Report of the North Andover
Advisory Board
TO THE CITIZENS OF NORTH ANDOVER:
The Annual Town Meeting will be held in the North
Andover High School Auditorium on Saturday, March 19,
1960, at 1:30 P.M. Your Advisory Board has reviewed every
item of the budget and carefully considered all the articles
in the Warrant.
We have interviewed pertinent department heads,
boards, and committees, and visited every site for which
an appropriation or expenditure of money is proposed. Our
recommendations are predicated on a good fiscal policy
and designed to promote the best interest of the Town of
North Andover.
We are informed that each $21,000.00 raised and ap-
propriated during this year will amount to $1.00 on the
tax rate.
Our specific recommendations are appended to the
various articles in the Warrant which we hope you will
read carefully. Before commending this report to you, we
wish to take this opportunity to offer our sincere thanks
to the members of other Town boards, Town officials, and
department heads whose excellent co-operation made pos-
sible the performance of our oam work.

To either of the Constables of the Town of North Andover.
GREETING:
In the name of the Commonwealth of Massachusetts,
you are hereby directed to notify and warn the inhabitants
of North Andover qualified t6 vote in elections and town
affairs, to meet in the Bradstreet School in Precinct One,
the St. Michaels Auditorium in Precinct Two, the Thomson
School Auditorium in Precinct Three and the Kittredge
School Auditorium in Precinct Four in said North Andover
on Monday, the 7th day of March 1960, at seven (7) o'clock
A.M. and there to act on the following article:
ARTICLE 1. To elect a Moderator, Town Treasurer,
Collector of Taxes, Highway Surveyor, Tree Warden, Three
Selectmen, Three members of the Board of Public Welfare
and Five Constables for one year, one Assessor, one
member of the Board of Public Works, one member of the
Board of Health, two members of the School Committee
for three years, one member of the Planning Board and
one member of the Housing Authority for five years, and
to vote upon the question.
QUESTION:
"Shall the Town of North Andover accept the
provisions of Section 47B of Chapter 31 of the
General Laws, as it applies to sealers of
weights and measures, a fair and concise sum-
mary of which appears below?"

"Acceptance of the provisions of Section 47B of
Chapter 31 of the General Laws would place
under Civil Service the sealer of weights and
measures of Town of North Andover."
All to be voted upon one ballot, the polls shall be open
at 7:00 A.M., and shall be closed at 7:00 P.M.

After final action on the preceding Article 1, said
meeting shall stand adjourned by virtue of Section 4,
Article One of the Town By-Laws, to Saturday, March 19,
:1960 at one-thirty o'clock P.M., in the Veterans Auditorium
of the North Andover High School, then and there to act
on the following articles:
ARTICLE 2. To elect all other officers not required
by law to be elected by ballot.
Recommended that this be referred to the Selectmen
for action.
ARTICLE 3. To see if the Town will vote to accept
the report of receipts and expenditures as presented by
the Selectmen.
Recommended that the report be accepted.
ARTICLE 4. To see what action the Town will take
as to its unexpended appropriations.
Recommended that all tmexpended appropriations be
returned to the Treasury as of January 1, 1960, except
those amounts followed by an asterisk.

ARTICLE 7. To see if the Town will vote to author-
ize the Town Treasurer, with the approval of the Select-
men, to borrow money from time to time in anticipation
of t~e revenue of the financial year beginning January 1,
196~ and to issue a note or notes therefor, payable within
one year, and to renew any note or notes as may be given
for a period of less than one year in accordance with Sec-
tion 17, Chapter 44 of the General Laws.
Favorable action recommended.
ARTICLE 8. To consider the report of all special
Committees.

