HomeMy WebLinkAbout1962-10-08Monday - October 8, 1962 Regular meeting & Nearings The Board of Appeals held their regular meeting on Monday evening, October 8, 1962 at ?:30 P.M. in the Town Building. The following members were present and voting: Daniel T. O'Lesry, Chairman; Robert J. Burke, Secret~ry; Howard Gilman, William Morton and Arthur Drummond, Associate Member sitting in place of Henry Lurid. Mr. Shields was present, just observing. 1. H~'~!,~G: Dewey A. Dyer Mr. Burk~ read the legal notice in the appeal of Dewey A. Dyer requesting a variatiou of Sec. 6, Para. 6.61 and 6.63 of the Zoning By-Law so as to permit a one stall garage addition on north side of existing dwelling on the premises, located at east side of Milk Street and known as 56 Ndlk Street. Mr. Dyer was present and spoke on his behalf and showed the plans to the Beard. There were appro~ately six people present for the hearing. The proposed addition would extend one foot, leaving 19 feet to the lot line. Mr. Roland Sherman spo~e, re~resenting Mr. & Mrs. Perkins, abutters, stating he v~nted to see the plans te determine the distance of the addition frem the side-line. Jennie Marino, an abutter, objected, sang she wants things left as they , he is coming too close as it is. Mr. Shields asked Mr. Dyer Lf this addition was a one car garage. Mr. Dyer answered that at present there is a one-car garage, this is to make an additional stall. This stall would be 15 feet wide, the same as the present stall, so that .it would match the other garage and have it look as part of the house, not just 'look tacked on. Mr. Shields said that the average garage is between 10-12 feet. Mr. Sherman said that he doesn,t think this situation calls for a variance. He could have the front the same without jutting over one foot; however, he would have no objection to a 1 ft. overlap. He says this does not meet all the requirements of the statute for the variance - a ~ariance should not be granted. Mr. Burke made a motion to take the matter under advisement. Mr. Drummond seconded the motion and the vote was unanimous. The Board then discussed the hearing. The members questioned the stamp ou the ~lans. Mr. Dyer has his ~,~i stamp.. Plans require the stamp of a Certified Engineer, ~r. O'Leary read the reasons for granting a variance to see if they applied to this petition and also read a letter from Town Counsel stating that all four reasons mst apply in order to grant a variance. Mr. Burke said that if nobody had opposed, the variance would probably be all right, but the neighbors have objected. Mr. Shields said that these plans could not be recorded because of ~he improper stamp. Mr. G41man said there is no hardship involved. Mr. Burke made a motion to DE~ the variance. Mr. Morton seconded the motion and the · vote was unanimous.
