The Board of Selectmen held their regular meeting on this date ~dth all members present; Sel-
ectmen Joseph A. Guthrie, Thomas J. McEvoy, Charles .~. Salisbury, Ralph 2. Joyce ~*ith Chairman
John F. Coady presiding. The warrant and minutes were approved as submitted.

The Board approved the location of the Christian Life Community Church, Inc., 151 Raleigh,
Tavern Lane.

R. Jeffrey Riotte appeared before the Board to advise them of the work the Merrimack Valley
Planning Commission would be doing in the next months.
YMCA ELDERLY LEASE:
After a previous meeting ~.~th the Chairman of the Community Center Trustees, the members of
the Board agreed that there should be a formal vote of the Board authorizing T mm Counsel
draft a lease ~.~ich would be agreeable to the Trustees. The Board voted unanimously to
authorize To~.m Counsel to drax.z up lease end Brian Sullivan to draft en Article for Snecial
To~.m Meeting. -
Invitation received for.~thm Submission of a Final Application (Small Cities & To~ms)'for
funding from the Dept. of Housing and Urban Development. Board voted to do so, ~ voted to
have ,a Public Hearing on October 18, 1978. Application ~.~11 be for $123~000 funding.
~IGiEfAT TRAFFIC SAFE~/ FU~ING:
Application received for i~nding assistance for hlgh~y traffic safety attenuators from the
State Department of Putxlic Works. Referred to the High,.my Surveyor and police safety officer.

Three letters received from the I{igh~.my Surveyor requesting assistence to c~ect money
to the tox~ for plod. ring out the Meadow View apartments during last year's blizzard, trash
pick-un at the Village Green condimini~ms and the drainage inst~3_lation for the Waverly
Archdiocese apartment construction. All letters referred to Tot.m Counsel for advice.

Letter received from the Board of Health re indemnification of the members of the Board of
Health. Board referred the matter to To~.~ Counsel for advice.
SPECIAL T U~E,;
After discussing ~.~ith Bill Salemne the duties of a future Planner it ~.ms determined that a
Special To~.rn l.~eting had to be held to change the title of the Planner: leaving out his
affiliation with the Board of Health. The Board voted to hold the Special To~m Meeting on ·
November 27, 1978: at 7:30 p.m. in the ;.tiddle School. Marrant ~.ms opened on this date, 10-
16-~8 and x. rlll close on November 6: 1978. Notices x.dll be sent to all departments and
committees.

Brian S. brought up the fact that the Board voted, in May, 1978, to prohibit parking along
Mass. Ave. from Bacon Avenue to 0sgood Street, effective September 1st unless the re. mere of
the "99" Restaurant resolved their p~rk~ug problems. The Selectmen voted to refer the m~tter
once again to Chief Lawlor for his recommendation for ne~ meeting,
CABLE TV HF~L~I~D:
Purpose of the henring ~.ms to assess the q~ifications of the applicant, Continentsl Cable. TV
and to revie~.~ the differences between the Select~en's report and the proposal submitted by
the applicant. Items, five in number, st~3~ had to be negotiated. Atty. Elias, attorney for
Cable TV, Richard Barranht, Man~ger and John R~caski, Vice President ~.rere present to ~xplain
the Cable TV services and to and,er questions. Mr. P~cas!~ stated that it x. ms a single
cable system, that they had 210 substations in 9 states, Cable TV was their only business and
he submitted a letter of credit. Service to schools ~.ms one of their designated areas ~.~th
reception of 35 channels. They were prepared to put up a $25,000 bond plus insurance coverage

built in 4 months aud 100 homes p~r'.m!le ~.M1~ be ser~.~ed. He was asked if more homes per
mile could be reduced if density increased. Answer: "Yes." John Robinson, Chairman of the
Cable TV Committee, highly endorsed the implementation of the contract. After an hour and
a half of diseussion~ the fo!lox, ring motion ~.ms made and seconded, vote being unanimous:
"To notify Continental Cable TV, subject, to resolving the differences between the Selectmen's
Report and Continental Cable TV's proposal, it is the Board's intent to grmut Continental TV
a provisional license." Selectman Guthrie ulso motioned that the to~.m~'s Cable TV Committee
be sent a letter of tho.uks and appreciation for the time and effort they expended on this
committee.

NERRINACE COLLEGE:
App!ication~received for a 1-day liquor license~ October 24,1978, at Merrimack College.
Application received for a 1-day beer license, October 20, 1978, at Nerrim~ck College. Both
licenses were taken under advisement until Chairman ~Evoy discussed the applications xeith

~dx.~rd Bardsley failed to show for a scheduled meeting with the Selectmen to discuss the
operation of his ts,~i. A letter ~.~11 be sent once again, certified, notifying him of a formal
hearing on October 30, 1978, at 8:15 p.~. to consider complaints against the operation of
t~.~i and to determine ~ether his license should be suspended or revoked. It ~1 be request-
ed that he or his representative be present at the hearmn~. ~
