 is deleted as this is all provided for in the General Laws, and the duties are incumbent on the Inspector with- out the by-law. The s~me is true with reference to section 9 which is deleted, and there is no provision for an appeal as pro- vided for in section 9, the remedy for a person aggrieved being to go directly to court. There is no provision of law with reference to building by-laws authorizing the designation of the Selectmen as a board of appeal to those parties on the acts of the Building Inspector. The only provisions for appeal boards in respect to buildings are in G.L. (Ter. Ed.) c. 40,ss'2? and 2?A, and c. 143, S.55, but these do not apply to building laws in general. Section 16 is approved as deleted. The action herein on deletion is because it leaves no standard for the builder to meet, and is entirely too arbitrary within the requisites of law. Section 31 is stricken out for the reason that you cannot incorporate the rules of a foreign body by reference. The second sentence of section 42 is stricken out because it sets no standard for the inhabitants of the town to meet, leaving them entirely to the untrammeled discretion of JoA. D., . . ~. the Board of Selectmen. Section46 likewise falls, as it leaves too much of an arbitrary power in the Building Inspector, failing to pre- scribe any stands~d by rules and regulations to be met in order to conform with the erection of ice houses in the town cf North Andover. In section 47 the words "chief of police upon the application of the" are stricken out, leaving the section to read as deleted.
