The Board of Selectmen held their regular meeting on this date with all members p~esent;
Selectmen Thomas J. MoEvoy, Charles A. Salisbury, P~lph R. Joyce, John W. Grahamwith
Chairman Joseph A. Guthrie presiding. The warrant and minutes were approved as submitted
with the exception of the Planner's salary.
AGRICULTURAL P~q~SERVATIONRESTRICTION ACT-BA~ERLAND:
The signing of the endorsement of George Barker's application under the above-named Act
came before the Board. A discussion ensued as to the cost of the application. Selectman
Joyce stated that To~.m Counsel should be authorized to prepare the necessary documents as
it was an unusual and complex procedure. Selectman Guthrie said that Barker should pay
for it and asked if the Board could endorse it without Town Meeting action. Selectman
McEvoy stated that both the Conservation Commission and Planning Board had endorsed the
application and that was assurance enough for him. 'Vin Turano statedthat the cost could
be~bm~rbed by C~mservation Co~,~,~ssion funds. Selectman Salisburymade a motion to submit
the application to Town Counsel for his opinion. Seconded by MoEvoy, vote was unanimous.
POLICE EL~.~:
It was an unanimous vote to authorize the Chairman to call for a Civil Service promotional
exam for the position of Police Sergeant.
P~0VIS!ONAL POLICE SE~ANT:
Upon the recommendation of Acting Chief Donnelly, Selectman McEvoy made a motion to appoint
Jack Lanni, a provisional Police Sergeant. Motion seconded by Selectman Graham and the
vo~e was unanimous. Donnel!y's second and third choices were Thomas Giaqninta and James
Carabe!lo. Also mentioned for future Sergeant positions were Naurice Lynch and Raymond
Canty who both h~ had Law Enforcement training.
DOG OFFICER APPOINTMENT:
It was voted to conduct interviews with the Dog Officer applicants on Tuesday, April 24th
starting at 7:45 p.m.
PUBLIC WO~S ARTICLE: 9:45 P.M.
The Selectmen reopened the l'~arrant to accept an Article that establishes rules and regula-
tions for the use of town parks and playgrounds. Chairman Guthrie stated that the' Depart-
ment of Public Works was responsible for the maintenance and upkeep of the parks and play -
grounds but did not have the authority to regulate their use. Supt. Borgesi is conaerned
about the green on the 01d Center c~,~on because it is being used for football and certain
groups are hanging around the common causing considerable littering. The park is not in=
tended for that type of use but should be used for passive activities such as band concerts
and picnics. At the present time, the lawn at the common is marred by deep, tire m~rks.
Borgesi was requested to submit the back-up regulations for the Article before the Warrant
goes to press so the townspeople will be informed on what they are voting for.
SCHRU~DER ARTICLE:
Before the Board could close the Warrant, George Schruender requested that an Article, sigmed
by ten citizens, be inserted in the I.~arrant. The Article called for a revision of the
Zoning By-Law to allow self-service gas stations in North Andover. After a few remarks
about the danger of re-epening the I~arrant, the Board voted to accept the Article for in-
clusion and the ~Yarrant was subsequently closed at 9:50 P.M. '
THIRD FIRE STATION:
A letter was received from the Board of Fire Engineers re a proposed third fire station.
After a discussion, Selectman Joyce motioned, seconded by Graham, unanimous vote that the
Board will call for candidates to serve on an Ad Hoc Committee to study the proposal and
submit their recozmmndations to the Selectmen. It was proposed that the co~,,.~tte consist
of I member from the Board of Selectmen, I member frc~ the Board of Fire Engineers and 3
interested and knowledgeable citizens. The Fire Engineers will be so advised by letter..
T~OP 81:
The Board approved the request for Troop 81 to use the Town Farm picnic area onJune 2,
rain date, June 3, for their annual chicken harbecue. Police and fire chiefs will be so
notified.
HISTORICAL CO~E~SSION SIGN:
The subject of having a sign made indicating the Town Building was built in 1925 was dis-
cussed. Selectman Salisbury stated that he wasn't too e~cited about the fact that the
building was built in 1925. G~thrie stated that permission would have to be given by the
Building Inspector. Vote taken 2-2. MoEvoy had to leave.
A.r~ITRATORAPPOINT~:
The Board voted to go into executive sessionafter the Selectmen's meeting on the above-
named matter.
ULD~'~i~ PAPJ~S FUNDiNG:
Letter from County Planner gave infoz~ation re Urban Parks and Recreation Recovery Program
funds. The Board vote to have Brian peruse the information to see if North Anclover quali-
fies for any of the grants.
BICYCLES: It was voted unanimously to authorize Chief Donnelly to ~ispose of bicycles at
the police station by an advertised auction. He will be so notified~

Bequest from Planning Board to endorse House Bill 5731. Tabled until more information rec'd
Invitation to annual Essex County Se!ectmen's Association dinner meeting. Sel. McE~oy going
Letter from Governor King re solid waste disposal.
