HomeMy WebLinkAbout1981-12-14 Board of Selectmen Minutes'332 DECEMBER 14 1981 The Board of Selectmen'held their regular meeting on this date with all mem- bers present except Selectman Salisbury. Present were Selectmen McEvoy, Joyce, DiFruscio with Chairman Graham presiding. The Warrant was approved. The minutes were not approved because Selectman DiFruscio was not present at the last meeting. Chairman Graham said they would approve them at the next meeting. JUROR: Phyllis Guptill, 93 Johnson Street, was in Lawrence.Superior Court. drawn for the January 4th Sitting, IDFA BONbING: The Board of Selectmen voted unanimously to approve the bonding of the following companies ..IDFA had approved the requests previously: Atrwa s Associates: Robert'Webster proposes to build a structure on leased land at the Airport for industrial use. Bonding approved: $641,250. Ca ricorn Cot :d b a Willow Industrial Park Pro'eet: Robert Regan proposes to build approximately 100,000 sq. ft. of buildings on Lots S' and Lot G", two separate lots in the Industrial I area. He will lease the buildings out to business firms. Bonding approved: $3,750,000. ~edical Research Center: Construction of a building of approximately 6,000 sq. ft., contiquous and attached to an existing building. Bonding approved: $850,000. tO LABOR RELATIONS SERVICE: . SELECTION: ~LRC~ITECTURAL, DESIGN, MARKETING FIRMS: - Gayton Osgood reported to the Board that the Committee had reviewed six finalists and made the following recommendations: For the architectural and Engineering services for construction of the Senior Center, Parking Lot and Handicapped access~o the Library,' they recommended City Design Colla- borative, Inc., Cambridge, Mass. For the Urban Design work for Main Street, they recommended the same company. For the market analysis for Central Business District they recormmended, Urban System Research and Engineering Inc., Cambridge, Mass. The proposed contracts will be ready in about two weeks for the Selectmen's perusal and approval. The above-named two firms will be hired contingent on their contract. If contract is no~ negotiated, the C6'mmittee will go to second choices. The contracts will be signed by' the Chairman of the Selectmen and the 'firms chosen. ~t was an unanimous vote to approve the Co~nittee's selection of firms. ' It was also voted to send a letter of thanks to' members of the Committee who did such a good job. PARKING FINE PROGRAM: ~ Br~an presented the Board with alternatives to expedite the parking fine program. He recommended the Board to vote to accept the provisions of Chapter 90, Section 20A 1/2. It allows the Boardto set its own fine schedule up to $15 and has a fine on the first offense. The only drawback is the 11% administrative cap. It was an unanimous vote to accept Sec. 20A 1/2. Brian~submitted afire, schedule which has been recommended by the Chiefs .from Methuen, Andover and North Andover. They recommend that the fines be the same in all three Towns so we can take advantage to bulk buying. It was an unanimous vote to adopt the fine schedule, as presented, and pro- vide for a $5.00 penalty if not paid within '21 days and a $15.00 penalty if paid after the Parking Clerk notifies the Registrar. The Board ~iscussed using a computer firm and the matter of a parkingclekk. Brian recommended CFI for processing of the tickets because CFI is the least costly. If the system is done manually, Brian stated, it would be an in- efficient use of the.Parking Clerk's time who would have to be paid more because it wou~ take so much more time. _ 333 DECEMBER 14, 1981. (continued) PARKING FINE PROGRAM (continued) Brian also stated that if the system is computerized, the compensation of the Parking Clerk should be half of what it would be if the system was manual. This savings could be used to offset the computer costs. Brian recommended the'Board vote to contract with CFI to process the parking tickets. Selectman Joyce thought there should be a call for proposals. Applications for the position of parking clerk were discussed, and the duties thereof. After discussing the guidelines, it was unanimously voted to appoint Karen Robertson, part time Selectmen's Secretary, the parking clerk,..to in- crease her hours, 3 or 4 hours more a week, and to contract CFI for processing the tickets. STREET LIGHT REQUEST: Thomas Leonard, Waverly Road, appeared before the Board to request a street light in the vicinity of his house on Waverly Road. The Board was told that there was a 400 ft. stretch of road without any light and that his. house and several other resident's homes had been vandalized. After discussion, it was voted to have Selectman McEvoy and Brian Sullivan look at the area and report back to the Board. CONSTABLE APPOINTMENT: It was an unanimous vote~ to appoint John Manning a Constable to Town of North. Andover