The Project. The Project (more fully described in the application 'I Of the FIRST PARTY) , to aid in the financing of which the Grant will be 3 made, is substantially as follows : For the installation of water main ex- tension„involving 6,260 feet of 6-inch pipe and 500 feet of 8-inch pipe in North Andover; also the construction of two additional circuits of water. mains and two additional feeders, comprising 4,900 feet of 6-inch pipe for { Poorly protected property, all in substantial accord with the First Party's application (Docket No 1990) , with such minor alterations or modifications thereof or additions thereto as mays from to time, be approved by the SECOND PARTY before or during the .. . � course of construction. 3, Preliminary Proceedings Syq First Party. Promptly after receipt from the SECOND PARTY of an unexecuted copy of this Agreement, the First M Party will; +� f (a) Adopt a resolution approving this Agreement, and authorizing and directing the execution and delivery thereof a1 by the officials designated to sign the same on its behalf, (b) Send to the SECOND PARTY complete extracts from the minutes of the meetings of the First PARTYtS governing body showing h all proceedings taken incident to such authorization, includ- ing a copy of said resolution , all duly certified, and three signed copies of this Agreement; (c) Commence all necessary proceedings , if any, to authorize the construction of the Project, and to obtain funds , which, to. G; gether with the amount to be represented by the Grant, will c! be sufficient to pay all the costs of constructing the Proj- ; o sot. Construction of Project. on or before the date of the execution by the SECOND PARTY of this Agpeement, the FIRST PARTY may, and within such time thereafter, as shall be satisfactory to the SECOND PARTY, the FIRST PARTY will commence or cause to be commenced the construction of the Project and will thereafter continue the same with all practicable dis- patch, in an efficient and economical manner, at a reasonable cost, and in accordance with plan, drawings , specifications and construction contracts j which shall be in form and substance as approved by the SECOND PARTY, and in accordance with such engineering supervision and inspection as the SEC* OND PARTY or its representatives may require. Except with the prior written consent of the SECOND PARTY, no materials or equipment for the Project shall be purchased by the FIRST PARTY subject to any chattel mortgage or to any conditional sale or title retention agreement. 4 5. COMPLETION OF PROCEEDINGS. As soon as practicable after i the execution by the SECOND PARTY of. this Agreement, the FIRST PARTY will complete all necessary proceedings and procure all necessary authorizations , permits, licenses, and approvals referred to in Paragraph 3 (c) and (d), PART ONE, hereof; will obtain the necessary funds , or will take appropriate proceedings to legally obtain the necessary funds , which, together with the amount to be represented by the Grant, will be suffucuent to pay all costs of constructing the Project; and, will lawfully acquire all lands, easements, 4 franchises , and rights-of-way necessary to the completion of the Project, 4and to put the Project in operation. 71 6. First Requisition. After the FIRST PARTY shall have complied with the requirements of paragraphs 3 and 5, PART ONE, hereof, and shall have expended not less than fifty per centum of the estimated cost of constructing the Project, the FIRST PARTY may at any time there- after, file with the SECOND PARTY, a requisition requesting the SECOND PARTY to pay to the FIRST PARTY, as provided in Paragraph 7, PART ONE, here of, the first portion of the Grant, such requisition to be accompanied by: (a) One certified copy of each necessary authorization., . permit, license and approval from Federal, State, county, municipal and other authorities, for the construction of the Project; (b) A signed`and dated opinion of the duly qualified and acting attorney of the FIRST PARTY to the effect that the FIRST PARTY to the effect that the FIRST PARTY has complied with all'the requirements of Paragraph 5, Part One, hereof, and that all such proceedings are in accor- dance with the Constitution and Statutes of the Common- wealth of Massachusetts Such opinion shall also state that the FIRST PARTY has, lawfully obtained and/ or arrangd to obtain the funds, which, together with the amount to be represented by the Grant, may be used lawfully to pay all costs of construe- ting the Project; (c) A signed and dated affidavit of a duly authorized officer of the FIRST PARTY, approved by the engineer or architect ' a in responsible charge of construction of the Project, covering in such detail as' the SECOND PARTY'S engineers