Murphy's decision that the project on Waverly Rd. does not require an Environmental Impact . I Study. ~s. Donahue stated that Murphy paid no heed to the many letters from citizens, town officials and town departments requesting a study. She requested that the Selectmen asked Town Counsel to search this particular matter of appeal and that he advised what stops could be taken by the town, if any, and that it be done right away. Letter from Planning Board stated that inasmch as they are aware the subject land lies within a wetlands area and that a project of this magnitude will only serve to increase the already existing sever~ dmainage and flooding problems, they wish to go on record as being in suppor~ of an appeal of Secr~ary Mur£hy's determination not to require an Environmental Impact Study. The Board voted to refer the matter to T~n Counsel. Chairman Coady stated that no official notice had been received by the Beard and that he will not appeal again. LICENSING OO~SSIONERS: Eaggie's Place - Notice from the Board of Heslth advised the Selectmen that Naggie's Place closed as of Sunday, March 19, 1978. Present management should not be allowed to reopen until our sanitarian has a chance to discuss $~ith them the necessary changes entailing a new, sub-surface sewerage disposal system. Application received for a Restaurant, Common Victnal i3.icense on premises foz~nerly known as Joey's Place, 3_140 Osgood St., from Paul V. Davis and others. Hearing will be held on April 18~ 1978, at 7:30 p.m. M. Letarte, Secretary ~':~"~'x~*~'~^~*×~**~m~"~* ~Clerk APRIL 3 1978 The Beard of Selectmen held their regular meeting on t~s date with a3.l five members present; Selectmen Guthrie, McEvoy, Salisbury and Joyce with Chairman Cea6y presiding. The warrant and minutes were approved as submitted. CLA~ STREE~ GATE: Letters received from the Public Works, Fire, Police and Highway Departments stated their approval of the request to erect a gate on Clark Street. Selectmen voted to request advice from Town Counsel as to the proper procedure, if any, is necessary to issue the permit. R~ISTRARS VACANCY: Certified letter received from the RePUblican T~m Committee contained request that they be notified by certified mail when resignation of Fred MaCormack is received. They stated, that under the state law, the Republican Town Committee should serve as the exclusive conduit for the names of candidates to fill the coming vacancy. Brian to look into party affiliation rules of the Registrars of Voters. FEDEP~Z COORDINATING OFFICER: Letter of appreciation for town's cooperation after the February 6-8 blizzard was received from. Joe D. T~inkle, Federal Coordinating Officer. Brian Sullivan stated that the to~ had received ~he sum of .~13,000, but was appealing the amount as it was approximately $1000.OO short. He stated that he knows tha~ they left out one invoice and would try to get the amount due the town. ARCHDIOCESE HOUSING APPEAL: Letter(copy) sent to Marge Luening, Nass. Ho~sing Finance Anthority~frcm Evelyn F. Murphy stated that the proposed construction of low~inaome housing project by' the Archdiocese did not require an enviornmental impact study. Chairman Coady stated that the expense of an appeal would be considerable, that the same issues and subject m~tter will be brought up again before the same Committee and there was ns doubt the same judgment would be reache~. Therefore, it was senseless to appeal, it would just be a waste of money. Selectman Gnthrie motioned that the town pursue the avenue of appeal if an appeal is available; to confer with Town Counaelo Selectman Salisbury seconded the motion. Vote was 3~e - 2-Yen. Selectman Joyc.e state~othat he was opposed to the appeal as he agreed with Chairman Coady that the appeal will go/~he same people that negated the study. HUD CO/$DIViTY DEVELOP~ENT PROGRAM: Brian Su3.livan, Adm. Assistant, advised the Board that last year the to%m submitted a Joint application with the Town of Andover for a program to assist elderly and Iow-income homeowners make health and salty improvements to their homes. Although the to%m did not receive funding, our application was chosen as first alternate. Brian suggested that the tow~ submit the same application this year except that the town do it themselves, without Andover. Two public hearings must be held prior to submitting the application on May 15th.. It was so voted. It was also voted to have the Chairman send letter of support for 60 units. TO~ GARAGE: Brian Su~_livan stated needed imprcvem~ents for the towu garage. The first one was to provide a hookup for an emergeacy generator to the gasolin~ pumps in the event that the electrical power is cut off. Presently, the Town Depts. would not be able to pump gasoline if there was a power faf&ute. Second, was to move the thermostats to a higher location so that they are not in cold areas close to the g~o.~nd. Final improvement was the installation of fire alarms or smoke detectors in the garage. Brian presented a quote from John Thompson for the first two items. ~ote was approved. A smoke detector could have been used last Friday. A smold- ering chair caused close to $3000. smoke damage in the Highway company room. Brian S. is to get prices to clean up the smoke damage at the garage.