tees be heard.
ARTICLE 9. To see if the Town will vote to authorize
the Board of Health to appoint one of their members to
the position of Board of Health Physician and to fix his
compensation in accordance with Section 4A, Chapter 41
of the General Laws.
Petition of the Board of Health.
Favorable action recommended on the basis of com-
pensation in the amount of $950.00 for the year of 1960.
This amount has been incuded in the Beard of Health
Budget recommended by your Advisory Board.
ARTICLE 10. To see if the Town ~vill vote to author-
ize the School Committee to appoint one of its members to
the position of School Physician and to fix his compensa-
tion in accordance with Section 4A, Chapteer 41, General
Laws.
Petition of School Committee.
Favorable action recommended on the basis of com-
pensation in the amount of $1,500 for the year of 1960.
This amount has been included in the School Department
Budget,
ARTICLE 11. To see if the Town wi]] grant to the
City of Lawrence and/or the Airport Commission of the
City of Lawrence, slope easement rights along the south-
easterly side of the town dump property on Clark Street

for the Construction of a street on adjacent property, and
to authorize the Board of Selectmen to sign, execute, affix
the corporate seal, and deliver a deed of easement on be-
half of the town on such terms as said Board of Selectmen
deem fair and equitable. ~ . ~,~/

ARTICLE 12. To see if the Toxvn will sell two indi-
vidual lots of land on Wood Avenue to City of Lawrence,
and/or the Airport Commission of the City of Lawrence
which lots were acquired by the town for non-payment of
taxes and are numbered 41 and 77 on plan of Woodside
Terrace which is Plan No. 609, and to authorize the Board
of Selectmen and/or the~~ to sign, execute,
affix the corporate seal, and de--deed or deeds, on
such terms as said Board of Selectmen deem fair and
equitable.

ARTICLE 13. To see if the Town will transfer from
the unexpended appropriation under Article 54 of the 1958
Annual Town Meeting, which appropriated money for the
extension of the water system, the sum of Ninety-four
Hundred Dollars ($9,400.) to be expended by the Lawrence
Airport Commission upon agreement with the Board of
Public Works for the purpose of using 12 inch cast iron
cement lined water pipe on the relocatiion of Clark Street
instead of the 6 inch pipe which was to be used to replace
the existing 6 inch pipe on the present Clark Street.

Favorable action recommended. It is recommended
that the sum of N~ne Thousand Four Hundred Dollars~
($9o400.00) be transferred from the unexpended appropria-
tion under Article 54 of the 1958 Annual Town Meeting
Warrant for the purpose of this Article.
ARTICLE 14. To see if the town will vote to raise
and appropriate One Thousand Dollars to purchase from
the City of Lawrence a proposed well field and right of way

at the Lawrence Airport for an addition to the water supply
system.

Favorable action recommended, It is recommended
that the sum of One Thousand Dollars ($1.011(I.00) be raised
and appropriated for the purpose of this Article.
ARTICLE 15. (1) To see if the Town will vote to ac-

ARTICLE 17. To see if the Town will vote to accept
Lyman Road from Middlesex Street to Silsbee Road, a
distance of approximately 250 feet more or less.

ARTICLE 19. To see if the Town will vote to approve
the continuance of the 5% cost-of-living increase to em-
ployees subject to the Wage and Salary Administration
Plan as voted under Article 18 of the 1959 Annual Town
Meeting, the cost of which is included in salaries and wages
of each Town Department under Article VI of this
rant.

the words "forty-five (45) hours in five days" and inserting
in place thereof the words "forty (40) hours in five days".

therefrom the title "Welfare Agent" and inserting

4. Amend Schedule B, CODE PF-05.01, by deleting
therefrom the ~vords "$75.00 per month, single rate"

ARTICLE 23. To see if the Town will vote to amend
the By-Law governing the Wage and Salary Administration
Plan for the employees of the Town of North Andover ad-
opted July 22, 1957 at a special town meeting, as amended,
pursuant to the provisions of the General Laws, Chapter
41, Section 108A and 108C, as amended, in the following
manner:
(a) Amend Code A. T. P., Classification Schedule "A",
by inserting in Code A. T. P.- 50 the following

Unfavorable action recommended. It is felt that the
Personnel Board had sound reasons for tarninq down this
request originally.
ARTICLE 24. To see if the Town will amend the By-
Laws governing the North Andover Personnel, Wage and
Salary Administration Plan in the following manner: Amend
Schedule C: Fringe Benefiits, Holidays, last paragraph, by
adding the following holidays: Ne~v Years Day, Patriots
Day, Washington's Birthday, Labor Day, Veterans Day,
Decoration Day and Columbus Day.

