September 17, 1962 Regular meeting & ~earings The Board of Appeals held their regular meeting on Monday evening, September 17, 1962 at ? :30 P.M. in the Town Building. The following members were present and voting: Daniel T. O'Leary, Chairman; Robert J. Burke, Howard Gilman, William Morton and Associate Member Arthur Dru~nond who sat in place of regulsr member Henry Lund. The Board of Selectmen appointed ~illiam Morton as a regular member of the Board due to the resignation of Harold Mor~.ey and also apoointed John J. Shields as a Associate Member. Mr. Shields was present just to observe. The Board eledted a new secretary due to Mr. Morley's resignation. Nr. Gilman made a motion to nominate Mr. Burke as Secret~ry. Mr. Morton seconded the motion and the vote was unanimous. 1. H~i~RllfG: Do~enick ~angano: 7:30 P.M. Mr. Burke read the legal notice in the appeal of D~aeniek Nanagano requesting a Special Permit under Section 4.7 Para. 4.7 ~ ~.73 of the Zoning By-Law so as to permit the erection of two buildings, each to be 80 Ft. l~ng by 30 ft. deep, 2 stories high, 4 apartments on the proposed lot of land on the premises, located on the north side and east of ~erhill St. and corner of Concord St. There were five ~_m_ bors of the ~ngano family present and 1 abutter. Mr. Santo N~n~ane spoke fo~ the group and showed the plans to the Board. Ne explained that the area is zoned for General Business, that now it is just wasted land and they want to put it to use. There is a need for apartments in town. Ail utilities are available, sewer, water & gas, hydrauts. The ontrauee would Be on Bunker Mill St., a parking lot between the b~ildings and on each side. The existing brick building is owned by the fat~ end is 281 away from the proposed apartments. The type of building would be wood frame with a brick front to first story, Garrison style. Each apartment has its c~n 1st and 2nd floor, c~n basements and entrance. There would be ~ entrances to each building. They h~d orl_g~ purchased the land for a warehouse but felt it would ~e better to keep it residential since houses face it. Mr. Barbett, 67 Concord St., an abutter, stated he was not opposed but wanted wore information as to water drainage. He ~s a water problem and felt this project might create a worse one. Mr. N-~o expl-~ed that the water w~Ald ~rain to the back into the brook and w~uld in fact he an advantage to B~m since it would take some of the water a~ay and will improve the area. Mr. Barbett said he had no objection to t.w~ the area, would like to see it so, he ~ Just worried about the water drainage. Be has no objections if the water can ~r. Burke ma~e a motion to take the petition under advisement, Mr. Drmnnond seconded the motion and the vote was ~-=-~_w~As. 2. BEARING: Arthur Bentley: 7:45 P.M. Mr. ~urke read the legal notice in the appeal of Arthnr ~emtley requesting a variation of See. 7, Para. 7.23 of the Zoning By-Law so as to permit the erection of a three stall garage on the premises, located at 16 C~w~onwealth Ave. Mr. & Mrs. ~entle~ were present and showed the plans to the ~oard. Mr. Bentley explained that he would like a 3-stall garage for their two cars mad their nephew's car. The garage would be ~nly 2 ft. from the back lot line but all of the land to the rear has been taken by tbs State for highway construction. There were no abut%ers present and there was no opposition. Burke ~ade a motion to take the petition under advisement, seconded by Mr. Norton and voted Mr. W41~s was present to recfdest a hearing for the next meeting to convert a'h°ass to a restaurant in an Industrial area en Sutton St. The hearing will be held on October 8tb~ 3. ~EARING: Joseph Campopiano: 8~00 P.M. Mr; Burke read the legal notice in the appeal of Joseph CamPOlX~no requesting a variation of See. ?, Para. 7.22 of the Z~-~-6 ~y-Law so as'to permit the erection o~ a single family wood frame dwellers on the premises, located at northwest side of.. Hewett Avenue. Atty. Ralph E. Finek represented the petitioner who was also present. They showed the plans to the Board. Originally the lot contained approx. 6,160 Sq. ft. l~t the Town of North Andover took some of the ]~ f~r access purposes for the Fr~-~4~ School leaving 4,~ ~q. ft. Because of the shape of the lot, this is the ,-]y ~y the house could be placed, leaving 9 ft. on one side and 17.5 f~. on the Back. There is sewerage and is in Country Residence area. The 1~--~ ~oard origi~-~y felt that o~ its o~n initiative it would cut do~n the sizes of the lots as sewerage was in- stalled. It woul~ create a substantial ~dwhip if thio were not granted. The House that is to Be built would be an asset to the neighborhood. Gordon Chemberli~ ~s oppOSed stating the lot was too ~ and that it would be a detr~ut to the neigh- ~orheed. Upon being questioned, he stated his o~m lot is 20r/OO sq. ft. Me. Finck sta~ that y~u should hear in mind that the tc~n took ~ of the property and left a ~ lot on which he w~uld have to pa~ taxes, so that it involves a substantial hardship. Joseph Cham~er]~, was also opposed. He lives across the street, approx. 