The Board noting their concerns 'that the neighborhood residents were not properly notified
of these plans and would like their input prior to these tests taking place. Also of
concerns to,'the Board was the accuracy in cond~ctin§ these tests in the winter. Motion .....
made by Selectman B~eelini, seconded by Kenneth C. Crouch to defer action on this request
until the neighborhood residents are aware of these plans and have had an opportunity
to deal with these issues. Votedd2 to 2 with Selectmen Crouch & Dugan voted aye and~l~tman
Ercolini and Chairman Salisbury voting nay. As this was a deadIock vote, Chairman Salis-
bury stated that this issue was dead until something new is brought before the Board.
Barker Conservation Easement
The Planning Board submitted a Conservation Restriction Easement and Appurtenant Town
Easement .on land owned by George Barker for the Board's approval. The purpose of this
easement was to place an open space conservation restriction on George Barker~ land.
Town Planner, Scott Stocking, noted that this document had been approved as to form by
Town Counsel but that his board had concerns as to some of the language in the document.
After making some modification to the document which would now reflect the Planning Boards
intentions, the Town Planner again submitted the document before the Boa~d. Atty. Peter
Curuso, representing George Barker, stated that ha was in agreement with the document.
Upon a motion by Selectmen Ercolini, seconded by Selectmen Dugan, the Board unanimously
voted to executed'the Conservation Restriction Easement':and'A~tenant Town Easemant as
submitted by the Planning Departmeht. Atty. Curuso, on behal~of his client, thanked the
Town and Town staff fsr pulling this together noting thAs is the first town in the
Merrimack Valley to have a planned residential development and it shows the foresight of the
Planning staff.

~ecause of the action the Board Just took in reference to the Barker Conservation
Easement, upon a motion by Seledtmen Crouch, seconded by Selectmen. Dugan, the Board
unanimously voted that the Town not excercise its rights of 3first refusal on the Ch.61A
option on George Barker!s parcel of land and to send a letter to Mr. Barker stating that.
Winter ParkingBan
~pon a motion by Selectmen Crouch, seconded by Selectmen Dugan, the Board unanimously
approved th~ annual winter parking ban to. go into effect on December 1-through April ~.
Further, upon a motion by Selectmen CroRch, seconded by Selectmen Dugan, the Board
unanimously voted to post the old center parking lo~ as "no parking for more than
48 hours; cars being towed at owners expense".
Local~Arts Council

Town Manager Paul Sharon noted that because of recent resignations from the council it is
difficult for them to get a quorum for voting, and he recommended ghat an interim member be
appointed. Upon a motion by Selectmen Crouch, seconded by Selectmen Ercolini, the Board
unanimously voted to appoint Town~'Manager Paul Sharon to the Local Arts Council on an interi
basis. Noting~that at a recent meeting the board increased the number of members on</the
council from 5 to 7. In view of the current situation, upon a motion by Selectmen Crouch
seconded by Selectmen Brcolini, the Board unanimously voted to set back the size of the
council from 7 to 5.
Cable TV
Response received from Town Counsel reg~rding the "window" for negotiating the-contract with
Continental Cablevision. In reference to the extra hook up for the ability for the addition-
al tie in for th~ Selectmen's~Meeting Room, Selectmen Ercolimi suggested that the committee
look at the possibility of tieing into the Sehior Center as this may be a more effective
use of the hook up in terms of more utilization by the community as this facility can~'
handle a larger number of people. Motion:'made by Selectmen Ercolini, seconded by Selectmen
Dugan, the.~Board unanimously voted tb?ask the Cable TV Committee to review our current
contract and come up with%suggestions for consideration in terms of negotiating a
new contract and any and other items that effeet:~service and present something to the
Board with 90 days.

The Board decided to d~fer discussion on this subject until their next meeting.
Injured Firefighter
Fire Chief Dolan informed the Board of Firefighter Robert Fogarty's injuries in fighting a
fire Saturday when he fell off a latter. He stated thht he is currently in the hospital
and is expecting full recovery. Upon a motion by Selectmen Crouch, seconded by Selectmen
Duga~, the Board unanimously voted to send a get well card and flowers to him.
Update on FY 89 Tax Rate
The Board discussed the updated status on the FY 89 tax rate process. Town Manager Paul
Sharon stated that the prior Assessor, Ted Phalan, estimated new growth at $80m -