request: (1) The purpose for which the FIRaT PARTY proposes to expend such portion of the Grant; (2) An accounting for all deposits in and expend- itures from the special account or accounts referred to in Paragraph 2 , rtiRi TREE, hereof; (3) The cost of the labor and materials employed upon the Project to the date thereof; (4) The quantity of work actually completed to the 4 . date thereof; 4 PRI f (5) The amount of funds expended upon the Project to the date thereof; and (6) The amount of funds expended to the date thereof for labor and materials employed upon the Project; (d) a signed and dated no-litigation certificate of the duly quali- fied and acting attorney of the FIRST PARTY; and (e) a statement by each bank in which have been deposited, in the special account or accounts referred to in PRragraph 2, PART THREE, hereof, the funds for the construction of the Projects showing all deposits made therein and the balance then remain ing in each such special account. The requisition and each of the documents accompanying same shall be in form and substance satisfactory to the SECOND PARTY, and, except for those .described, in Paragraph 6 (a) , PART ONE, hereof, shall bear the same date. (7) First Payment. If such requisition and documents accompany- ing the same are satisfactory to the SECOND PARTY, then, subject totheterms ' j and conditions of this Agreement, upon reasonable notice to the FIRST PARTY$ �y and within a reasonable time after the receipt by the SECOND PARTY of ,such requisition and other documents , .(but not earlier than ten days after the receipt thereof, unless the SECOND PARTY shall waive such time limit), the r'. SECOND PARTY will pay to the FIRST PARTY an amount equal to twenty-five. per centum of the total cost of .the labor and materials employed upon the Project, as; in the opinion of the SECOND PARTY; is shown in all sta3teaients • theretofore approved by the SECOND HiRTY. Such payment will be made at the rfi Federal Reserve Bank of Bostonp Bostony Massachusetts a or at such other place or places as the SECOND PARTY may designate, against delivery by the FIRST PARTY of its receipt therefor. (S( Intermediate Requisitions. From time to time after such first payment, but not more often than once in thirty days (unless otherwise satisfactory to the bECOND PARTY) the FIRST PARTY .may file requis- itions with the SECOND PARTY, requesting the SECOND BLRTY to make additional payments on account of the Grant, each such requisition to be accompanied -by: '^ (a) Documents corresponding to those described is Paragraph , ,' '.., 6 (b) and (d) , PART ONzy,-bereof; (b) A signed and dated affidavit of a duly authorized 'k` officer of the FIRST "PARTY, approved by the engineer or architect in responsible charge of construction of the s i 2roject, covering in such detail as the SECOND PARTY'S 1 engineers may request: u (1) The purposes for which the FIRST PARTY proposes to expend such portion of the Grant; (2) an accounting for all expenditures theretofore E made on the Project, in so far as such expenitures l have not been previously so accounted for: (3) The cost of the labor and materials employed upon the Project to the date thereof: (4) The quantities of work actually completed to the date thereof: (5) The quantities of work actually completed during each of the periods between all respective requisitions; (6) The amount of funds expended upon the Project during each such period: and (7) The amount of funds expended during each such period for labor and materials employed upon the Project; (c) A statement be each bank in which have been deposited, in the special account or accounts referred to in Paragraph 20 PART THREE, hereof, the funds (including any previous payments on account of the Grant) for the construction: of the Project, showing the balance then remaining in each such special account, provided no such statement need be submitted by any bank in which no such balance remains on deposit and which has previously so certified. The requisition and each of the documents accompanying the same shall be in form and substance satisfactory to the SECOND PARTY and shall bear the same date. (9) Intermediate Payments . If such requisition and documents accompanying same are satisfactory to the SECOND PARTY, then, subject to the terms and conditions of this agreement, upon reasonable notice to the FIRST PARTY, and within reasonable time after receipt by the FIRST PARTY an amount ,I • equal to 25 per centum of the cost of the labor and materials employed upon the Project, not exceeding, however, with all previous payments on account 6 of the Grant, an amount equal to 25 per centum of the total cost of such i labor and materials as shown in the statements theretofore approved by the SECOND PARTY, but in no event, to exceed, together with all such previous. payments , in the aggregate, the sum of $3583. Each such payment shall be made at the place or places as hereinbefore provided for, against delivery by the FIRST PARTY of its receipt therefor. 