Electric/NewEngland Telephone Petition: Turnpike St. The Board unanimously approved the petition to relocate 33 poles on Turnpike St. for the purposes of reconstructing lines. Mass. Electie/NewEngland Telel~hone: Sharpner's Pond Rd. The Board unanimously approved the petition to install 5 new poles on Sharpner's Pond Rd. to service 6 new homes. Mass. Ele6tricf Sharpner's Pond Rd. The Board.unanimously approved the petition to install buried cable on Sharpner's Pond Rd. to service Eastern Tank. Tree Bearing: Stackelback, 248 Greene St. The board conducted a ~public hearing in accordance with MGLC.87 upon the petiron of Mr. an Mrs. Stackelbeck of 248 Greene St., to remove a 30" white pine shade tree. Tree Warden, Leo Lafond reports that the tree has been found to be healthy and does not recommend removal. Upon a motion by Crouch, seconded by Smith, it was voted unanimously not to authorize the removal of the tree, but to instruct the Tree Warden to monitor it for damage and report same to the Boa~d. Toni Lally and John Thompson reviewed activities witb correction of the water quality.with the Board. Mr. Lally reported that chlorine dioxide equipment has been added and that the gtardia does not appear to be a problem at the state level, but that other matters are complicating the issue. He also~reportsd.that~the oznone generators have been approved by the State and personnel have been trained in the operation of.the system. Gayton 0sgo0d of the Bd. of Health reported that 3 negative test results will be necessary for giardia before they would vote to open the 'pond. Exec. Secretary Keith Bergman reported that the supplemental budget for $2.5 million has been signed by the Governor and that a meeting will be held with the state shortly to discuss how these funds can'.be spent. Chairman Salisbury suggested inviting Lake IEP to =he July 14th meeting for an update of activities. . LICENSING COMMISSIONERS Transfer. of Cahoots The Board held a public hearing on the application of Jem, Inc., d/b/a Vinny's to' transfer the restaurant all alcoholic license from Cahoots, Inc. d/b/a Andy & Harry's. Owner Vincent Fiore reported.that the restaurant will be more a family style restaurant, than'a tavern, and will operate on Sundays.in addition to during the week. Chairman Bahrawy reported that there has been a motion filed for a preliminary injunction for a restraining order by the owners of the Top of the Scales, due to a purchase and sales agreement reportedly not honored. Atty. Mirigltotti for Jem, Inc. said he believed there was no merit for the motion and requested that the Board move forward. Chairman Bahrawy also reported on correspondence from Atty. Marden noting pending lititagion and stated that he would prefer to take no action on the request until after the hearing on the injunction. Selectman Graham felt that.the.Board should not concern themselves with legal action outside of the scope of the application. Upon a motion by Smith, seconded by Crouch, it was voted 4-1(Graham opposed) to continue the public hearing on July 14th. Fourth of July: Two Day Liquor License FRank Dushame met with the Board to review concerns related to the 4th of July festivities requested two day beer license, reporting;that the park will be picked up on both days at the end·of festivities, and that the Highway Dept.will supply trash barrels. Additionally, he said one policeofficer will be at the park at all times with additional police coverage as needed. Upon a motion by Crouch, seconded by Smith, it was voted unanimously to grant a beer license and to request police patrol emphasis on the 0sgood St. Andover St. area. Ralph Adie, III: Common Victualer Mr. Adie, 22 Boxford St. appeared before the Board to request a common victualer license to operate a vending wagon, which he constructs himself, for the sale of steamed hot dogs, sodas, soft pretzels, etc. at night games and along Main St. Upon a motion by Salisbury, .seconded ~by Smith, it was voted unanimously to grant the license and request that Mr. Adie have trash trash receptacles available and to notify the. Recreation Council _ ' ..... -:~, ~ ..~.'.. Boston University The Board unanimously approved all alcoholic licenses for weddings on July 12 and July 19, at 0sgood Hill Conference Center.