Favorable action recommended by both the Advisory
Board and the Personnel Board.
ARTICLE 25. To see if the Town will vote to amend
the By-Laws governing the North Andover Personnel, Wage
and Salary Administration Plan in the following manner:
Amend Schedule B, CODE PF, Rate of Progression: For
Chief by inserting "12 months" in place of "18 months."

ARTICLE 26. To see if the Town will vote to amend
the By-Laws governing the North Andover Personnel, Wage
and Salary Administration Plan in the following manner;
Amend Schedule C: Fringe Benefits, Uniform allowance,
paragraph one (1) by inserting the words "One Hundred
Dollars ($;[00.00)" in place of the words "Eighfy-Five Dol-
lars ($85.00)".

the By-Laws governing the North Andover Personnel Wage
and Salary Administration Plan, in the following mannec:
Amend Schedule C: Fringe Benefits, Uniform Allowances,
paragraph four (4), by inserting the words "Forty-five
dollars ($45.00)" in place of the words "Thirty Dollars
($3O.0O) ".

Favorable action recommended by both the Advisory
Board and the Personnel Board.
ARTICLE 28. To see if the Town will raise and ap-
propriate or transfer from available funds the sum of Fifty
Dollars ($50.00) for the purpose of paying a certain em-
ployee wages that were earned from July 12, 1958 to ]De-
cember 31, 1958.

that the sum of Fifty Dollars ($50.00) be raised and appro-
priated for the parpose of this Article.
ARTICLE 29. To see if the Town will vote to raise
and appropriate or transfer from available funds the sum
of Five Hundred Dollars ($500.00) to purchase metal street
signs of uniform size and color for installation at various
necessary locations.

Favorable action recommended. It is recommended
that the sum of Five Hundred Dollars ($500.00) be raised

ARTICLE 30. To see if the Town will raise and ap-
propriate or otherwise provide Two Thousand Dollars
($2,000.00) to pay an outstanding bill on the West Side
Server Construction, Article 56, 1958. ~~
Petition of Board of Public Works.
Favorable action recommended, It is recommended
that the sum of Two Thousand Dollars ($2,000,00) be raised
and appropriated for the purpose of this Article.
ARTICLE 31. To see if the Town will raise and ap-
propriate Seven Hundred and Twenty-five Dollars ($725.00)
to be used with a 1934 Remington Special Typewriter to
purchase a system writer front feed electric

Favorable action recommended. It is recommended
that the sum of Seven Hundred Twenty-Five Dollars
($725.00) be raised and appropriated for the purpose of this
Article.
ARTICI,E 32. To see if the Town will vote to raise
and appropriate the sum of Two Thousand Dollars ($2,000.-
00) for the purchase of five hundred (500) feet of new 21/z''

ARTICLE 74. TO see if the Town will vote to create
a special unpaid committee, to be known as the Regional
Vocational School District Planning Committee, to consist
of three members, including one member of the School
Committee, all to be appointed by the Moderator, which
committee may join with a comparable committee, or com-
mittees, from one or more neighboring Towns and/or City,
to form a Regional Vocational School District Planning
Board for the purpose of studying the advisability of es-
tablishing a Regional Vocational School District, and mak-
ing recommendations relative thereto, pursuant to Chapter
71, of the General Laws, Sections 14 to 161; inclusive.

· ARTICLF, 75. To see if the Town will vote to accept
the provisions of Section 8A of Chapter 40 of the General
Laws as established by Chapter 297 of the Acts of 1954 and

lish a development and industrial commission of nine (9)
members with all of the powers and duties thereof as pro-
vided in said Section SA of Chapter 40, General Laws.

