HomeMy WebLinkAbout1978-01-30 Board of Selectmen MinutesJ.~?~.RY 23, 1978 (continued) CYR- FOSTER: Charlie Bud Cyr appeared before the Board in reference to his letter in which he stated that/Foster, Building Inspector, ignored his letters pertaining to drainage and driVeway permits. Cyr also complained that the Town Departments were his biggest obstacle in his work...that he doesn't receive any cooperation from them. He stated that Poster should have told him he could not help him because of the town by-law, Sec. 11, Article III which states..."No drive- way or other means of access to privately owned property from any public way or any way maintained by the Town or shown on an approved subdivision plan, shall be constructed unless a permit for its entry into said way shall first have been issued by the Highway Surveyor.,' So drainage or driveway permits are under the Highway Surveyor's Jurisdiction only.. Paul Lamprey, Planning Board Chairman, cemented that he had heard there was a lack Of communication between the Building Inspector's office and other departments..' Selectman McEvoy made a motion to have the Building Inspector meet with the Selectmen on January 30, at 7 p.m., to clear the charges, as alleged, cleared up. ~lice M. McEvoy with Chairman John F. Ceady presiding. The minutes and warrant were approved as submitted. BUTLBING INSPECTOR: Charles Foster, Building Inspector, met with the Selectmen, at their request, to discuss alleged lack of communication between his department and other departments as stated by ~..CyF, Highway .Surv.eyo? .and. Chairman Ceady then asked there is no communication problem between the Planning Board and the Building Inspcector. Lamprey replied that there was no question that the Building Inspector is not communicating with the Planning Board and other Boards. Coady stated that a letter from the Board of Health indicated that there was no communication gap between them and the ~!ding Inspector. Foster remarked that the Building Inspector and the Planning Board share the same office and were in constant touch with business of the Planning Board. Planner and Nrs. Joyce of the Board of Health were in and out of his office constantly and all three have a good, working relationship, no problems whatsoever. ~lso with the Assessor's office. Poster was glad that Mr. Lamprey retracted his' statements . of last week and that from the facts that the Board has received from other Boards, he would like vindication from the Selectmen that the Building Inspector does not deserve what was said at last week's meeting. Mr. Coady said that there seems to be a problem between the Building Inspector and an elected official, the Highway Surveyor, that the Building Inspector. should respond to Cyr's letters. Foster replied that the letters were 3 or 4 mo~ths old and thatC2w was ihzlly aware of what the Building Inspector could do about driveways and easements..that permits for same could not be determined by the Occupancy Permit of the Building Inspector. Poster found it difficult to attach importance to Cyr's complaints on driveways and easements for they were under the jurisdiction of the High%my Surveyor, Town By-Laws, Article III, Section 11. ) Cyr's appearance before the Board the previous week was a deliberate attempt to discredit Foster in the eyes of the commumity. Coady asked if Poster ~ .~ was stating that he has answered ali the letters from the Highway Dept. either verbally or in writing? Should they be answered in writing 'instead df orally?. Foster stated that he normally did. He thought Cyr"s situation had been resolved, that he had answered him totally. McEvoy said Poster should =n~wer~ every letter sent to him, in writing, no matter who it is, to protect himself. Foster agreed but what bothered him was the other accusations. Coady asked if the Building Inspector and the Planning Board ever been on a registered letter basis? Lamprey said, "No." Coady stated that the solution would be that to every written letter, there should be a written reply. Guthrie agreed that would be the key to the solution. Coady stated that the situation that emfsts between Cyr and Fost6r is another matter..both have responsibilities to carry out duties of each department. Guthrie stated that it was difficult to bridge any gaps as the Selectmen do not get enough communication from the department heads. Coady then asked Poster if he would answer,~ sll letters seat to him, in writing and Poster replied,',yes.,'. McEvoy then made a motion, seconded by Guthrie, stating that evidence shows that communication~is not lacking between the ~?~ ding Inspector and Cyr and other departments. Allan Firth, 32 Cabot Road, an Engineer and Joseph K. Nigrelli, 50 William St, retired were drawn by Selectman NcE~oy to serve on February 28th Sitting, at Salem. POLE lOCATIONS: Petition to install 7 poles on Barker St. and a petition to replace 1 existing pole on Mass. Avenue were approved. SNO~.~ BUDGET: ~etter received from Highway Sarveyor stated that snow budget was almost depleted and suggested that a minimal amount of $50,00 will be needed to carry the department through the winter. Guthrie stated that he was opposed to any monies to that extent, that requests should be made only on "need" basis. He made a motion which was seconded, that $20, $00 be ~lloted at this time. 4TH OF JULY COmmiTTEE: Selectman McEvoy reported that he had conferred with last year's committee, the Lion's Club who stated that if was fine with them if the V~Y would like to run this year's observances but they ~ould like to have a booth at that time. The Selectmen voted unanimously to give the Job to the V.F.W. They will be notified by letter. LAGASSE & NICOSIA: At the hearing of Police Officers Walter Lagasse and Charles Nicosia, convicted of conduct unbecoming to Police Officers, the Board of Selectmen unanimously voted to dismiss them. Letters will be sent to Civil Service, ~reasurer and Town Accountant. The two officers will be so notified. TC~*T WARR~: The Board voted unanimously to ea~end the time to close the Warrant for Articles from January 30, 1978 to February 13, 1978. Guthrie stated that the time w as needed to correct articles that were incomplete. REV~E SHARING: Letter received stating audit be made once every three years on revenue sharing Article was discussed for the cost of said Article. CLOSING DATE-NOMinATION PAPERS: Town Clerk, erroneously, but in good faith, publicized February 3, 1978 as the last day to submit for certification of nomination papers for the Mmrch 6th annual Town Election. The last day to submit these papers should be January 30, thirty-five days before the election. The Selectmen summoned Mr. Lyons in to discuss the error. Mr. Lyons stated that Rep. Joseph He,mann would contact the Secretary of State requesting an extension of the grace period to February 3, 1978, as .p~licized. Atty. Ralph Joyce questioned the validity of the exbension, raised the validit~f the to~,n election which question he stated should be referred to To~en Counsel. Atty. Joyce is running for the office ~tSelectman. Tox,~ Counsel is his boss. Chairman Coady replied that the Selectmen would~sue the validity of the extension until the question is raised. An an~,er is expected from the Secretary of State on the rotter by February t, 1978~ FIRE ENGinEERS MEETING: Meeting ~ith the Fire Engineers will be postponed until the Board has met with the Local Firemen's Union to hear their proposals. RECEIVED: Notice of Cable TV Committee meeting, February 1, 1978, Selectmen invi%ed. Nototized appointment of Atty. Pdchard Sullivan, Special Toxen Counsel. Letter re flood insurance.
