The Board of Selectmen held their regular meeting on this date with all mem-
bers present except Selectman Salisbury, away on business. Present were
Selectmen McEvoy, Joyce, DiFruscio with Chairman Graham presiding. The mtnut~
and warrant were approved as submitted.
CONSERVATION'COMMISSION:
A 'letter received from the Conservation Commission contained a request for
permission to have a Special Counsel represent them in a legal action they
proposed to take against Mr. Turtle, a builder, who has not complied with
the items he is required to do by the Conservation Commission. As a result,
run-off problems created by his build~ng is continuing ~ausing damage to
Stevens Pond. The Department of Publxc Works seeks re~tution on this damage
AS Mr. Lafond stated, the Public Works, Town Planner and the Highway Surveyor
had received little cooperation from Turtle concerning the problems created
by his subdivision off of Great Pond Road and fully support the C. C. in
plan to bring him to court. Mr. Lafond stated that an enviornmental special-
ist was needed prior to the court case. It was voted 3 to 1 to appoint a
Special Counsel for the C.C. Selectman Joyce abstained from voting. Jim
Lafond advised the Board that his Commission would report back next week with
a list of persons from which the Selectman would appoint Special Counsel.
SPEED REGULATION:
The Selectmen approved the Speed Regulation as submitted by the Mass. DPW.
It was an unanimous vote. The.Board assured the residents of Chestnut St.
who were present that the speed signs would be installed as soon as possible
and would be upheld.
TRUCK RESTRICTION-CHESTNUT STREET:
The Board of Selectmen unanimously approved and voted to adopt an amendment
to the Traffic Rules and Regulations to restrict heavy commercial vehicles
from using Chestnut Street and Hillside Road to the Salem Turnpike (Rt. 114)
The alternate route shall be by way of Chickering Road and Salem Turnpike,
(Rt. 114). A part of the motion was to have Brian S. find out whether or not
Rea owned property on Chestnut Street. If he did, he would have the right to
use the street.
DISTRICT CT.-TICKET PROCESSING:
Brian advised the Board that Chief Donnelly has recommended and offered to
send over Officer Jim Cars~ello to the District Court to help process the
Town's back-log of violation notices. Officer Carabello, since his injury,
is only capable of doing limited duties so is available for this work.
Selectman McEvoy stated that he resented being pressured by newspaper article~
or threatened by Judges but he would assent to sending Carabello over to do
the work. Selectman Joyce stated that he would not change his previous vote,
that he was against sending help over to Lawrence even to process North
tickets. Vote was 3-1, Joyce against.
POLICE CHIEF EXAMINATION:
Notice of Police Chief's Examination scheduled for February 6, 1982 received.
Date of exam approved unanimously.
STREETf~LIGN~S:~
The matter of eliminating street lights to stay within the budget was dis-
cussed. Brian S. advised that there were a few more streets to be surveyed
after which the report would be ready.
SPORTS PROGRAM BOOK:
It was unanimously voted to have a message from the Board of Selectmen
inserted in the 10th Annual High School Football Super Bowl Program in the
event the North Andover High School Football Team competes. At the request
of Selectman DiFruscio, it was voted to send a letter to the coach and team
after the Thanksgiving Game.
PARKING BAN:
Brian advised the Board that the All Night Winter Parking Ban would be
advertised.

MERRIMACK COLLEGE:
Letter received from Police Chief concerning recent events at Merrimack
College that is causing him concern. He stated that on three recent
occasions, members of his department were called to assist the security
guards and the Andover Police department to quell disturbances at which
times his officers were roughed up and uniforms torn. He stated that there
was hO.doubt that the serving of liquor is the primary problem although
one was arrested for possession of marijuana. He also stated that the
arrests they have made many times in the past at the college are not
students. He remarked that his officers were not getting the help they
should from the security guards at the college, and that at least a
dozen of the security guards have the power to arrest disorderly persons.
It is evident that somebody is not controlling the problems at the college
that arise at functions that have a large attendance. He wan~s, to know if
the Board would object if he were to refuse to assign any of his police
officers to private details at the college in the future. On this request,
the Board did not take any vote, nor voiced any opposition. Chairman
Graham said Chief Donnelly had informed him that he was meeting with official
of the college on Wednesday n~rning to discuss the problem..After discussion
the Board voted unanimously to schedule a hearing on Monday, December 7, with
Merrimack College officials to discuss the alleged liquo_r violations.