10. Final Requisition. Pdien the Project has been completed :and all costs in connection therewith have been determined, then the FIRST PARTY may file the final requisition with the SECOND PARTY, requesting the SECOND PARTY to make the final payment on account of the Grant. Such requisition shall be accompanied by: (a) yocuments Correspondingto those described cribed in Paragraph 6. (b) and (d), and Paragraph 8 (c) , PART ONE, hereof; (b) An affidavit corresponding to that described in Paragraph 8 (b), PART ONE, hereof, which shall also be approved by the Government engineer; (c) An affidavit by the engineer of architect in responsible charge of construction of the Project, (which shall be ' approved by the Government engineer) , showing., am"ong other i things, and in such detail as shall be satisfactory to the (SECOND PARTY: (1) The quantities of work completed during each of the periods between the dates of each respective„ requisition; (2) The cost of labor and materials employed upon the Projects the total cost of the Project; and (S) The completion of the Project in accordance with the plans and specifications therefor. , a The term "Government Engineer" as used herein, shall mean the State Engineer (P-W.A. ), or his duly authorized representative, or any person to whom his duties or functions may be trasferred by the Federal Emergency II Administration of Public Works , or tis successors . 1 11. Final Payment. If such requisition and the documents accompanying r the same are satisfactory to the SECOND PARTY$ then, subject to the terms and conditions of this Agreement, upon reasonable notice to the FIRST PARTY'. and within a reasonable time after receipt by the SECOND PARTY of such requisit- ion and other documents, the SECOND PARTY will pay to the FIRST ARTY a sum of money, which, together with all payments theretofore made on account of s the Grant, shall not exceed 30 Per centum of the cost of labor and materials employed upon the Project, but in no event, to exceed, in the aggregate, together with all such previous payments , the sum of 14,300 Such final payment shall be made at the place or places as hereinbefore provided for, against delivery by the FIRST PARTY of its receipt therefor. PART TWO CONSTRUCTIODT CONTRACTS 1. Construction Contracts* e.11 construction contracts made by the iFIRST PARTY and all subcontracts for work on the Project shall be subject opted by the SECOND RLRTY to carry out the to the rules and regulations ad purposes and control the administration of the act, and shall contain provisions appropriate to insure that: { (a) Convict Labor. No convict labor shall be employed on the Project, and no materials manufactured or produced by con- vict labor shall be used on the Project. i (b ) ;50-Hour week. Except in executive, administrative and super- visory positions, so far as practicable and feasible in the judgment of the SECOND HLRTY no individual directly employed on the rroject shall be permitted to work more than thirty hours in any one week, or, except in cases of emergency, on any Sundays or legal holidays; but in accordance with rules and regulations from time to time made by the SECOND PARTY, this provision shall be construed to permit working time i lost because of inclement weather or unavoidable delays in any one week, to be made up in the succeeding twenty days. (c) Wages . (1) all employees shall be paid just and reasonable wages which shall be compensation sufficient to provide, for the hours of labor as limited, a standard of living in decency and comfort; (2) all contracts and subcontracts shall further prescribe such minimum wage rates for skilled and unskilled labor as may be determined by the SECOND PARTY and shall be subject to all rules and regulations which the SECOND PARTY may promulgate in connection therewith. ouch. minimum rates, it any, shall also be stated in all proposals of bids submitted, including those of subcontractors; and a clearly legible statement of all wage rates to be paid the several classes of labor employed on the work shall be posted in a prominent and easily accessible place at the site of the work. All contractors shall keep a true and accurate record of the hours worked by ttk and the wages paid to each employee and shall furnish the 6ECOND PARTY with sworn statements thereof on demand; (3) all employees shall be paid in full not less often than once each week and in lawful maney of the United states of America ri in the full amount accrued to