HomeMy WebLinkAbout1962-03-12Monda~ - March 12, 1962 Regular Meeting & Hearing The Board of Appeals held their regular meeting on Monday evening, March 12, !962 at ?:30 P.M, in the Town Building. The members present and voting were: Daniel T. O~Leary, Chairman; Harold Morley, Secretary; Robert J. B~rk~, Howard Gilman and Associate Member ~illima Morton, who sat in place of Henry Lund. HEARING: Charles Waites. This hearing was in the appeal of Charles Waites requesting a variation of Sec. 6, para. 6.31 of the Zoning By-Law so as to permit the use of two lots of land m~,~y adjoining and in one *.,~ership to be used separately for two homes, with each lot conta__ining 8300 sq. feet more or less ~n the premises, located at the east side of Saunders Street, 100 feet distant from the corner of Cleveland Street and known as 70 Saunders Street. Chairman O, Leary read the legal notice of the hearing. Atty. Jehn J. Willis represented the petitioner, who was also present. Atty. Willis showed plains and explained the reason for desiring two lots. He pointed out that the Board wus familiar with Mr. Waites, predicsme~t as shown by previous hearings. Each lot would have a 50 ft. frontags, which w~mld be the same as other lots in the neigh- borhood. Each hcme would cost about $15,OOO. He has talked with some of the neighbors and they were in favor of having hemes built there. Mr. Morley the motion no abutters present and there was no epposition. made a motion to take She petition under advisement. Mr. Morton seconded and the vote was una~h~ous. The Board discussed the l~i2~mm. Mr. Burke made a motion to GRANT the variance. Mr. O~m'~ seconded the motion and the vote was unanimous. The reasons for s~oproval ~ as follow~: 1. There exist certain conditiens, especially affecting the parcel in question, which do not generally affect the entire zoning district in which the parcel is located. 2. Unless the variance is granted, the applicant will suffer substantial hardship, financial or otherwise. 3. The requested variance will not adversely affect the public good to any substantial extent and will not materially affect the general character of the neighborhood. 4, The requested variance will not be in substantial derogation from the intent or purpose of the Zoning By-Law.