80 Gordon lives approx. 60 ft. away. Mr. Drummond made a motion to take the petition under advisement, seconded by Mr. Morton and voted unanimously. 4. HEARING.' Albert Kneupfer: 8:15 P.M. Mr. Burke read the legal notice in the appeal of Albert Xneupfer reques+~ing a variation of See. 6, Para. 6.33 of the ~,o-4~ By-Law so as to permit the divisi~a of ]~nd to ~e o~e addition~l bu~a~,~ lot on the premises, located at east side of Salem St., 400 ft. distant fr~a the corner of Appleton Street and known as nmaher 370 Salem Street. Mr. Xne~er showed his plans amd exp~aimed that he has a frontege of 2~ feet and needs a variance of 8 feet. There were no abutters present and there w~s n~ opposition. -MrS. McClellan, an abutter, telephoned to say that she had no objections. Mr. G~- ~ade a motion to take the petition under advisement, senc~ded by Mr. ~ke and voted 5.: }~ARING: Albina Camde]lo: 8:30 P.M. 1~. ~urke read the legal notice in ~he appeal of Albina Oard~llo reques*.~ a variation of Sec. 6, Para. 6.61 of the Zon~ By-Law so aa to permit a sac/1 house on a lot on the premises, looa+~ed at the corner of Mazeaehusetts Avenue an~ ~aeon Street. Mr. Cardello did not have the proper plans, ~he ~ WAll be sent in before an~ sept. 17, -Cont. decisioa i~ made. ~r. Cardello sh~ed a sketch. ~is mother & father ~ere also present. The lot cont~.~.~s, 5,380 ft. and a variance of 1~ ft. on one side a~d 12 ft. ca another is needed. There.were approx. 10 abutters present. Those recorded as opposed ware.- L41~4av Carlson, Mr. & Mrs. Ducker and Axel Carlson, all stating that the lot was too m~. Mr. 0'Leafy expS~-ed that there is no other land adjacent to this lot and that is why he has to come to this Board for a side line variance. Mr..~urke made a motion to take the petition under advisement and act on it at the next .meeting provided the proper plans are received. Mr. Morton zeeo~ded the motion and the vote was t~mous, The Board then proceeded to dis~ss the ew~ning~s hearings. 1. Domomic Mangano. Mr. O'Leary read a letter fX~a To~n 'Cou~zel regarding apartments and stated that these plans do not cc~for~ to the requirements of lot size for each apartment. Mr. Shields, newly appointed associate member was present just to observe, spoke as an observer caly and stated that the Registry would accept the plans because they dca't give total sq. ft., has brought in 2 lots as 4-family units instead of apartments - it would be easier to grant 2 S-family units and take out apartments." The subdivision of the lots also is in question, the plans dc not shew as lots or if a~ is one parcel. ~. ~rton got the Assessor's maps to see how ]_~ was divided, two iota on record, 80~ deep. The whole plot ~s changed to Business at To~n ~eeting. There is a distance 'of 8' from an existing b~ding on the adJo~,~ lot to the lot line of this plan. After further discussion, the Board instructed to Clerk to send Mr. ~mgano a letter asking him to show the Board a plot plan of record at the time of re-zoning of that area.' No further action will be tak~ ~ntil Mr. Manga~o has con- tacted' the Board. 2.. Arthur Bentley. Mr. Gilman stated that the garage would conform to the neighborhood, since all the houses are close together. Mr. ~orton said there whould be a fire resistant w~l on the south side of the garage ~tnce there is ~ a distance of 4 ft. hetwaen the Mr. Burke ~ade a motion to GRAFT the variance subject to the construction of a fir~ resistant wall ca the south side of the garage. Mr. D~w~nd seconded the motion and the vote was ,ma-~ous. The restriction V~ aisc be written on each copy of the plans. 3. Albert K~e~pfer. Mr. ~arke made a motion to GRA~T the variance, Mr. G~ seconded the motion and the vote was unanimous. 4. ~oseph C~mpopiano. The Board discussed the petitica and found that there was no ,proper block ~n the plans for the signatures of the Board. Mr. ~ made a motion to GRA~T the variance subject to putting the proper block on the plans for the signatures. ~r. Morton seconded the motion and the vote was ~a~. The usual reasons for g~_~ting are given t~ slx approvals. Sept. 17, 1962 - Cont. 5. Alb~ Oardello. The Beard took no aetion ca this petition until the proper plans are received.