Annual Chamber of Commerce dinser. Board voted to authorize Chairman to reserve table for
the Board. Event will take place, May llth at the Gr. Law. Voc School
Chairman G~thrie will try to make Legislative Dinner, April 26th.
Letter from Howard Crozier re contributions for participation of Phil ~latson in the inter-
national competition as a Member of the Mass. ~.Yrestling Team in l~est Germany. Voted to be
posted on bulletin board.
OVERPASS:
Malcolm Norwood appeared before the Board protesting Advisory Board's action for not approv-
ing an Article to have the overpass sandblasted to remove ?r~itten vulgarities that'are
visible from the Brookside To~.rn House complex. He said some interested citizens would ~
it themselves. He also requested permission to remove the cement in front of his house be-
cause he wanted to plant shrubbery there. Brian ~ms authorized to pursue the request.
HEAE~G --SCHOOL ST. PA~ING:
A hearing was held to reconsider a former decision of the Selectmen on restriction of
on School Street. Malcolm No~;ood stated the businessmen of Main Street were grateful that
the two-hour parking was finally bein enforces, but he said they hoped the angle parking '~
would not be abolished. ~fter considerable discussion the Board voted unanimously on
man Joyce's motion, seconded by Selectman Graham, to amend the traffic rules and re~?lstions
as follows: Parking prohibited on School Street, northerly side, for a distance of 178 feet
from Main Street. Angle parking allowed on School Street, southerly side, for a distance of
135 feet from Main Street. It will be so advertised and Police Department notified.
LICENSING CONMISSIONERS:
HEARING-MCGRegOR:
A hearing was held on the application of Alexander McGregor for a T~etaurant, All Alcoholic
license on premises located on Saville Street, North Andover. ~.~neu asked ~ry Chairman Salis-
bury, what king of establisl~nent did he propose to run McGregor replied that he intended to
sell drir~m and sandwiches. He did not intend to serve dinners like steak and lobster, etc.
It would be a limited menu - no chef. Selectman Guthrie asked how big x. ms opening of street.
McGreg~replied street was 40' wide. Guthrie stated that one of the major concerns on Rt.
ll4 were the exits and ent~ng: Chairman Salisbury asked why the Planning Board changed
lng and McGregor answered/§amd that he had a fence busines and wanted to do retail business
on the fence business also. Selectman Graham asked about the rest of property, and about
parking space. McGregor stated that the rest of the area he intended to rent..that he had
two offers..one, from Ventura Refrigerator Co., selling ~eli and prime meat supplies...the
other~ was a company that sold pet foods and supplies. He said Savllle Street was a paper
street. ~s~tions were answered by McGregor: He expected to seat 100 people, would have
music and dancing. Yes, there was a septic systmen there. A petition was submitted ~ith
144 signatures who wished to go on record that they were against the granting of the liquor
license. Thirteen other people present spoke registering that they were against the license
because of dangerous traffic conditions; opposed to a Mall and a liquor license; that it
would become another Rt. l, opposed because of zoning; did not want it to become a hangout
for teenage-~s and out-of-townere. Selectman Guthrie stated he would not vote for any liquor
license on Rt. ~4 because of safety problem. Chairm~n Salisbury also stated the danger of
increased traffic was his main concern. Selectman Graham said his concern was the parking.
Abutters stated they were opposed to the granting of the license not McGregor. Selectman
McEvoy stated that McGregor ~s an exemplary citizen, that he has done a lot for the tm*n,
could not see denying license because of traffic and made a motion to grant the license.
Selectman Joyce seconded the motion stating that Rt. !~4 was zoned for business and would
support business and application. Business on Rt. il4 would bring tax revenue to the town.
The application was denied..3-2 vote. Joy, e, McEvoy for and Guthrie, Salisbury, Graham
against.
HFARING- B~E~T:
A hearing was held on the application to operate two taxi cabs to be located at the Lawrence
Airport from Henry N. Bennett, ll Moran Ct., law. Mass. Bennett stated that he intended to
give 24 hr. service through a dispatcher in his la~rence cab office, that he had parking spa¢
use at the Airport. His rates would be the prevailing rates, 755 for the first mile. Glair-
man Salisbury stated that his rates should not be more than the other cabs even if the cab
came from Lawrence. Bennett stated, when questioned, that he operated 8 cabs out of La~menoe
school busses, also. That he had 14 cab licenses, expected to put two more on road. He
admitted that he had been operating a taxi cab busiuess in North Andover without a license,
that he was answering the telephone as North Andover Town Tarot, that he had been taking
calls since April 17th, also, when he ~*as told by the Board that he couldn't until he had a
license. Selectman Guthrie stated that Bennett showed a lack of respect for the Board by
operating without a license. Selectman MCE~oy stated that Beunettx*as deceitful and ha~been
· charoo-lng a much higher rate that existing licensed cabs in town. Selectman McEvoy stated
that an adverse recommendation had been received from the Police Chief and made a motion to
deny the cab license, Selectman Joyce seconded, and the vote ~,as unanimous to deny the
