Regular Meeting
The Board of Appeals held their regular meeting on Monda~ evening, December 11,
1961 at 7:30 P.M. at the Town Building. Members present and voting were: Daniel T.
0'Leafy, Ch~i~man; Harold Morley, Secretary; Howard Gilman, Robert J. Burke and
Henry E. Land.
HEARING: Viola Koho~
This hearing was in the appeal of Viola Kobos, requesting a variation of
Section 6, para. 6.31, 6.62 .of the Zoning By-Law so as to permit the subdivision of
existing sm~ll lots into two lots on the pr~mises, located at Mablin Avenue.
Chairman O'Leary read the legal notice of the hearing,
Mrs. Kobos was present and expla~Aed that the subdivision of the small lots into
two lots was necessary in order to comply with the By-law, for future sale of the
laud. There was no opposition.
Mr. Burke made a motion to take the petition un~er advisement. Mr. Lund
seconded the motion and the vote was unanimous.
HEARING: Robert R. Deacon
This hearing was in the appeal of Robert R. Deacon, requesting a variation of
Section 6, para. 6.2 of the Zoning By-Law so as to permit the addition of a
dining room and garage on the premises, located at 171 Cotuit Street.
Chairman O'Leary read the legal notice of the hearing.
Mr. Deacon was present and explained his need for the addition and added tha%'
it would be an asset in the neighborhood and that his neighbors were in favor of it.
There was no opposition.
Mr. Burke made a motion to take the petition under advisement. Mr. Lurid
seconded the motion and the vote was unanimous.
HEARING: Margaret Curtin & Js~aes O. Curtin
This hearing was in the appeal of Margaret Curtin & Jmaes O. Curtin requesting
a variation of Section 6, para. 6.3, 6.31 of the Zoning By-Law so as to permit the
subdivision of existing small lots into two lots on the pr-m!ses, located at the
westerly side of W~tworth Avenue.

Yr. Curtin was present and expire_ned the subdivision of 4 small lots into ~
lots. O~e house is erected and another to be built shortly. It was necessary to
clear up lot size require~_ments in order to continue with the sale of one house
a~d erection of another. There were 6 abutters present. There was no opposition,
but Mr. & Mrs. Martin Lawlor, Jr. and Mrs. Ferrin asked questions of the petitioner
and the Board.
Mr. Burke made a motion to take the petition 'Under advisement. Mr. Lurid
seconded the motion and the vote was unanimous.

The Board then discussed the three hearings and made the foll~wlng decisions:
1. Viola Kobos:
Mr. B~rke made a motion to APPROVE the variance. Mr. Lund seconded the motic~
and the vote was unanimous. Permission is hereby granted to allow the subdivision
of the lc~s as set forth on the applicant,s plan. This subdivision complies with
Sec. 6, para. 6.62 of the Zoning By-Law, all provisions of said section having been
c,~,,~.,lied with.
2. Robert R. Deacon:
Mr. G~lm~n made a motion to APPROVE the variance. Mr. Morley seconded the
motion and the vote was unanimous. Permission is hereby granted to allow the
erectic~ of a ~ag room and garage to the rear of the structure, to be withiu
? feet of the side line on the northwest corner and within 8 feet of the side line
on the southwest corner and a distance of 1§o5~ feet from the street line.
It would be a particular hardship to the applicant if these variances were not
granted, due to the unusual contour of the land, and She location of the existing
houses are built in conformity to the natural contour of the land.
3. Margaret Curtin & James O. Curtin:
Mr. Burke made a motion to APPROVE the variance. Mr. Morley secouded the
motion and the vote was unanimous. Permission is hereby granted to allow She
subdivision of lots ~106, 107, 108 and 109 iuto lots A and B, as set forth an the
applicant,s plan, by granting a variance so Shat each lot may have a front line
less than 100 feet and a total area of less Shan 12,5OO sq. feet.
It would he a particular hardship to She applicant if these variances were not
granted. Both lots conform to the existing lots in the neighborhood and the
granting of these variances would not derogate from the purposes of She Zoning
The B~ard than discussed the Budget for 1962 and will ask for an appropriation
of $800, due to the increase in hearings which also means an increase in expenses
and services.