each individual at the time of 4; closing of the payroll, which shall be at the latest date practicable prior to the date of payment, and there shall be no deductions on.account of goods purchased, rent, or other, obligations , but such obligations shall be subject to collection only be legal process. (d) Labor Preferences. Preference shall be givens where they are qualified, to ex-service men with depandents, and then in the following order: (l) To citizens of the United states and aliens who have declared their in of becoming citizens, who are bona fide residents of the Town of North Andover a dbr Essex County, Commonwealth of Massachusetts : and (2) To citizens of the United btates and aliens who have 1I declared their intention of becoming citizens , who are bona fide residents of the Commonwealth of Massachusetts ; provided, that these preferences shall apply only where such 3 labor is available and qualified to perform the work to which ' the employment relates. (e) Panployment services. To the fullest extent possible, labot required for ,the rroject and appropriate to be, secured through employment services , shall be chosen from lists of qualified workers submitted by local employment agencies designated by the United States Employment service, provided, however, that organized labor, skilled and unskilled, shall not be required to register at such local employment agencies but shall be secured in the customary ways through recognized union locals . In the event, however, that qualified workers are not furnished by the union locals within 48 hours (cundays and holidays excluded) after request is filed by the employer , such labor may be chosen from lists of qualified workers submitted by local employment agencies designated by the United 6tates Employment service. In the selection of workers from lists prepared by such employment agencies and union locals, the labor preferences provided in Para- graph 1 (d) , PART TWO, hereof, shall be observed in accordance with such rules and regulations as the SECOND PARTY may prescribe. ; (f) Human Labor. In accordance with such rules and regulations as the SECOND PARTY may prescribe, the maximum of human labor khall be used in lieu of machinery wherever practicable and consistent with - sound economy and public advantage; and to the extent that the work may be accomplished at no greater expense by human labor than by the use of machinery, and labor of requisite qualifications is available, such human labor shall be employed. (g) accident Prevention. Every construction contract for work on the Project shall contain an undertaking to comply with all applicable; provisions of the laws and building construction codes of the 6tate`1 Territory, District and/or municipality in which the work is done, ; and with any regulations for the protection of workers which maybe ` promulgated by the SEOOND PARTY. (h) Compensation Insurance. Every construction contract for, work on the Project shall contain a provision requiring the employer to furnish compensation insurance for injured workers and to give proof of such adequate insurance satisfactory to the SECOND PARTy. (i) Persons Entitled to Benefits of Labor Provisions. Bvery person who performs the work of a laborer or of a mechanic on the Proj- ect,. or any part thereof, shall be entitled to the benefits . of the labor and wage provisions hereof, regardless of any contractual relationship between the contractor or subcontractor and such laborer or mechanic. There shall be no discrimination in the selection of labor on the ground of race, creed or color. 10 (j ) Bonding of Uontracts . Construction contracts shall be supported by adequate surety or other bonds or seour ity' satisfactory to the sEUOND PARTY for the protection of labor and material men employ- ed on the Project or any part thereof. (k) Materials . so far as articles , materials, and supplies produced in the United states are concerned, only articles , materials and ` supplies produced under codes of fair competition adopted par- suant to the provisions of Title I of the Act, or under the President's Reemployment Agreement, shall be used in work on the Project, except when the SEUUND PARTY determines that this re quirement is not in the public interest or that the consequent cost is unreasonable, ao far as feasible and practicable, and subject to the above, preference shall be given to the use of locally produced matterials, if such use does not involve higher j cost, inferior quality, or insufficient quantity, subject to the determination of the SACC:;:; PARTY; but there shall be no require ments providing price differentiations for or restricting the use of materials to those produced within the Nation or state. (1) Inspection and Records . The