ARTICLE 76. To see if the Town will vote to raise
and appropriate a sum of Five hundred dollars ($500.00)
for the purpose of establishing and maintaining a develop-
ment and industrial commission as provided by Section 8A
of Chapter 40, G. L. and determine whether the money
shall be provided for by taxation or by appropriation from'
available funds in the treasury.

ARTICIJE 77. To see if the Town will vote to raise
and appropriate, transfer from available funds, or other-
wise provide, the sum of Thirty-five thousand dollars
($35,000.00) to be expended under the direction of the
School Building Committee, for topographical surveys,
borings, specifications, complete plans layout, working
drawings, and estimate of cost, and such other disburse-
ments as may be preliminary to the construction of an
addition, or additions, to a present school building or
buildings.

On Articles pertaining to Zoning, Articles 78 through
85, there will be no recommendations made prior to the
Annual Meeting since the Planning Board Hearings per-
taining to these Articles will not yet have taken place by
the time this report goes into print.
ARTICLE 78. To see if the Town will vote to amend
the North Andover Zoning By Law of the town to change
Section 4.55 of the Zoning Laws dealing with Motels such
that said section will be amended by adding thereto sub-
section J which will read as follows:
J. There shall be allowed in a Motel, a coffee shop
or restaurant to be used in conjunction with the
operation of a motel.

ARTICLE 79. To see if the Town will vote to amend
the Zoning By-Law by adding thereto the following new
sections:
4.7 APARTMENT DEVELOPMENTS
The Board of Appeals may grant a special permit
for an apartment development in any zoning dis-
trict, but only if it be satisfied that such develop-
ment will conform to the permitted uses and spe-
cific regulations set forth in sections 4.72 and 4.73.
4.71 In so far as they may be apt, the provisions of
sections 4.5 through 4.54, inclusive, shall apply to
any application for a special permit under section
4.7.
4.72 Permitted Uses:
(a) Multiple or group dwellings, provided that
there shall be not more than twelve dwelling
units per structure.

(b) Such accessory uses as are customary in con-
nection with the permitted principal uses, ex-
cept that professional offices and home occu-
pations are specifically excluded.
4.73 Specific Regulations:
(a) No structure shall exceed t~vo and one-half
(2¥2) stories or thirty-five (35) feet, in height,
measured above the top of the foundations.
(b) No structures, except one-story garages or
carports, or unpierced walls of residential
structures shall be nearer to each other than
the sum of the heights of their two opposing
exterior walls, measured above the top of
the foundations.
(c) There shall be a lot area of at least 3,500
square feet for each dwelling unit in multiple-
dwelling structure, in addition to the lot area,
if any, required for other permitted uses.
(d) The gross usable floor area of all principal
and accessory structures shall not exceed
30% of the gross area of the lot.
(e) No structure shall be built within 30 feet of
the side line of any public street or way and
no structure or parking space shall be built
or maintained within 20 feet of any other ex-
terior property line.
(f) There shall be provided at least one paved
off-street parking space, or space in garage
or carport, for each dwelling unit, said space
to be not more than 200 feet from the outside
entrance to such unit. No space shall be con-
sidered available for parking which reduces
the effective width of a driveway providing
access to more than one dwelling unit to less
than 12 feet.
(g) There shall be a paved driveway, or paved
walk adequate to accommodate emergency
vehicles, within 50 feet of the outside entrance
to each dwelling unit.
(h) Any road or driveway providing principal ac-
cess to 6 or more dwelling units or 8 or more
parking spaces shall conform to appropriate
provisions of the subdivision control regula-
tions as if it were a minor residential street.
Before issuing any permit the Board of Ap-
peals shall request a report from the Planning
Board on the extent of such conformity.

4.74 No special permit shall be granted under section
4.7 unless the Board of Appeals finds that the de-
velopment as planned will not be detrimental to
the neighborhood in which it is to be located, and
that the Town can reasonably provide the pro-
posed development with all necessary utilities
and facilities.