for the term of three years. serve in the PROCLAMATION: It was unanimously voted to sign a proclamation for the March of Dimes Drive and to give copies to the news media. DAc~NSING COMMISSIONERS: GAS0LINE STORAGE: A hearing was held on the application of Edward N. Norris t6 store additional gasoline (30,000 gas, 5,000 diesel) at his service station at 701 Salem St. Residents' in t~ area were present to protest the application (Joseph Belanger, Mr. Augeri, Mr. Letourneau, a former owner of the garage, and Ralph Angelo) They'stated that there were many children in the area, a school bus stop was nearby, ~hey feared the water table would be in jeapordy, a garage wasn't needed ih a residential area. Selectman Joyce advised that Town Meeting had voted the zoning of the garage as a business location. Mr. Norris stated that his property was used as a school bus turn-a~ound. Fire Chief Currier approved the application, also. Board voted to send letter to Chief Donnelly and the School for their recommendations on the application. Application decision was tabled until the next meeting on December 21st. ROY ARCADE APPLICATION: Raymond Roy appeared before the Board to advise that his application far an arcade had changed to a new location, t~e Sweeney property on Sutton Street. Mr. Roy stated that the property, an eyesore for many years, would be renova- ted, parkin~ would be obtained from the old Messina's store lot and from taking down the old cement buildings. He stated that the Arcade would be a place for children and teens to go where they would be properly supervised and occupied (North Andover does not have a place for them now). Smoking, drinking (not even Coca Cola) would not be allowed. The center would keep them off the streets. But he cannot go ahead with any plans until he has a license. He asked the Board to grant him a temporary license of 6 months and, if in that time, they weren't satisfied with the way his .business is being run, they could revoke it. Selectman Graham stated that he has diffi- culty accepting the machines, but the Board must have a solid reason why the license is denied. Selectman McEvoy stated that parking would have to be provided but the proposed business would be a big improvement in that area. --,~-- ~,~ mo allow this aoDlication at this location. Selectmen Joyce made a mo~ion to deny. without prejudice and table the application until next week. Vote 3-0-1. DiFruscio abstained. On Selectman Grabam's motion, vote was unanimous. 334DECEMBER 14, 1981 (continued) CUMBERLAND FARMS APPLICATION: Pamela Mullen was present to protest the denial of a license for 1 video machine at the Cumberland Store. She stated that this was not an arcade, just one machine,and that every other Cumberland Store had been granted license for a video machine. The application.was tabled until next week's meeting. SPYR0'S RESTAURANT & STAR PIZZA: Application for a video machine at Spyro's Restaurant, and an application for a second machine at Star Pizza, also tabled until the December 21st meeting. 110 Sutton Street, 15 Eirst Street, was COMMON VICTUALER LICENSES APPROVED: Treadwell's Ice Cream, Captain Pizza, Messina's Market, The General Store, and Burger King. RETAIL PK~. GOODS STORE-WINE & BEER: -~- Application received for the above-named license from John J. Enright on premises at 7 Johnson Street, d/b/a The General Store. Hearing was set on that application for January 11, 1982. MERRIMACK COLLEGE: Reverend Joseph Gillen appeared before th~ Board to discuss three incidents., that had occurred at Merrimack College. Se!e~man Graham told Fr. Gtllen that they never had any trouble with Merrimack College before the three in- cidents, that he understood the persons out of order were non-studenfs. His.:chief concern were t~ students, underage, drinking at the school, and asked what was being done. Fr. Gillen stated that, in the future, before they plan to have any concerts, they would consult with the Selectmen and Police Chief Donnelly. Merrimack College is trying to educate the students. To advert trouble with non-students, a student has to sign his guest any event. If the non-student starts any trouble, the sponsor student is suspended. He also stated that the maxim that the Last Pub is open is 3. times a week. Selectman McEvoy stated that he did not want the Town~oli6e- men abused when they were called. Joyce told Fr. Gillin that the reports received were potential license violations and that the college cannot be treated any differently than any other license holders. Selectman Graham stated that the big thing is that the students understand and suggeste~ that when a 1-day liquor license is requested, the students should be present at the meeting when it is granted. Father Gillin agreed to t~is policy..Selectman Graham told Fr. Gilli~ he appreciated his presence at the meetzng.