SECOND PARTY, through its authorized ,? agents , shall have the right to inspect all work as it progeessea and shall have access to all payrolls, records of personnel, 3n u. voices of materials , and other data relevant to the performance of the contract. (m) Reports . Subject to such rules and regulations as the SECOND PARTY may prescribe, contractors and subcontractors shall make r reports in triplicate to the SECOND PARTY monthly within five days diter the close of each calendar month on forms to be a furnished by the United States Department of uabor, which, reports shall include the number of persons on their payrolls, p the aggregate amount of the payrolls; the man-hours worked; j wage scales paid to various classes of labor; and the total expenditures for materials . The contractors shall also furnish to the SECOND PARTY THE names and addresses of all subcontractors at the earliest dates practicable. j J 11 .� i 1 (n) Compliance with Title I of the Act. All contractors and subcontractors must comply with the conditions pre- scribed in Section 7 (a) (1) and Section 7 (a.) (2) of Title I of the Act'. R 2. Restriction as to Contractors. If the SECOND PARTY shall not be satisfied as to all legal matters and proceedings affecting the Project* ", (d) Representations. •If any representations made by the FIRST ± ' PARTY in this Agreement or in the application for the Grant or '' art other data submitted by the PIRST. PARTY shall be found by the SECOXD PARTY to be incorrect or incomplete in any material-,:, respect; (e ) Pim pial Condition. 'If, in the judgment of the SECOND PARTY, ` the financial condition of the FIRST PARTY shall have changed unfavorably in a material degree from its condition as there— tofore represented to the SECOND PARTY. No waiver by the SECOND PARTY, express or .implied, of any such condition shall constitute a waiver thereof as applied to any subsequent obligation of $' the. SECOND PARTY under this AgRM=ent. i (2. Deposit of Proceeda. .THE FIRST PARTY will deposit the Grant, 4 and all funds which it has represented to the SECOND PARTY as on hand or hereafter available for the construction of the Projects in a bank or T banks which are members of the Federal Reserve System; in a special account or accounts.. `a 13 w 3. Disbursement of Proceeds. The FIRST PARTY will expend the funds in such special account or accounts only in paying the cost of constructing the Pro i Jett. 4. Accounts.. The FIRST PARTY will keep proper books of records and 3ecounts (separate from all other records. and accounts) in which complete and. iorrect entries shall be made of all transactions relating to the System 1 . and to the Project. 5. Information. During the construction of the Project, the FIRST PARTY will furnish to the SECOND PARTY all such information and data. as the �SECOI�D PA8TY1S engineers may request as to the construction, costand progress of the work. 6. RL-presentations and warranties. THE FIRST PARTY represents and J: warrants as follows: (aG) Authorization. All nesessary authorizations, pemmits, li- cenaes and approvals from Federal, Atate, county, municipal and other authorities have been or will be obtained for the A construction and operation of the Project. 4 (b) Litigation. No litigation or other proceedings are now pend �. s ing or threatened which might adversely affect the powers and w authority of the FIRST PARTY in reference to the construction47. or financing of the Project, or the financial condition of the FIRST PARTY (c) Fees and. Commissiona. No fees or commissionr.has been or will 4 4 r any of its officers, employee be paid by .the FIRST PARTY o agents or representatives., and no agreement to pay a fee or commission has been or will be entered into by or on behalf >: of the FIRST PARTY or any of its officers, employees, agents or representatives, in order to secure the Grant Hereunder. j (d) Affirmation. Every statement contained in this Agreement, in the application for a Grant, in any supplement thereto or G amendment thereof, and any other data submitted or to be sub ,i mitted to the SECOND PARTY by or on behalf of the. FIRST PARTY is, or when so submitted will be, correct and complete, and no"" revelant fact materially affecting the Project or the finance ing thereof by the FIRST PARTY has been or will be omitted ail 4 therefrom. 