SPECIAL TOWN COUNSEL:
Letter received from Town Counsel requesting the Selectmen appoint Atty. Donald F. Smith
to represent the town cf the District Court of Lawrence case, ~ichard M. Boherty and
A. Doherty v. Town of North Andover. Brian was asked why To~en Counsel could not represent
the town and Brian~ stated that Town Counsel's health prevented him f~om the duty.

The Board of Selectmen held their regular meeting on te wroth all memb mt,
Selectmen Joseph A. Guthrie, John F. Coady with Chairma~ Thomas J. McEvoy presiding. The
minutes and warrant were approved as submitted. E~ecutive session was c~l~ed at 7:32 p.m.
to hear complaint of a citizen~ involving a member of the police department.
POLE LOCATIONS:
Approved at hearings: Petition to install 5 poles on Lacy St., and 1 pole on Boston and
Sullivan Streets.

on Tuesday, October 4, 1977, at 7:30 p.m.
SPECIAL TOWN MEETING:
The Selectmen, upon receipt of a petition signed by 330 citizens, called a Special Town
Meeting to be held on Nove~mber 7, 1977, at 7:00 P.M. in the Middle School Auditorium. The
warrant ~11 be opened at the .Selectmen's Meeting on October 3, 1977 for inolueion of the
proper Articles. Articles must be posted 14 days before a Special Town Meeting so the Town
Clerk must receive them by October 22, 1977. Selectman Coady advised Bernal and others that
any Article containing price of land must be approved by the Board of Selectmen and the
Advisory Board. If approval cf both parties is not secured, the Article will be scrat~ched.

cate to the voters that an eminent domain taking may be authorized. Article not conclusive
enough. He advised that, if any definitive action is to be taken by the meeting upon the
k~ad subject matter of the proposed article,~ additional aritcles, submitted by the
tion Commission, the Selectmen or by some other Town Board of Officer, should be prepared
for insertion in the Warrant for the proposed Special Town ~eeting, giving the voters a
choice as to what definitive action should be taken. TOwn Counsel ~1 meet with Atty.
Sullivan representing the present owner, to confer with him as to what concessions the
present owner is ~ling to make in connection with the town's acquisition of title to part
or -~ of the area in question.
NORTH ANDOVER IAN~ILL:
Copy of letter received addressed to the Highway Surveyor from the Dept. of the Attorney
General re North Andcver's landiMll located off Holt Road. Letter stated the the Dept. of
Enviror~ental Quality Engineering has infomed this office that the .town's landfill is in
violation of the Solid'Waste Disposal Act and the Massachusetts Clean Waters Act. Their
office, therefore, intends to take appropriate action. The Selectmen voted to accept the
letter and w~11 discuss it further with Bud Cyr and Brian Su2.livan.
GAS ~CAVATION:
Approved: ~etition to excavate on Chickering Rd. and Highland Terrace and 6~ Water St. to
make repairs.
