HomeMy WebLinkAbout1962-05-14Monday - 14, 1962 Regular Meeting The Board of Appeals held their regular meeting on Monday evening, May 14, 1962, at 7:30 P.M. in the Town Building. The following members were present and voting: Daniel T. O'Leary, Chairman; Harold Morley, Secretary; Howard Robert J. Burke and Associate Member Arthur Drummond who sat in place of Henry Lurid. 1. HEARING: Salvatore Alaimo. Mr. O~Leary read the legal notice which was in the appeal of Salvatore Alaimo requesting a variation of Sec. 6, Para. 6.31 of the Zoning By-Law so as to permit the subdivision of three existing lots, each 50' x 1OO~, into two lots, each 75' x 100~, on the premises located at east side of Harwood Street, known as 26 Harwood St. Mr. Alaimo and his daughter were present and showed the plans to the Board. There were no questions since everything was shown on the plans. There were no abutters present and there was no opposition. Mr. Burke made a motion to take the petition under advisement. Mr. Morley seconded the motion and the vote was unan__~mous. 2. HEARING: Sherwood Homes, Inc. 7:45 P.M. Mr. Morley read the legal notice of the Sherwood Homes, Inc. requesting a variation of Sec. 6, Para. 6.31 of the Zoning By-Law so as to permit the erection of a frame residential dwelling on the premises, located at the south side of Gilbert Street; 211 feet from the corner of Patriot Street and known as Lot ~2 and part of Lot 43, Gilbert Street. Mr. John Shields and his son were present. The showed and explained the plans to the Board. Mr. Shields sh=~ed a plot plan of record from the Registry _~_-~ has an agreement with Davis and Furber Machine Co. There is water, gas and sewerage and he will extend the water where needed. The lots are in accord with the neigh- borhood. Approval of this variance will broaden the tax base for the Town. Mr. Burke made a motion to take the petition under advisement. Mr. Gil_wmn seconded the motion and the vote was unanimous. 3. HEARING.' Sherwood Homes, Inc. 8:00 P.M. Mr. Morley read the legal notice of the Sherwood Homes, Inc. requesting a variation of Sec. 6, Para. 6.31 of the Zoning By-Law so as to permit the erection of a frame residential dwelling on the premises, located at the north side of Francis Street, located 211 feet distant from the corner of Patriot Street and known as Lot 32 and part of Lot 33, Francis Street. Mr. Burke made a motion to go ahead with the hearing even though it was not yet 8:00 P.M. Mr. Drummond seconded the motion and the vote was unanimous. The same information applied to this variance as to the previous one. 4. HEARING: Sherwood Homes, Inc. 8:15 P.M. Mr. Morley read the legal notice of the Sherwood Homes, Inc. requesting a May 14, 1962 - Cont. variation of Sec. 6, Para. 6.62 of the Zoning By-Law so as to permit to bring i~to conformity of size, existing Lots of Record, indicated on Plan #2098, No. District Essex Registry of Deeds, dated July 28, 1949, resulting in lots of not less than 10,OO0 sq. ft. and not less tken 100 ft. frontage on the premises, located at West side of Patriot Street, from the corner of Belmont Street to the corner of Francis Street, Lots 84-93, 46 & 47, 36 & 37. Mr. Shields explained that this land was offered to the Town at last year's Town Meeting, but the Town did not take it, so he purchased it from Davis & Furber. Mr. Burke made a motion to take the petition under advisement subject to any objections up to 8:15, since the hearings were going ahead of schedule. Mr. Morley seconded the motion and the vote was unanimous. Ther~ were no abutters present and there was no opposition. The Board then discussed the petitions and made the followimg decisi~s: 1. Salvatore Alaimo. Mr. Burke made a motion to GRANT the variance, Mr. Morley seconded the motion and the vote was umamimnus. Permission is granted to allow the subdivision of the lots as set forth on the applicant's plan. This subdivision complies with Sec. 6, Para. 6.31 of the Zoning By-Law, all provisions of said section kg__v~ng been c~mplied with. 2. Sherwood Homes, Inc. - 3 Hearings. Mr. Burke made a motion to GRANT the variances for the three hearings. Mr. Gil,~n seconded the motion and the VOte was UnaBtmmus. Permission is granted for th~ lots as set forth on the applicant's plans, all provisions of Sec. 6, Para. 6.62 & 6.31 of the Zonin~ By-Law having been complied with. The 0 ' Leary, the vote Board signed all of the plans. Burke made a motion to keep the present Chairmsm and Secretary. (Mr. Chairman and Mr. Morley, Secretary). Mr. Gilman secomded the motion and was llllanimons. Mr. Morley made a motion not to hold any ~;-~er meetings unless sometht-g special comes up. Mr. Gilman seconded the motion -nd the vote was unanimous. The Board signed a bill for Anna Donahue for $40.00. at 8~%o P.M. meeting adjouraed AD Clerk The Chairmsa