14 •1 7. Indemnification. THE FIRST PARTY will indemnify the SECOND PARTY against any loss or liability incurred by reason of any inaccuracy or incompleteness in any representation contained herein. S. Use of Second Party' s Name. Without the prior written consent f the SECOND PARTY, the FIRST PARTY will-not refer to this Agreement or to any rant authorized or made hereunder as an inducement for the purchase of any ecurities of the FIRST PARTY, and will not permit any purchaser from it of y such securities to do so. 9. Expenses.. The FIRST PARTY will pay all costa, charges and ex enses incident to compliance with all the terms and conditions of this Agree- 1.ent greelent on its part to be complied with, including,, without limiting the genera- lity of the foregoing, the cost of preparing, executing and delivering to the COND PARTYall the documents required herein to be furnished by the FIRST. ARTY. 10. Supplemental Instruments. Upon request, the FIRST PARTY will furnish such data., agreements. and other instruments. as the SECOND PARTY may eem necessary or desirable in connection with the performance of the obliga- ions of the FIRST PARTY under this Agreement. 11; Agreement Notfor the Benefit of Third Parties. This agree ent is not for the benefit of any person or corporation other than the parties ereto, 12. Kiscellaneous. No rights of the FIRST PARTY hereunder shall be assignable except with the prior written consent of the SECOND PARTY. ' All obligations of the FIRST PARTY shall cease upon payment in full of all costs of constructing the Project. F ' ry i .i / r / i i [CHAP.461] AN ACT PROvMDYG FOR PREFERENCE TO DE GIVEN TO VETERANS AND OTHERS IN THE EMPLOYMENT OF MECHAN- 'ICS, TEAMSTERS, CHAUFFEURS AND LABORERS ON CERTAIN - PUBLIC WORKS, AND PROVIDING ALSO 'FOR THE PRIOR DETERMINATION BY THE COMMISSIONER OF LABORAND S- - INDUSTRIES•OF• THE MINIMUM WAQES TO BE PAID.Tp SAM _ EMPLOYEES ON SUL-a PUBLIC"WORES: Be it enacted, etc.,as follows: Chapter one hundred and forty-nine of the General Laws is hereby amended by striking out sections twenty-six and twenty-seven, as appearing in the Tercentenary Edition, and inserting in place thereof the six,following new see- tions:—Section 26.' In the employment of 'mechanics, teamsters, chauffeurs and•laborers•in't construction of public works by'the commonwealth,or by a county, town or, district, or by persons contracting'or sub-contracting for such works,preference shall first be given to citizens,of the commonwealth who have served'in the army or navy of the United.States in time of war and have been honor- ablydischarged therefrom or released from: active duty j . therein,and who are qualified to perform the work to which the employment"relates; and secondly, to citizens of the commonwealth generally, and, if they;cannot.be obtained r "'in'euRicientnnmbers Hien W'citizens of the United States;'.M and every contract for such work shall contain a provision to this effect. Each county, town or district in the con- struction of public works, or persons contracting or Sub- contracting for such works,shall give preference to veterans and citizens who are residents of such county; town or district._ The rate per hour of the wages paid to said mechanics, teamsters, cbauffeurs and laborers in the con- struction of public works shall not be.less than the rate or rates of wages to be determined by the commissioner as hereinafter provided; provided, that the wages paid to laborers employed on said works shall not be less than those paid to laborers in the municipal service of the, town or towns where said works are being constructed; provided, further, that where the same public work is to be con- structed in two or more towns,-the wages paid to laborers Shall not be less than those paid to laborers in the municipal service of the town paying the highest rate; provided, further, that if,in any of the towns where the works are to be constructed,a wage rate or wage rates have been estab- lished in certain trades and occupations by collective agree- meats or understandings between organized labor and em- ployers,the rate or rates to be paid on said works shall not be less than the rates so established; provided, further, that in towns where no such rate or rates have been so established, the wages paid to mechanics, teamsters,chauf- feurs and laborers on public works, shall not be less than the wages paid to the employees in the same trades and occupations by private employers engaged in the construe- tion.industry. This section shall also apply to regular em- ployees of the commonwealth, or of the county, town or district when such employees are employed in the con- struction, addition to or alteration of said works for which special appropriations are provided. Section 27. The commissioner shall prepare, for the use of such public officials or public bodies whose duty it shall be to cause public works to be constructed, a list of the several jobs usually performed on various types of public works upon which mechanics, teamsters, chauffeurs and laborers are employed. The commissioner shall classify said jobs, and he may revise such classification from time to time, as he may deem advisable. Prior to awarding a contract for the construction of public works, said public official or public body shall submit to the commissioner a list of the jobs upon which mechanics, teamsters, chauffeurs and laborers are to be employed,and shall request the com- missioner to determine the rate of wages to be paid on each job. The commissioner, subject to the provisions of the preceding section, shall proceed forthwith to determine the same, and shall furnish said official or public body with a schedule of such rate or rates of wages as soon as said determination shall have been made. In advertising or calling for bids for said works, the awarding official or public body shall incorporate said schedule in the advertise- ment or call for bids by an appropriate reference thereto, and shall furnish a copy of said schedule, without cost, to any person requesting the same. Said schedule shall be made a part of the contract for said works and shall con- tinue to be the minimum rate or rates of wages for said employees during the life of the contract. Any person engaged in the construction of said works shall cause a legible copy of said schedule to be kept posted in a con- spicuous place at the site of said works during the life of the contract. Whoever shall pay less than said rate or rates of wages to an employee on said works shall forfeit to the commissioner a sum equal to twice the difference between said rate or rates andthe wages actually paid to said em- ployee,said sum to be recovered by the commissioner in an action of contract for the benefit of the employee; and whoever, for himself, or as representative, agent or officer of another, shall take or receive for his own use or the use of any other person, as a rebate, refund, or gratuity, or in any other guise,any part or portion of the wages paid to any employee.for work done or service rendered on said public works, shall be punished by a fine of not less than one hun- dred nor more than five hundred dollars, or by imprison- ment for not more than six months, or both. Section 27A. Within three days from the date of the Chap.461.pada 2. i i first advertisement or call for bids, two or more employers of labor, or two or more members of a labor organization, or the awarding officer or official, or five or more residents of the town or towns where the public works are to be con- structed,may appeal to the associate commissioners from a wage determination, or a classification of employment as made by the commissioner,by serving on the commissioner a written notice to that effect. Thereupon the commis- sioner shall immediately cause the associate commissioners to hold a public hearing on the commissioner's action ap- pealed from. The associate commissioners shall render their decision not later,than three days after the closing of the hearing. The decision of a majority of the.associate commissioners shall be final and notice thereof shall be given forthwith to the awarding official or public body. Section 27B. Every contractor,sub-contractor or public body engaged in said public works to which the two pre- ceding sections apply, shall keep true and accurate register of all mechanics, teamsters, chauffeurs and laborers em- ployed thereon, showing the name, address and occupa- tional classification of each employee on said works, and the hours worked by, and the wages paid to, each such em- ployee,and shall furnish to the department upon its request a true statement of the same. Such records shall be kept in such manner as the commissioner shall prescribe, and shall be open to inspection by any authorized representa- tive of the department at any reasonable time and as often as may be necessary. Section 27C. Whoever, either by himself or an agent, superintendent or foreman-for another, violates any provi- Bion of the four preceding sections, where no other penalty has been provided for, shall be punished by a fine of not less than one hundred nor more than three hundred dollars for a first offence, and for a subsequent offence,by a fine of not less than two hundred nor more than five hundred dol- lars, or by imprisonment for not more than three months, or both. Whoever shall have been convicted of a second i violation of any of said provisions shall be prohibited from contracting, directly or indirectly, with the commonwealth or any county, city, or town for the construction of any public works, or from performing any work on the same as contractor or sub-contractor for a period of two years from the date of said conviction. Section 27D. Wherever used in sections twenty-six to twenty-seven C, inclusive, the words "construction" and "constructed", as applied to public works, shall include additions to and alterations of public works.
